The City Council requested that you draw a resolution granting the attached
appeal of William D. Naiditch to relax the density standards so as to permit
a 17 -unit apartment building on Lots 17, 18 and 19, Block 21, A. Gotzian's
Rearrangement of Sigel's Addition, at the southeast corner of E. Fourth St.
and Hancock.
The Council also requested that you prepare a resolution granting the attached
application of William D. Naiditch for a 17-car parking lot permit on that
property, in accordance with plans dated February 23rd, 1961.

Dear Madam:
This is in the matter of William D. Naiditch's 1) appeal to relax the density
standards to permit a 17 unit apartment building on a lot of insufficient area,
and 2) application for a permit to construct and operate a 17 car off - street
parking lot accessory to said apartment building on property located at the
southeast corner of E. Fourth and Hancock Streets. The property is described
as Lots 17, 18, and 19, Block 21, A. Gotzians Rearrangement of Sigel's Addition.
The coning is commercial and has been since the enactment of the Ordinance in 1922.
The site which is presently vacant is of irregular shape with a frontage along
E. Fourth Street of 153.97 feet and 159.34 feet along Hancock Street with a
depth from E. Fourth Street of 140 feet. The width across the rear portion of
this .lot is 80 feet; the total lot area amounts to approximately 16,380 square
feet. This property lies approximately seven feet above the street grade of
E. Fourth Street, and at its highest point is approximately 12 feet above the
street grade of Hancock Street. The proposed development does not meet the
minimum density standards recently adopted by the City Council, but does meet
the puilding ground coverage requirements. To meet the required density standards,
the lot area should total 17,000 square feet. As stated above, the lot area con-
sists of 16,380 square feet. Because of this shortage in area, it is necessary for
the applicant to appeal to the council for permission to erect the 17 unit apartment
building.
East and adjoining is a single - family residence which fronts on Fourth Street;
south and across an unimproved public alley is vacant land; directly west across
Hancock Street is vacant land, farther to the west are single - family residences
fronting on Fourth Street; diagonally across the intersection is vacant property
and farther to the west are single - family residences; directly north across
Fourth Street is the site for a proposed 11 unit apartment building which is under
construction. The applicant's parking lot plan filed on January 25 does not meet
the standards for this type of facility. However, there is sufficient space to
make the installation in accordance with the required standards.
Field investigation discloses that it would be possible to develop this site as
proposed by substantially changing some of the existing grades of the property. 1
The Board of Zoning considered these matters at their regular meeting on Feb-
ruary 2, 1961, ana it is their opinion that the recently adopted density require-
ments should be adhered to. No true hardship exists in this case, as the site
can be developed for 16 units which would meet the required standards. Therefore,
the Board of Zoning recommends the denial of both the appeal to relax the density
standards, and the application for a permit for a 17 car off-street parking lot on
the above described property. -

I, William Naiditch, owner of the Lots 17 -18 & 19, Blk. 21,
A. Gotzians rearrangement of Siegels Addition, S. W. corner of
Fast Fourth and Hancock Streets, which is at present vacant,
propose to construct a two and one -half story, seventeen unit
apartment building.
I appeal as required under legislative zoning code Chapter '
64.03, paragraph I. to helax the requirement under Chapter 60.24
of the zoning code which provides 1000 square feet per unit of
which we are 700 feet deficient.

Dear Madam:
This is in the matter of William D. Naiditch appealing to relax
the multi - residential density standards of Chapter 60.25 of the
Legislative Zoning Code which were enacted by the City Council
on December 10, 1960. The applicant is desirous of constructing
a 17 unit apartment building on a lot of insufficient area, and
is also - asking permission to install and operate a 17 car private
off-street parking lot accessory to the apartment building. This
property is located at the southeast corner of East Fourth Street
and Hancock Street. This matter was considered by the City Council
on Thursday, February 23 at which time the Board of Zoning sub-
mitted its report and findings. The Council, hoping to find a
solution in this matter, referred it back to the Board of Zoning
for further study.
I wish to report that the Board of Zoning again considered this
matter at their regular meeting on March 2, 1960 and found no
reason to change their recommendation for denial of the relaxation
of the density standards, meaning that this property should not be
developed beyond the maximum density standard of 16 units. The
applicant's parking lot plan has been amended and now meets the
required standards for this type of facility. The Board of Zoning
therefore recommends the granting of a pdrmit for a 17 cfik private
off-street parking lot on Lots 17, 18, 19, Block 21, A. Gotzian's
Rearrangement of Sigel's Addition in accordance with the parking lot
plans as filed and dated February 23, 1961.
