1 WFIEREAS, Deparhnent of Safety and Inspections has requested the City Council to
2 hold public hearings to consider the advisability and necessity of ordering the repair or wrecking
3 and removal of a one and one-half story, wood frame dwelling and its detached, wood frame
4 garage located on property hereinafter refened to as the "Subject Property" and commonly
5 known as 575 CHARI.ES AVENUE. This property is legally described as follows, to wit:

WHEREAS, based upon the records in the Ramsey County Recorder's Office and
infoiznation obtained by Department of Safety and Inspections on or before May 12, 2008, the
following are the now known interested or responsible parties for the Subject Property: Federal
Natl Mtg Assn, 1 S Wacker Dr, #3100, Chicago, IL 61616; Wilford & Geske, 7650 Currell Blvd,
#300, Woodbury, MN 55125; Countrywide Home Loans, 7105 Corparate Dr, PTX-C-35, Plano,
TX 75024; Fannie Mae, c/o Dawn Reinke, 2026 Eaglewood Circle, Shakopee, MN 55379;
Thomas-Da1e District 7 Planning Council.
WHEREAS, Department of Safety and Inspections has served in accordance with the
provisions of Chapter 45 of the Saint Paul Legislative Code an order identified as an"Order to
Abate Nuisance Building(s)° dated July 18, 2008; and
WITEREAS, this order informed the then known interested or responsible parties that the
structure located on the Sul�ject Property is a nuisance building(s) pursuant to Chapter 45; and
WHEItEAS, this order informed the interesCed or responsible parties that they must repair
or demolish the structure located on the Subject Property by August 18, 2008; and
WHEREAS, the enforcement officer has posted a placard on the Subj ect Property
declaring this building(s) to consritute a nuisance condition; subject to demolirion; and
WHEREAS, this nuisance condition has not been corrected and Department of Safety
and Inspections requested that the City Clerk schedule public hearings before the Legislative
Hearing Officer of the City Council and the Saint Paul City Council; and
WHEREAS, the interested and responsible parties have been served notice in accardance
with the provisions of Chapter 45 of the Saint Paul Legislative Code, of the time, date, place and
puipose of the public hearings; and
WHEREAS, a hearing was held before the Legistative Hearing Officer of the Saint Paul
City Council on Tuesday, October 28, 2008 to hear testimony and evidence, and after receiving
testimony and evidence, made the recommendation to approve the request to order the interested

or responsible parties to make the Subject Property safe and not detrimental to the public peace,
health, safety and welfare and remove its blighting influence on the community by rehabilitating
this skucture in accordance with all applicable codes and ordinances, or in the alternative by
demolishing and removing the sriucture in accordance with all applicable codes and ordinances.
The rehabilitation or demolition of the structure to be completed within fifteen (15) days after
the date of the Council Aearing; and
WHEREAS, a hearing was held before the Saint Paul City Council on Wednesday,
November 19, 20�8 and the testimony and evidence including the action taken by the
Legislative Hearing Officer was considered by the Council; now therefore
BE IT TtESOLVED, that based upon the testimony and evidence presented at the above
referenced public hearings, the Saint Paul City Council hereby adopts the following Findings and
Order concerning the Subject Property at 575 CHARI.ES AVENUE.
That the Subject Property comprises a nuisance condition as defined in Saint Paul
Legislative Code, Chapter 45.

That the costs of demolition and removal of this building(s) is estimated to exceed
five thousand dollars ($5,000.00).
That there now exists and has existed multiple Housing or Building code
violations at the Subject Property.
4. That an Order to Abate Nuisance Building(s) was sent to the then known
responsible parties to correct the deficiencies or to demolish and remove the
building(s).

That the deficiencies causing this nuisance condition have not been conected.
That Department of Safety and Inspections has posted a placud on the Subject
Property which declares it to be a nuisance condition subj ect to demolition.
That this building has been routinely monitored by Department of Safety and
Inspections, Vacant/Nuisance Buildings.
8. That the known interested parties and owners are as previously stated in this
resolution and that the notification requirements of Chapter 45 haue been fulfilled.
ORDER
The Saint Paul City Council hereby makes the following order:
The above referenced interested or responsible parties shall make the Subject Property
safe and not detrimental to the public peace, health, safety and �velfare and remove its
blighting influence on the community by rehabilitating this structure and correcting all

deficiencies as prescribed in the above referenced Order to Abate Nuisance Building(s) in
accordance with all applicable codes and ordinances, or in the altemative by demolishing
and removing the structure in accordance with all applicable codes and ordinances. The
rehabilitation or demolition and removal of the structure must be completed within
Tifteen (IS7 days after the date of the Council Hearing.
If the above corrective action is not completed within this period of time Department of
Safety and Inspections is hereby authorized to take whatever steps are necessary to
demolish and remove this structure, fill the site and charge the costs incurred against the
Subject Property pursuant to the provisions of Chapter 45 of the Saint Paul Legislative
Code.
In the event the building is to be demolished and removed by the City of Saint Paul, all
personal property or fixtures of any kind which interfere with the demolition and removal
shall be removed from the property by the responsible parties by the end of this time
period. If all personal property is not removed, it shall be considered to be abandoned
and the City of Saint Paul shall remove and dispose of such property as provided by law.
It is further ordered, that a copy of this resolution be mailed to the owners and interested
parties in accardance with Chapter 45 of the Saint Paul Legislative Code.

The building is a one and one-half story, wood frame, single-family dwelling with a detached
one stall garage, on a lot of 2,178 square feet.
According to our files, it has been a vacant building since September I, 2006.
The current property owner is the Federal National Mortgage Association, per AMANDA and
Ramsey county property recozds.
The City of St. Paul has boarded this building to secure it from trespass.
There have been seven (7) SUMMARY ABATEMENT NOTICES since 2006.
There have been seven (7) WORK ORDERS issued for:
- Removal of tall grass and weeds
- Removal of refuse and miscellaneous debris
- Removal of graffiti
- Boarding
On July 1, 2008, an inspection of the building was conducted, a list of deficiencies which
constitute a nuisance condition was developed and photographs were taken. An ORDER TO
ABATE A NUISANCE BUILDING was posted on July 18, 2008 with a compliance date of
August 18, 2008. As of this date this property remains in a condition which comprises a nuisance
as defined by the legislative code.
The Vacant Building registration fees are paid. {Paid via assessment on 10/22l08)
Taacation has placed an estimated market value of $19,300 on the land and $72,500 on the
building.
As of August 1Q, 2007, a Code Compliance inspection has been completed.
As of October 24, 2008, the $5,000.00 performance bond has not been posted.
Rea1 Estate taaces are current.
Code Enforcement Officers estimate the cost to repair this structure is $50,000-$75,000. The
esrimated costto Demolish is $10,300 to $14,3Q0.
NHPI, Division of Code Enforcement Resolution submitted for consideration orders the property
owner to repair or remove this struchue within fifteen (15) days, if not the resolution authorizes
the Division of Code Enforcement to demolish and assess the costs to the property.

Inspections, Division of Code Enforcement, hereby declares the premises located at:

to comprise a nuisance condition in violation of the Saint Paul Legislative Cade, Chapter
45.02, and subject to demolition under authority of Chapter 45.11.
On July Ol, 2008, a Building Deficiency Inspection Report was compiled and the following
conditions were observed.
This list of deficiencies is not necessarily all the deficiencies present at this time.
As first remedial action, a Code Compliance Inspection must be obtained from
the Building Inspection and Design Secfion, 8 Fourth Street East, Suite 200,
Commerce Building (651)266-9090. That inspection will identify specific defects,
necessary repairs and legal requirements to correct this nuisance condition. You
may also be required to post a five thonsand dollar ($5,000.00) performance
bond with the Building Inspection and Design Office before any permits are
issued, except for a demolition permit.

This building(s) is subject to the restrictions of Saint Paul Ord'anance Chapter 33.03
and shall not again be used for occupancy until such time as a Certificate of
Compliance or a Certificate of Occupancy has been issued.
This is a one and one-half story, wood frame dwelling and its detached, wood frame
garage.

BUILDING
1. Properly install weather barrier and siding on front porch.
2. Install front steps and landing to code.
3. Install handrail and guardrail to code for second floor stairs.
4. Install handrail and guardrail on stairs to baseinent to code.
5. Tuck Point interior lexterior foundation as needed.
6. Provide thumb type dead bolts for a11 entry doors. Remove any surface bolts.
7. Repair or replace any deteriorated window sash, broken glass, sash holders, re-putty
etc.as necessary.
8. Provide storms and screens complete and in good repair for all door and windaw
opemngs.
9. Repair walls and ceilings throughout, as necessary.
10. Prepare and paint interior and exteriar as necessary (take the necessary precautions if
lead base paint is present).
11. Provide general clean-up of premise.
12. Provide smoke detectors as per the Minnesota State Building Code.
13. Repair soffit, fascia trim, etc. as necessary.
14. Provide proper drainage around house to direct water away from foundation.
15. Install downspouts and gutter system as needed.
16. Provide generai rehabilitation of gazage.

All plumbing work requires pernit(s) and must be done by a plumbing contractor licensed in
Saint Paul.

HEATING

3. Clean and Orsat boiler burner. Check all controls for proper operation. Submit
report from licensed contractor.
4. Check fiunace heat exchanger for leaks, provide documentation.
5. Provide back flow preventer on city water fill line to hot water{steam heating system.
6. Repair and/or replace fin tube radiation and covers as needed.
7. Appropriate Mechanical Permits are required for this work.
ZONING
This house was inspected as a single family home.
As owner, agent or responsible party, you are hereby norified that if these deficiencies and the
resulting nuisance condition is not conected by August 18, 2008 the Department of Safety and
Inspections, Division of Code Enforcement, will begin a substantial abatement process to
demolish and remove the building(s). The costs of this action, including administrative costs
and demolition costs will be assessed against the property taYes as a special assessment in
accordance with law.
As first remedial action, a Code Compliance Inspection Report must be ohtained from the
Building Inspecrion and Design Section, 8 Fourth Street, Suite #200, Commerce Building,
(651)266�9090. This inspection wi11 identif� specific defects, necessary repairs and legal
requirements to correct this nuisance condition.
As an owner or responsible party, you are required by law to provide full and complete
disclosure of this "Order to Abate" to all interested parties, a11 present or subsequent renters and
any subsequent owners. If you sell, transfer, or convey in any manner, the ownership ar

responsibility for this property, you must wittun seven (7) days, notify the Enforcement Officer
with Yhe names and addresses of any new owners or responsible parties.
The Enforcement Officer is required by law to post a placard on this property which declares it
to be a"nuisance condirion", subject to demolition and removal by the City. This placard shall
not be removed without the written authority of the Department of Safety and Inspections,
Division of Code Enfoxcement. "I'he department is further required to file a copy of this "Order
to Abate" with the City Clerk's Office.
If corrective action is not taken within the time specified in this order, the Enforcement Officer
will norify the City Council that abatement acuon is necessary. The City Clerk will then
schedule dates for Public Hearings before the City Council at which time testimony will be
heard from interested parties. After this hearing the City Councfi will adopt a resolution stating
what action if any, it deems appropriate.
If the resolution calls for abatement action the Council may either order the City to take the
abatement action or fix a time within which this nuisance must be abated in accordance with the
provisions of Chapter 33 of the Saint Pau1 Legislative Code and provide that if corrective action
is not taken within the specified time, the City shall abate this nuisance. The costs of this
action, including administrative costs will be assessed against the property as a special
assessment in accordance with law.

There was considerable storagefclutter within property at the time of the inspection. Property is
to meet appropriate Codes when complete.
All items noted as recommended do not have to be completed for code compliance but should be
completed at a later date. Possible purchasers of property shall be made aware of these items.
This is a registered vacant buiiding. In order to reoccupy the building, all deficiencies
listed on the code compliance report must be corrected and be in compliance with the
Minimum Housing Standards of the St. Paul Legislative Code (Chapter 34), and all

4. Ordering the owner to remove or repair the building(s) at 575 CharlesAvenue within fifteen
(15) days from adoption of resolution.
The property owner of record, Federal National Mortgage Association, did not appear. No other
parties of interest appeared.
Mr. Ma�er stated the building was a one and one-half story, wood frame, single-family dwelling
with a detached one and one-stall garage on a lot of 2,178 square feet and had been vacant since
September 1, 2006. A code compliance inspection had been done on August 10, 2007, the vacant
building registration fees in the amount of $1,000 went to assessment on October 22, 2008, and the
$5,000 performance bond had not been posted. On July 1, 200$, an inspection of the building was
done and a list of deficiencies which constitute a nuisance condition was developed. An order to
abate a nuisance building was posted on 7uly 18, 2008 with a compliance date of August 18, 2008.
To date, the property remained in a condition which comprised a nuisance as defined by the
Legislative Code. Ramsey County Taxation estimated the market value of the land to be
approximately $19,300 and the building to be $72,500. Real estate taxes were current. Code
Enforcement esrimates the cost to repair The building to be approximately $50,000 to $75,000. The
aost for demolition was estimated to be approximately $10,300 to $14,300. There had also been
seven summary abatements issued to this property since 2006, seven of which went to wark order:
to secure the building and the City had to board the building to secure it from ttespass, remove
refuse and miscellaneous debris, boarding, cut tall grass and weeds, and remove graffiti. Code
Enforcement recommends the building be repaired or removed within 15 days. Mr. NLagner
presented photographs of the property.
Ms. Moennond asked how they became aware this was a vacant building. Mr. Magner stated that
the code enforcement inspectar condemned the building due to numerous code violations and
referred the property to Vacant Buildings.
Ms. Moermond asked far a report from Ms. Spong. Ms. Spong stated that this building was built in
1889 as a worker's cottage-style building. This property was located in the potential Frob own
historic district and had not been surveyed; however, she believed it was a potential historic
resource in the neighborhood. She noted that this neighborhood was unique in that two houses were
built on one lot, as side-by-sides, and then the lots were subsequently split.
Mr. Magner stated that there was a high concenCration of residential structures in this nei�borhood
and the goal was to reduce density given the history of problems in the area. Ms. Spong responded
that PED's recommendarion conflicted as they believed higher density of narrow houses was
preferable to building high rises to meet the housing needs for this area.
Ms. Moermond stated that since no one appeared, she recommended the building be removed or
repaired within 15 days.
