THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN:

Section 1., That the Zoning Code, Chapters 60 to
64 inclusive bf the Saint Paul Legislative Code, as amended,
pertaining to Use Districts, Height Districts and Rezoning
of certain properties, in the City of Saint Paul, be and the
same is hereby further amended so as to rezone the following
described property from "A" residence to Commercial District,
to -wit:
All of Lots 17 and 18, together with
Lot 16, except that part taken for the
widening of White Bear Avenue, Block 6,
Hazel Park Division 4, at the northeast
corner of Stillwater and White Bear
Avenues. '
Section 2. This ordinance is hereby declared to
be an emergency ordinance rendered necessary for the preserva-
tion of the public peace, health and safety.
Section 3. This ordinance shall take effect and
be in force upon its passage, approval and publication.

Dear Madam:
This is in the matter of the petition of the Grace English Evangelical
Lutheran Church to rezone from "At1 residence to commercial property located
at•the northeast corner of Stillwater and White Bear Avenues. The property
is described as all of Lots 17 and 18, together with Lot 16, except that
part taken by the City of St. Paul for the widening of White Bear Avenue,
Block 6, Hazel Park Div. No. 4.

On September 28, 1960, the applicant filed a petition to rezone the above
tract which was declared insufficient on November 14, 1960. The petition
was -refiled and on February 10, 1961, the Commissioner of Finance reported
the petition sufficient with the owners of 11 of a possible 16 (68.75 %) tracts
of land within the prescribed 100 foot radius having signed the petition.
The property is presently developed with a church structure and parsonage.
The church building was erected in 1917 and the parsonage in 1924. If re-
zoned, the property will be developed with a filling station operation. This
property has a frontage of 115.92 feet along Stillwater Avenue and a front-
age of 124.31 feet along White Bear Avenue, resulting in an area of approxi-
mately 14,410 square feet. Directly east and adjoining is a single - family
residence, then five vacant lots owned by the petitioner and utilized for
off - street Larking purposes in connection with church functions, farther
east are for single - family residences which occupy the remainder of the
block; north and across an unimproved public alley are single - family residences
fronting on both White Bear and York Avenues; northwesterly across White Bear
Avenue is a recently constructed building which provides office space for a
chiropractor and an insurance agent and four residential units; directly west
across White Bear Avenue is a one -story medical clinic and also a vacant tract,
farther to the west are single - family residences fronting on Stillwater Avenue;
southeasterly across Stillwater Avenue are single - family residences fronting
on said street, and directly south across Stillwater Avenue is an existing
filling station operation; diagonally across the intersectionof Stillwater
and White Bear Avenues is a two - family residence fronting on White Bear Avenue.
The residences mentioned are substantial and in good repair, some of them
having been constructed in recent years.
Field investigation discloses that the existing church use has provided a
desirable transitional use between the residential properties and the commer-
cial character of White Bear Avenue to the south. f
The Board of Zoning considered this matter at their meeting on February 16, 1961
and recommend the granting of the petition to rezone the above described p-rA. J
