08-1271Council File # Ggy a� � Green Sheet # 306z998 RESOLUTION SAINT PAUL, MiNNESOTA / Ip Presented by i 2 3 4 5 6 7 8 9 l0 I1 12 13 14 15 16 17 i8 19 20 21 22 23 24 25 26 RESOLUTION AUTHORIZING APPLICATION TO THE DEPARTMENT OF EMPLOYMENT AND ECONOMIC DEVELOPMENT FOR CONTAMINATION INVESTIGATION AND CLEANUP GRANTS AND TO THE METROPOLITAN COUNCIL FOR TAX BASE REVITALIZATION GRANTS FOR THE NEW HORIZON SCHOOL, OLD HUDSON SElVIOR HOUSING, THE PENFIELD, THE RENAISSANCE BOX, THE COMMERCIAL CLUB, NOVA CLASSICAL ACADEMY, LEXINGTON COMMONS, AND MISSI5SIPPI MARKET SITES WHEREAS, the City of Saint Paul, Minnesota is a participant in the Livable Communities AcPs Housing Incentives Program for 2008 as determined by the Metropolitan Council, and is therefore eligible to make application for funds under its T� Base Revitalization Account; and WHEREAS, the Cify has identified environmentai investigation and clean-up projects within the City that meet the purposes and criteria of ttie Contamination Investdgation and Cleanup Gr^ant Program of the Department of Employment and Economic Development, and the Tax Base Revitalization Account Grant Program of the Metropolitan Councii; and WHEREAS, the City finds that the required contamination cleanup will not occur through private or other public investment within the reasonably foreseeable future without DEED'S Contamination Investigation and Cleanup Grant Program funding and the Metropolitan Counci]'s Tax Base Revitalization Account Grant Program funding; and WHEREAS, the City represents that it has undertaken reasonable and good faith efforts to procure funding for the activities for which Livable Communities Act Tax Base Revitalization Account Grant Program funding is sought but was not able to find or secure from other sources funding that is necessary for cleanup completion and states that this representation is based on the following reasons and supporting facts: 27 • The City of Saint Paul has extremely limited redevelopment funding sources and no funding source 28 dedicated to investigating and remediating contaminated properties; 29 • The extraordinary cost of remediating contamination adds no coilateral va7ue to a property that can 30 be used to attraet private financing; and sl • Attracting potential developers to contaminated sites in the inner city is greatly facilitated when 32 grant funding is available to investigate and quantify the potential costs of remediating the property, 33 34 NOW, THEREFORE,, BE IT RESOLVED, that the City Council of the City of Saint Paul, Minnesota 35 hereby approves the contamination invesfigation and cleanup grant applications submitted to the 36 Department of Employment and Economic Development and the Metropolitan Council on November 3, 3� 2008 by the City of Saint Paul for the New Horizon School, Old Hudson Senior Housing, the Penfield, the 3s Renaissance Box, the Commercial Club, Nova Classical Academy, Lexington Commons, and Mississippi 39 Market sites; and 40 41 BE IT FURTHER RESOLVED, that the City of Saint Paul, Minnesota agrees to act as legal sponsor for a2 the projects contained in the cleanup grant applications submitted to DEED and the Met Council on 43 November 3, 2008 and that the Director of the Department of Planning and Economic Aevelopment is D ��ld'71 4a hereby authorized to apply to BEED and the Met Council for funding of these pro}ects on behalf of the as New Horizon School, Old Hudson Senior Housing, the Penfield, the Renaissance Box, the Commercial a6 Club, Nova Classical Academy, Lexington Commons, and Mississippi Mazket sites; and 47 as BE IT FIJRTHER RESOLVED, that the City has the legal authority to apply for financial assistance, and 49 the insritutional, managerial and financial capability to ensure adequate project administration; and 50 5t BE IT FITRTHER RESOLVED, that the sources and amounts of the local match identified in the 52 applications are committed to the projects idenfified; and 53 54 BE IT FURTHER RESOLVED, that the City of Saint Paul certifies that it has not violated any Federai, 55 State or local laws pertaining to fraud, bribery, graft, kickbacks, collusion, conflict of interest, or other 56 unlawful or corrupt practice and that it will comply with all applicable laws and regulations as stated in the 57 contract agreements; and 58 59 BE IT FURTHER RESOLVED, that upon approval of its appiications by the Department of Employment 6o and Economic Development and the Metropolitan Council the City of Saint Paul may enter into agreements 61 with the State of Minnesota for the above-referenced projects, and that the City of Saint Paul certifies that it 62 will comply with a11 applicable laws and regulafion as stated in all contract agreements;
