PMOLVO, upon and pursuant to the appeal of G. E. McCall
therefor, that the provisions of the Zoning Code, Sections 60.02 and
60.25 of the Saint Paul Legislative Code,'be and the same hereby are
varied and relaxed to the extent necessary therefor, and a special permit
hereby is granted for the proposed rearrangement of Lots 21+ and 25,
Chesterwood Addition, in respect of housing allocations, to the end that
the residence building on said Lot 24, otherwise designated as 1872
Mississippi River Boulevard, shall be allocated in frontage along Mississippi
River Boulevard 50 feet, a depth approximating 125.3 feet, and an area of
approximating 8,061* square feet, and that the remaining portion of said
lots combined will represent an "L" shaped tract incorporating a 30 foot
frontage on Mississippi River Boulevard., a depth of 201+.67 feet, and a
width upon the rear line of the same of 80 feet, and an area of approximately
8,310 square feet, and for the installatioin, maintenance and use thereon of an
additional residence building approximately 57 feet in width to be removed
from another location, that designated as 1892 Mississippi River Boulevard,
and installed on said "L" shaped tract; and that the aforesaid provisions
and all other provisions of said Zoning Code hereby are varied to the
extent necessary for the effectivergrenting of said special permit hereunder.

Dear Madam:
This is in the matter -of the appeal of G. E. McCall for a relaxation of
Sections 60.02 of the Legislative Code pertaining to required minimum ;
lot frontage, and 60.25 pertaining to the division and reduction of the j
size of a lot presently developed with a residence. The property in `
question is located on the north side of the Mississippi River Boulevard if
between South Prior Avenue and the West Seventh Boulevard and is described
as Lots 24 and 25, Cbesterwood Addition, The zoning is "A" residence.
In,1947, Lot 24 was developed with a single - family residence. Lot-25-
adjoining on the east, is presently vacant and used for yard purposes
accessory to the residence on Lot 24. The applicant proposes to combine
the two lots, and then re- divide said two lots so that the exist ng resi
dence on Lot 24, known as 1872 Mississippi River Boulevard,_would have a
f antage along he River Bou evard of 50 feet, and a depth of approximately
125�3-fee resu ting in an area of`°8,064 square feet. The remaining por-
tion of the two s would create an "L�s�i,aped trg• ct prAv_ ding, a 30 foot
from ou evar and a depth of 204.67 feet. The width at-tbe

approximately 8,310 square feet. It is proposed to move the residence now
at 1892 Mississip ver Bou rd on to the rear portion of the "L" shaped
tract. This residence is 57 feet in width and is so designed that it would
require a lot having a minimum width of 65 feet.
It should be pointed out that Section 60.02 of the Legislative Code re-
quires a minimum lot width of 40 feet in an "A" residence district.
Section 60.25 of the Legislative Code also states briefly that it is illegal
to-reduce the size of a lot already occupied by a building. In order for
Mr. McCall to deviate from these provisions, be must secure a variance of
same from the City Council.
East and adjoining the property under consideration is a two- family resi-
dence, farther to the east is the extended Trunk Highway #5 right -of -way;
to the west are two single - family residences, also the off - street parking
lot of St. Theresa's Catholic church; north and across a public alley are
single - family residences fronting on Norfolk Avenue. All of the residences
in this area are very substantial in nature. South and adjoining is the
Mississippi River Boulevard. The rear elevation of this property is appro-
ximately five feet higher than the River Road elevation.

The Board of Zoning, after considering this matter at their regular meet-
ing of May 4, 1961, wishes to report that the granting of this appeal, in
their opinion, would establish a very undesirable precedent. It would
violate the established building line in the block, and it would adversely
affect the open character of the adjoining residential yards.
In consideration of these factors, the Board of Zoning recommends the
denial of the appeal as outlined above.

This house is of brick co struction•,only four or five
years old and should enhalbe beauty of neighbacrhood on
proposed location.

for house to be moved onto.
I have already been awarded the bid,with intention of
moving it onto this large lot but was not aware of the
limitations of law passed last year until advised by
Mr Schroeder.

To the Honorable Mayor and the City Council:
We, the undersigned property owners in the area
of 1872 So. Mississippi River Blvd., wish to express
our opinions in regard to the movement of the
house vhh ich is now located at 1892 So. Mississippi
River Blvd: and is proposed to be moved to the
vacant 40 foot lot between 1872 and 1884 So.
Mississippi River Blvd. Tie size of this house•
is such that it can not be placed on a 40 foot
facing the street as the house was origionally
built to face. We strongly object to the placing
of this house in any position other than in line
with the present established line of homes
If this house were to be placed in any position
behind the established line of houses we feel an
invasion of back yard privacy would result.
We have no objection to the movement of this house
onto this lot if it can be set in line with the
established line of houses and does not infringe
on the building code of the city of St. Paul.
