Whereas, Orville Lancaster, employe
of the Board of Water Commissioners
of the City of Saint Paul, was injured
in a third party accident on March 24,
1960, and in this connection the Board
of Water Commissioners has expended,
on behalf of the employe, the sum of
$802.15 for medical expense and the
sum of $432.00 in Workmen's Compen-
sation benefits for time loss; and
Whereas, A compromise settlement
has been arrived at in the total-mm'

WHEREAS, Orville Lancaster, employe of the Board of
Water Commissioners of the City of Saint Paul, was injured in
a third party accident on March 24, 1960, and in this connection
the Board of Water Commissioners has expended, on behalf of the
employe, the sum of $802„15 for medical expense and the sum of
$432.00 in Workment s Compensation benefits for time loss; and
WHEREAS, a compromise settlement has been arrived at
in the total sum of $5,000, and the Corporation Counsel is in
possession of a draft in that amount issued by St. Paul Fire
and Marine Insurance Company, insurer of Loren Erickson, third
party involved in said accident, payable to Orville Lancaster,
Stanley Mosio, his attorney, and the City of St. Paul; and
WHEREAS, .it is the recommendation of the off ice' of
the Corporation Counsel that the City accept, in full settlement
of its subrogation claim in this matter, the sum of $925.58
less attorney's fees to said Stanley Mosio of one -third that
amount, $308.53, or a net amount of $617.05, now, therefore,
it is hereby
RESOLVED, That the Board of Water Commissioners and
the City of Saint Paul, through proper officers, accept the sum
of $925.58 less attorney's fees, or a net sum of $617.05 in full,
final and complete settlement of its subrogation claim against
the third party involved in said accident, and that said sum be
credited to the Water Department Fund; be it
FURTHER RESOLVED, That the proper City officers are
authorized and directed to endorse said draft in the amount of
$5,000, payable to the employe, his attorney and the City.
