WHEREAS, the City of Saint Paul is currently acquiring
or has acquired various properties for construction relating to
the Saint Paul Flood Control Project; and
WHEREAS, it is imperative that the following described
property, to the extent indicated, be made available to the
Corps of Engineers for Stage One of the project and that assur-
ances of availability of such properties for use by the Corps
of Engineers in connection with such project be given to the
Federal Government from and after the 2nd day of June, 1961; and
WHEREAS, in the following described properties, the
Federal Government requires that the availability of such proper-
ties, to the extent indicated, for use by the Corps of Engineers
'be immediately granted by the City of Saint Paul so that the
Federal Government can let a necessary contract or contracts
with reference to the aforesaid Saint Paul Flood Control Project;
NOW, THEREFORE, BE IT RESOLVED that the Council of the
City of Saint Paul finds that, with reference to certain of its
properties located on Harriet Island, hereinafter described,
said. properties, -are required .for use by the Federal. Government,
acting through the Corps of Engineers, Saint Paul District, in
connection with the Saint Paul Flood Control Project, and this
Council further finds that the rights hereinafter granted to the
Corps of Engineers for the use of such properties as herein-
after expressed is consistent with the grant of title to the
City of Saint ,Paul, subject to the conditions .that said
land should be forever held by the City and used for the
purposes of public bathing and recreation grounds, since the
�aoint Paul Flood Control Project with reference to such lands
contemplates that the Corps of Engineers will temporarily
use certain areas for a borrow area and will construct on
said property a small boat harbor and, in consequence thereof,
the Council of the City ' of Saint Paul is prepared to grant

and hereby does authorize and grant to the Federal Government,
acting through its Corps of Engineers, its contractors, its
agents, servants and employees, for the period required to
complete the aforesaid Saint Paul Flood Control Project,a
temporary easement with the right to fill and to operate a
disposal area and the right to operate a borrow area and to
construct a small boat harbor on the following portion of
Harriet Island: That land lying within the following de-
scribed lines: Commencing at a point being the intersection
.,of the center line of the C. & N. W. Ry. Co. main track and
�a line lying 25.'feet southwesterly from and parallel to the
extended northeasterly line of Lot 13, Rose-a's Addition;
thence bearing northwesterly along said last described line
a distance of 125.0 feet to the point of beginning of the
property to be described; thence bearing -S 58052' W a dis-
tance of 597.2 feet; thence bearing S 441JOOIE a distance of
90.0 feet; thence bearing S 510.511W a distance of 4.99.0 feet;
thence bearing N 410431W a distance of 160.9 feet; thence
bearing N 320031E a distance of 505.0 feet; thence bearing S

BE IT FURTHER RESOLVED, that the Council of the
City of Saint -Paul hereby authorized and grants to the
Federal Government „ acting through its Corps of Engineers,
its contractors, its agents, servants and employees, for
the period regdred to complete the aforesaid Saint Paul
Flood Control Project, a temporary easement required for
the construction, operation and maintenance of a levee
access ramp on the following described property, located on
Harriet Island: That land lying beneath the Wabasha Street
Bridge, bu not to include the bridge, lying within the

following described lines: Commencing at the southwest
corner of Lot 4, Block H, Robertson's Addition; thence
bearing along the northwesterly line of said lot a distance
of 10.0 feet to the point of beginning of the property to be
described; thence bearing southwesterly at right angles to
said northwesterly line of Lot 4 a distance of 60.0 feet;
thence at right angles bearing northwesterly a distance of
55'; thence at right angles bearing northeasterly a distance
of 60.0 feet; thence bearing southeasterly to the point of
beginning. Also that land lying within the following de-
scribed lines: Commencing at the Monument located at the
intersection of the north line of Water Street and the west
line of Daniel Street; thence bearing N 510361W a distance
of 222.0 feet; thence bearing S 3603 'W a distance of 108.0
feet; thence bearing S 580111W a distance of 250.0 feet to
the point of beginning of the property to be described;
thence bearing S 89037' W a distance of 370.0 feet; thence
bearing S 310521E a distance of 72.9 feet; thence bearing
N 810021E to the point of beginning, being part of SE4,
Sec. 6, T -289 R -22. Also two small areas at the bottom of
Ramp "C" and Ramp "D" as colored in blue on the map numbered
49 attached hereto, and made a part hereof by reference;

BE IT FURTHER RESOLVED, that the Council of the
City of Saint Paul hereby authorizes and grants to the
Federal Government, acting through its Corps of Engineers,
its contractors, its agents, servants and employees, for
the period required to complete the aforesaid Saint Paul
Flood Control Project a temporary easement required for the
construction of flood walls, dikes, and other structures
being located on Harriet Island and bein� part of the
South 2, Sec. 61 T -281 R -22, and the SW4, Sec. 7, T -28,
R -22, the limits of said temporary easements shown colored
yellow on the attached prints, marked Maps 3, 4 and 5, copies
of said maps being attached hereto and made a part hereof
by reference;
BE IT FURTHER RESOLVED, that the Council of the
City of Saint Paul hereby grants to the Federal Government
acting through its Corps of Engineers, its contractors,
agents, servants and employees, a permit to use certain
streets in connection with said Flood Control Project of
the City of Saint Paul, as hereinafter more fully described:
That part of Ethel Street lying between the extended
northwesterly line of Block 194, Irvine's Addition
to West St. Paul, and a line parallel to and 30 feet
southeasterly from said extended northwesterly line
of Block 194.

That part of Daniel Street lying between the extended
northwesterly line of Block 191, Irvine's Addition
to West St. Paul and a line parallel to and 30 feet
southeasterly from said extended northwesterly line
of Block 191.
BE IT FURTHER RESOLVED, that the Council of the
City of Saint Paul hereby grants to the Federal Government
acting through its Corps of Engineers, its c�2ntra 0?16'11owing agents, servants and employees, a permit to /M _
street for the construction of flood walls and dikes and with the
right to fill to elevation 703.0:
That part of Belle Street lying between the extended
northwesterly line of Block 203, Irvine's Addition
to West St. Paul, and a line parallel to and 60 feet
southeasterly from said extended northwesterly line
of Block 203.
BE IT FURTHER RESOLVED, that the Council of the
City of Saint Paul hereby grants to the Federal Government
acting through its Corps of Engineers, its contractors, agents,
servants and employees, a permit to temporarily use the
following street for the construction of flood walls and dikes
for flood control purposes and also a permanent easement over
the same for the construction and maintenance of a public
sewer:
That part of Moses Street lying between the extended
northwesterly line of Block 189, Irvine's Addition to
West St. Paul, and a line parallel to and 25 feet
southwesterly from said northwesterly line of Block 189:.
BE IF FURTHER RESOLVED, that the Council of the
City of Saint Paul hereby grants to the Federal Government
acting through its Corps of Engineers, its contractors, agents,
servants and employees, a permit to temporarily use the follow-
ing street for the construction of flood walls and dikes for
flood control purposes and with the right to fill to Eleva-
tion 701.0:
That part of Water Street lying between the west line
of State Street and the extended west line of Lot 1,
Block 1, Marshall's*Addition to West St. Paul; also,
the West 2 of State Street lying between the extended
south line of Water Street and a line parallel to and
61 feet northerly from the north line of Water Street
also the easterly one -half of the intersection of
Water Street and State Street.

BE IT FURTHER RESOLVED, that the Council of the
City of Saint Paul hereby grants to the Federal Government
acting through its Corps of Engineers, its contractors, agents,
servants and employees, a permit to use West Water Street
from the extended northeasterly line of Lot 8, "Rosen Addi-
tion" Saint Paul, Minnesota, to 175 feet southwesterly of
the southwesterly line of Lot 13, "Rosen Addition ", at the
existing grade or at the grade which the Council may establish,
pursuant to,the proceeding with reference to establishment
of a grade,along Water Street in the City of Saint Paul, in
the vicinity of the area hereinbefore referred to, which pro -
ceeoing to establish a grade is presently pending before the
Council of the City of Saint Paul;
BE IT FINALLY RESOLVED, that the Council of the
City of Saint Paul hereby authorizes and directs the proper
City officers of the City of Saint Paul to cooperate with
the Federal Government and its Corps of Engineers, Saint
Paul District, with reference to preparing and executing
such other or further documents as the Corps of Engineers,
Saint Paul District, may request of the City, consistent
with the intent and provisions of this resolution.
