Presented
WHEREAS, Depariment of Safety and Inspections has requested the City Council to
hold public hearings to consider the advisability and necessity of ordering the repair or wrecking
and removal of a one and one-half, wood frame, single family dwelling with an oversized, one-
stall garage located on property hereinafter refened to as the "Subject Property" and commonly
lrnown as 1500 YORK AVENUE. This properiy is legally described as follows, to wit:

WHEREAS, based upon the records in the Ramsey County Recorder's Office and
information obtained by Deparhnent of Safety and Inspections on or before Apri12, 2007, the
following are the now known interested or responsible parties for the Subject Property: Dennis
A GuptiULynn M Guptil, 6360 Glacier Lane, Maple Grove, MN 55311; Centennial Mortgage
and Funding, 5001 American Blvd West, Suite 1000, Bloomington, MN 55437; District 2
Community Council.
WHEREAS, Department of Safety and Inspections has served in accordance with the
provisions of Chapter 45 of the Saint Paul Legislative Code an order identified as an "Order to
Abate Nuisance Building(s)" dated September 18, 2007; and
WHEREAS, this order informed the then lrnown interested or responsible parties that the
shucture located on the Subject Property is a nuisance building(s) pursuant to Chapter 45; and
WHEREAS, this order informed the interested or responsible parties that they must repair
or demolish the structure located on the Subj ect Property by October 18, 2007; and
WHEREAS, the enforcement officer has posted a placard on the Subject Property
declaring this building(s) to constitute a nuisance condition; subject to demolition; and
WHEREAS, this nuisance condition has not been corrected and Deparhnent of Safety
and Inspections requested that the City Clerk schedule public hearings before the Legislative
Hearing Officer of the City Council and the Saint Paul City Council; and
WHEREAS, the interested and responsible parties have been served notice in accordance
with the provisions of Chapter 45 of the Saint Paul Legislative Code, of the time, date, place and
purpose of the public hearings; and
WHEREAS, a hearing was held before the Legislative Hearing Officer of the Saint Paul
City Council on Tuesday, January 8, 2008 to hear testimony and evidence, and after receiving
testimony and evidence, made the recommendation to approve the request to order the interested

or responsible parties to make the Subject Property safe and not detrimental to the public peace,
health, safety and welfaze and remove its blighting influence on the community by rehabilitating
this structure in accardance with all applicable codes and ordinances, or in the alternarive by
demolishing and removing the structure in accordance witYi all applicable codes and ordinances.
The rehabilitation or demolition of the structure to be completed within fifteen (15) days after
the date of the Council Hearing; and
WHEREAS, a hearing was heid before the Saint Paul City Council on Wednesday,
February 6, 2008 and the testimony and evidence including the action taken by the Legislative
Hearing Officer was considered by the Council; now therefore
BE IT RESOLVED, that based upon the testunony and evidence presented at the above
referenced public hearings, the Saint Paul City Council hereby adopts the following Findings and
Order conceming the Subject Property at 1500 YORK AVENUE.
1. That the Subject Property comprises a nuisance condition as defined in Saint Paul
Legislative Code, Chapter 45.
2. That the costs of demolition and removal of this building(s) is estimated to exceed
five thousand dollars ($5,000.00).
3. That there now exists and has existed multiple Housing or Building code
violations at the Subj ect Property.
4. That an Order to Abate Nuisance Building(s) was sent to the then lrnown
responsible parties to correct the deficiencies or to demolish and remove the
building(s).
That the deficiencies causing this nuisance condition have not been corrected.
6. That Department of Safety and Inspections has posted a placard on the Subject
Property which declares it to be a nuisance condition subject to demolition.
That this building has been routinely monitored by Deparhnent of Safety and
Inspections, Vacant/Nuisance Buildings.
8. That the known interested parties and owners are as previously stated in this
resolution and that the notification requirements of Chapter 45 have been fulfilled.
ORDER
The Saint Paul City Council hereby makes the following order:
The above referenced interested ar responsible parties shall make the Subject Property
safe and not detrimental to the public peace, health, safety and welfare and remove its
blighting influence on the community by rehabilitating this structure and correcting all

deficiencies as prescribed in the above referenced Order to Abate Nuisance Building(s) in
accordance with all applicable codes and ordinances, or in the altemarive by demolishing
and removing the structure in accordance with all applicable codes and ordinances. The
rehabilitation or demolition and removal of the struchxre must be completed within
rr� one-hundred ei2htv days after the date of the Council Hearing.
2. If the above corrective action is not completed within this period of time Department of
Safety and Inspections is hereby authorized to take whatever steps are necessary to
demolish and remove this structure, fill the site and charge the costs incurred against the
Subject Property pursuant to the provisions of Chapter 45 of the Saint Paul Legislative
Code.

In the event the building is to be demolished and removed by the City of Saint Paul, all
personal property or fixtures of any kind which interfere with the demolition and removal
shall be removed from the property by the responsible parties by the end of this time
period. If all personal property is not removed, it shall be considered to be abandoned
and the City of Saint Paul shall remove and dispose of such property as provided by law.
It is further ordered, that a copy of this resolution be mailed to the owners and interested
parties in accordance with Chapter 45 of the Saint Paul Legislative Code.

The building is a one and one-half story, wood frame, single-family dwelling with a shed on a lot
of 6,967 squaze feet.
According to our files, it has been a vacant building since October 12, 2005.
The current property owners are Dennis and Lynn Guptil, per AMANDA and Ramsey county
property records.
The City of St. Paul has boarded this building to secure it from trespass.
There have been fifteen (15) SUMMARY ABATEMENT NOTICES since 2005.
There have been fifreen (15) WORK ORDERS issued for:
- Remova] of snow and ice
- Removal of tall grass and weeds
- Removal of refuse
On August 14, 2007, an inspection of the building was conducted, a list of deficiencies which
constitute a nuisance condition was developed and photographs were taken. An ORDER TO
ABATE A NUISANCE BUILDING was posted on September 18, 2007 with a compliance date
of October 18, 2007. As of this date this property remains in a condition which comprises a
nulsance as defined by the legislative code.
The Vacant Building registration fees are delinquent in the amount of $1,375.00.
Taxation has placed an estimated market value of $62,400 on the land and $103,300 on the

Inspections, Division of Code Enforcement, hereby declares the premises located at:

Chapter 45.02, and subject to demolition under authority of Chapter 45.11.
On August 14, 2007, a Building Deficiency Inspecfion Report was compiled and the
following condirions were observed.
This list of deficiencies is not necessarily all the deficiencies present at this time. As
first remedial action, a Code Compliance Inspection must be obtained from the
Buiiding Inspection and Design Section, 8 Fourth Street East, Suite 200, Commerce
Building (651)266-9090. That inspection will identify specific defects, necessary
repairs and legal requirements to correct this nuisance condition. You may also be
required to post a five thousand dollar ($5,000.00) performance bond with the
Building Inspection and Design Office before any permits are issued, except for a
demolition permit.
This building(s) is subject to the restrictions of Saint Paul Ordinance Chapter 33.03 and
shall not again be used for occupancy until such time as a Certificate of Compliance or a
Certificate of Occupancy has been issued.

Note: The dwelling was open to entry, copper pipe theft.
Interior
1. There is open electrical and plumbing.
2. There aze missing or defective guazdrails. Provide all stairways,
porches, decks or steps which are more than 30" high with guardrails
and intermediate rails with openings in the guardrail no more than four
(4) inches apart and in accordance with the State Building Code.
The bathroom floor covering is deteriorated or inadequate. Provide
floor covering which is impervious to water and easily cleanable
throughout the bathroom and seal around the edges and fixtures.
4. Lacking deadbolt door locks. Provide one-inch throw deadbolt locks for
all entry dooxs to dwelling unit(s).
5. Lack of Electricity. Immediately restore electrical service. Failure to
provide proper electrical service will result in these premises being
declazed Unfit for Human Habitation and ordered vacated for lack of
this basic facility. Use of candles, fuel operated lighting or extension
cord wiring is not permitted while the power is off.
6. FURNACE: Have a licensed heating contractor service and clean the
fiunace or boiler and make any necessary repairs. Perform a C/O test on
the heating plant. Then, send the attached form back to the Inspector.
Repair of gas fired appliances requires a permit.
Lack of Natural Gas Service. Immediately restore natural gas service.
Failure to provide natural gas service will result in these premises being
declazed Unfit far Human Habitation and ordered vacated for lack of
this basic facility.
The stairs have missing or defecrive handrails. Provide a11 interior and
exterior stairways and steps of more that three (3) risers with handrails
which are grippable and installed 34" to 38" above the nose of the stair
treads.
9. The interior ceilings are defective. Repair all ceiling defects and finish
in a professional manner.
10. The interior walls are defective. Repair all wa11 defects and finish in a
professional manner.

11. T'here is evidence of a rodent infestation. Immediately exterminate and
eliminate all rodents from the entire building. Remove rodent
hazborages in the yazd azeas. Tuckpoint the foundation if necessary to
rodent-proof the building to prevent re-infestation. Ixnmediately remove
any dead rodents from the premises.
12. Smoke Detector: Lack of properly installed and operable smoke
detector. Provide functioning smoke detectors in accordance with the
attached requirement, within 24 hours.
13. Lack of Water Service. Immediately restore water service. Failure to
provide water service will result in these premises being declared Unfit
for Human Habitation and ordered vacated for lack of this basic facility.
14. The exterior walls of the house andlor gazage aze defective. Repair all
holes, breaks, loose or rotting siding, to a professional state of
maintenance.

15. STORM DOOR(S): The storm door(s) are in disrepair; repair or replace
the door(s).
16. The window and/or door screens are missing, defective or in a state of
disrepair. Provide proper window and door screens for all openable
windows and doors. Screens must be right-fitting and securely fastened
to the $ames.
17. The windows and/or storm windows are in a state of disrepair. Replace
all missing or broken window glass. Make a11 necessary repairs to
frames, sashes, hardware and associated ttim in a professional manner.
Permit may be required.
18. The exterior walls and/or trim of the house and/or garage has defective,
peeled, flaked, scaled or chalking paint or has unpainted wood surfaces.
Scrape and repaint to effect a sound condition in a professional manner.
As owner, agent or responsible party, you aze hereby notified that if these deficiencies and
the resulting nuisance condition is not corrected by October 18, 2007 the Depariment of
Safety and Inspections, Division of Code Enforcement, wiil begin a substantial abatement
process to demolish and remove the building(s). The costs of this action, including
administrafive costs and demolition costs will be assessed against the property taxes as a
special assessment in accordance with law.

As first remedial action, a Code Compliance Inspecrion Report must be obtained from the

As an owner or responsible party, you aze required by law to provide full and complete
disclosure of this "Order to Abate" to all interested parties, all present or subsequent
renters and any subsequent owners. If you sell, transfer, or convey in any manner, the
ownership or responsibility for this property, you must within seven (7) days, notify the
Enforcement Officer with the names and addresses of any new owners or responsible
parties.
The Enforcement Officer is required by law to post a placard on this property which
declares it to be a"nuisance condirion", subject to demolition and removal by the City.
This placard sha11 not be removed without the written authority of the Department of
Safety and Inspections, D'avision of Code Enforcement. The department is further
required to file a copy of this "Order to Abate" with the City Clerk's Office.
If corrective action is not taken within the time specified in this order, the Enforcement
Officer will notify the City Council that abatement action is necessary. The City Clerk
will then schedule dates for Public Hearings before the City Council at which time
testimony will be heard from interested parties. After this hearing the City Council will
adopt a resolution staring what acrion if any, it deems appropriate.
If the resolufion calls for abatement action the Council may either order the City to take
the abatement action or fix a time within which this nuisance must be abated in
accordance with the provisions of Chapter 33 of the Saint Paul Legislative Code and
provide that if correcfive action is not taken within the specified time, the City shail abate
this nuisance. The costs of this action, including administrative costs will be assessed
against the property as a special assessment in accordance with law.

removed, members that aze over-spanned, over-spaced, not being cazried properly,
door and window openings that aze not headered, etc.) are to be reconstructed as per
code.
13. Provide general clean-up of premise.
14. Provide smoke detectors as per the Minnesota State Building Code.
15. Repair soffit, fascia trim, etc. as necessary.
16. Provide proper drainage around house to direct water away from foundation.
17. Install guardrail and handrail to code on basement stairs to code.
18. Repair and reside south side addition to code.

ELECTRICAI.
1. Ground the elechical service to the water service within 5'of the entrance point of the water
service.
2. Bond azound water meter with a copper wire sized for the electrical service per Article 250 of
NEC.
3. Provide a complete circuit directory at service panel.
4. Install(replace GFCI receptacle in bathroozn/second bathroom adjacent to the sink.
5. Ground bathroom light in second bathroom and disconnect receptacle on fixture.

HEATING

10. Ordering the owner to remove or repair the building(s) at 1500 York Avenue within fifteen
(15) days from adoption ofresolution.
Mr. Magner stated the building was a one and one-half-story, wood frame, single-family dwelling
with a shed on a lot of 6,967 square feet and had been vacant since October 12, 2005. A code
compliance inspection had been done on December 7, 2007. The vacant building registration fees
were delinquent in the amount of $1,375 and the $5,000 performance bond had been posted on
November 15, 2007. On August 14, 2007, an inspection of the building was done and a list of
deficiencies which constitute a nuisance condition was developed. An order to abate a nuisance
building was posted on September 18, 2007 with a compliance date of October 18, 2007. To date,
the property remained in a condition which comprised a nuisance as defined by the Legislative
Code. Ramsey County Taxation estimated the mazket value of the land to be approximately
$62,400 and the building to be $103,300. Real estate taxes are current. Code Enforcement
estimates the cost to repair the building to be approximately $50,000 to $60,000. The cost for
demolition was estimated to be approximately $8,900 to $11,900. There had also been 15 suminary
abatements issued to this property since 2005, 15 of which went to work order: to secure the
building and the City had to board the building to secure it from trespass, remove snow and ice, cut
tall grass and weeds, and remove refixse. Code Enforcement recommends the building be repaired
or removed within 15 days. Mr. Magner presented photographs of the property.
The property owner of record, Dennis Guptil, appeared and stated that he had owned the property
far several years with the intent of tearing down the building and developing the property. This
became an unviable option with the downturn in the market.
Ms. Moermond stated that from the pictures, it appeared the building was open to access. Mr.
Magner responded that this was correct. The property backed up to a railroad line, the house was
set up on a hill away from other residences and there was a commercial site to the east. He believed
there were kids in the neighborhood who likely hung out at this property and broke into it on a
regular basis.
Mr. Guptil stated that the house was up on a hill, surrounded by woods, and was a single lot on
approximately three acres of vacant land. There were apartment buildings on the south side of the
property. The surrounding vacant land was owned by MnDOT which was why he had purchased
the property. It was his understanding that MnDOT had purchased the property for the Highway 61
project with the plan ofputting an intersecrion at this location. He believed that MnDOT then
changed their plans, which was why the vacant land surrounds the building. He believed that most
of the dumping that had occuned was on MnDOT's land and he paid the assessments for those clean
ups. He said that it had been difficult to keep the building boarded up and that the copper piping,
the furnace, air condition, and water heater, had all been stolen out of the buiiding. He had obtained
the code compliance report and planned to rehabilitate the property. He was currently working with
his subcontractors on finding a tenant to move into the building and would then planned to take
approximately three to four weeks to do the build out. He believed this wouid prevent people from
breaking in and taking stuff out as soon as they were putring it in.
Ms. Moermond asked how they became aware this was a vacant building. Mr. Magier stated that
one of the inspectars referred the property to vacant buildings as it was condemned, open to entry,
had broken windows, the interior was completely trashed, trash in yard, utilities shut off, and the
shed was open. Ms. Moermond asked if there was any note in the file on the location of the trash

Mr. Guphi responded that there really wasn t any delmeahon between the lot lines or the property
lines. There was a tree on the MnDOT property; washers and dryers had been dumped there. He
had cemented steel posts into the ground and put a chain across it to prevent anyone from accessing
the property.
Mr. Magner stated that according to the file, whenever a summary abatement was issued it was
usually for trash in the yazd and to secure the building. Since no one was at the property all of the
time, in other cases such as this, these activiries did occur.
Mr. Guptil stated that the neighbors had been supportive and helpful; however, when someone
breaks into the house and it takes more than an hour to two hours for the police to respond, there
really wasn't anything he could do unless he had someone living in the house.
Ms. Moermond asked Mr. Guptil why he had not paid the vacant building fees. Mr. Guptil
responded that the first notice he had received was dated December 11 and he claimed he had never
received any bills.
Ma Moermond stated that she was dismayed at the number of summary abatement orders that had
been issued and had gone to work orders as the City was not in the business of managing his
property. Mr. Guptil responded that he also paid taxes for police services and he did not believe it
should take two to three hours for the police to respond when someone was breaking into his
property. He did not believe the property was a blight to the neighborhood.
Ms. Moermond expressed concern about the police calls to the property and wanted to look at the
calls for service so they could possibly determine the issues going on. She understood that the
police needed to prioritize the calls they receive; however, she was concerned with the response
time.
Ms. Moermond asked for a report from Ms. Spong. Ms. Spong stated that property had not been
inventoried from any of their past surveys. The building appeared to be an early farm house that
was built in 1916 which she did not believe would fit into that category. The exterior had also been
altered and there were integrity issues with the exterior.
Ms. Moermond stated that she would recommended granting the time to rehabilitate the building on
the condition that the following be provided by the end of business on Friday, February 1: 1) the
vacant building fees must be paid; 2) need to provide financial documentation demonstrating the
capacity to make the repairs; 3) a work plan with timelines must be completed; and 4) the property
must be maintained.
