O'CONNELL SPECIAL ASSISTANT May 2, 1961 On April 26 your letter of same date was received, which is quoted, as follows: "The City Council laid over indefinitely a Resolution Ratifying Assessment in the matter of changing the grade, and grading Clarence Street from Ivy to Arlington Avenues, and referred to you for study and opinion an allegation of Thomas Malone, representing Mr. B rewitz, that a court had recently held that the Brewitz's property was-nb&£ benefitted, but rather was damaged by reason of the change of grade. Mr. Malone said that it would not be fair or legal to levy the proposed assessment against that property. "Eltor Dehn alleged that the property has been benefitted by reason of the improvement, and that the .assessment should be levied." Please be advised that this matter has been discussed between Mr. Malone and the Corporation Counsel's office and it is the conclusion of this office that the assessment procedures of the City should be followed in the instant case.
