1 RESOLUTION A�IiIZING APPLICATION TO THE DEPARTMENT OF EMPLOYMENT AND
2 ECONONIIC DEVELOPMENT FOR A CONTAMINATION INVESTIGATION AND CLEANUP GRANT
3 AND TO THE METROPOLITAN COUNCIL FOR A TAX BASE REVITALIZATION GRANT FOR THE
4 NIISSISSIPPI MARKET SITE; DISTRICT 9
6 WHEREAS, the City of Saint Paul, Minnesota is a participant in the Livable Communities Act's Housing
7 Incentives Program for 2008 as determined by the Metropolitan Council, and is therefore eligible to make
8 application for funds under its Tas Base Revitalization Account; and
l0 WHEREAS, the City has identified environmental investigation and clean-up projects within the City that
11 meet the purposes and criteria of the Contamination Investigation and Cleanup Grant Program of the
12 Department of Employment and Economic Development, and the Tax Base Revitalization Account Grant
13 Program of the Metropolitan Council;

15 NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of Saint Paul, Minnesota
16 hereby approves the contamination investigation and cleanup grant applications submitted to the
17 Department of Employment and Economic Development and the Metropolitan Council on November 3,
1 s 2008 by the City of Saint Paul for the Mississippi Market site; and

2o BE IT FURTHER RESOLVED, that the City of Saint Paul, Minnesota agrees to act as legal sponsor for
21 the projects contained in the cleanup grant applications submitted to DEED and the Met Council on
22 November 3, 2008 and that the Director of the Department of Planning and Economic Development is
23 hereby authorized to apply to DEED and the Met Council for funding of these projects on behalf of the
24 Mississippi Market site; and

26 BE IT FURTHER RESOLVED, that the City has the legal authority to apply for financial assistance, and
27 the institutional, managerial and financial capability to ensure adequate project administration; and
28
29 BE IT FURTHER RESOLVED, that the sources and amounts of the local match identified in the
3o applications aze committed to the projects identified; and

3z BE IT FURTHER RESOLVED, the City of Saint Paul certifies that it has not violated any Federal, State
33 or local laws pertaining to fraud, bribery, graft, kickbacks, collusion, conflict of interest, or other unlawful
34 or corrupt practice and that it will comply with all applicable taws and regulations as stated in the contract
35 agreements; and

37 BE IT FURTHER RESOLVED that upon approval of its applications by the Department of Employment
38 and Economic Development and the Metropolitan Council the City of Saint Paul may enter into agreements
39 with the State of Minnesota for the above-referenced projects, and that the City of Saint Paul certifies that it
4o will comply with a11 applicable laws and regulation as stated in all contract agreements;

42 NOW THEREFORE BE IT FINALLY RESOLVED, that the Mayor and City Clerk of the City of Saint
a3 Paul are hereby authorized to execute such agreements as are necessary to implement the projects on behalf
44 of the applicant.

Mississippi Market wants to apply for pollufion grants from DEED and Met Council. A resolution granfing approval for Mississippi
Market to apply must be completed and sent in with the application. There is a timing issue which is why the resolution is being
brought in under suspension.

Dave,
attached is a resolution that needs to be brought to the November 5th City Council meeting under
suspension. There is a timing issue for Met Council and DEED regarding when the resolution is
approved.
Approval of the resoiution is required before Mississippi Market is allowed to apply to DEED and Met
Council for pollution cleanup funds.
We just learned that they need these funds for disposal of pollution and for vapor barriers on the building.
Are you willing to support the application and will you bring it in under suspension?
Please let me know.....1 have to get the Mayor's signature in order to bring it forward.
