O'Connell City Clerk Building Dear Madam: This is in the matter of the appeal of Earl and Margaret Benson to establish a ten foot building line set back on property located one the south side of Hillside Avenue at Commonwealth Avenue. The pro- perty is described as Lot 1, Block 40, St.Anthony Park Addition. The zoning'is "A" residence. The site is-presently vacant and, in part, approximately 8 feet bed low the street grade of Hillside Avenue. The lower portion of this lot has been partially filled to street grade. The applicant pro- poses to move an existing residence and two car garage onto this site. ,This is an irregularly shaped tract of land having a curvalinear I frontage along Hillside Avenue of 128 feet; a scaled dimension of approximately 85 feet along its east side which adjoins a public alley, and a scaled distance of 135 feet along the rear lot line, resulting in an area of approximately 6,000 square feet. The building line set back on Hillside Avenue as established in the block by the existing' residences built prior to the enactment of the Zoning Code is 24 feet. However, Mr. Schroeder ruled that a 22 foot set back would be accep - able to that department for this particular lot. The staff reviewed this matter, and finds that the residence could be placed on this lot with a set back of 22 feet and still maintain the other requirements of the building and zoning codes. The properties to the east and' north are developed with single - family residences, while the properties to the south and west are railroad right -of -way. Field investigation discloses that the relaxation of the building line as requested would have a detrimental effect on the other residences in this block,to the east. The Board of Zoning considered this matter at their regular meeting in July 13, 1961, and recommend the denial of this appeal to relax the building line set back to ten feet and further recommend that the build- ing line set back be relaxed to not less than 22 feet on the above I described property. From a practical standpoint: (a) The necessary stepdown fotting duo to the lour rear mould almost invariably crack, regardless -of reinforcing. June 292 1961 Mayor Vavoulis The City Council .P,1 Schroeder, City Architect Gentlemen: We hereby.petition a re- assignment of building line on Lot 1, Block 40, St. Anthony Park, which is located at the-junction of Hillside.and the railroad right -of -way at approximately 2350 Hillside for the following reasons: The lot is triangular with about 84 ft. depth on the deep side tapering to an apex about 128 ft. along Hillside. Thus, a 48 ft. house which I bought from the city and which 1 plan to move onto this lot, at the present 21 ft. building line would put theback of the house only about 4 ft. from the railroad telegraph wires. -Also the back of this lot`is a- bout 10 ft. low and would require difficult footing arrange- ment. Therefore, due to this and the peculiar triangular; shape of the lot, I ask that the building line be changed to 1Q Z�.
