WHEREAS, Department of Safety and Inspections has served in accordance with the provisions of Chapter 45 of the Saint Paul Legislative Code an order identified as an"Order to Abate Nuisance Building(s)" dated September 13, 2007; and WHEREAS, this order informed the then known interested or responsible parties that the structure located on the Subject Property is a nuisance building(s) pursuant to Chapter 45; and WHEREAS, this order informed the interested or responsible parties that they must repair or demolish the structure located on the Subject Property by October 15, 2007; and WHEREAS, the enforcement officer has posted a placard on the Subject Property declaring this building(s) to consritute a nuisance condition; subjecY to demolition; and WHEREAS, this nuisance condition has not been corrected and Department of Safety and Inspections requested that the City Clerk schedule public hearings before the Legislative Hearing OfFcer of the City Council and the Saint Paul City Council; and WHEREAS, the interested and responsible parties have been served notice in accordance with the provisions of Chapter 45 of the Saint Paul Legislative Code, of the time, date, place and purpose of the public hearings; and WHEREAS, a hearing was held befofe the Legislative Hearing Officer of the Saint Paul City Council on Tuesday, January 8, 2008 to hear testimony and evidence, and after receiving testimony and evidence, made the recommendation to approve the request to order the interested D�-l�3 42 or responsible parties to make the Subject Property safe and not detrimental to the public peace, 43 health, safety and welfare and remove its blighting influence on the community by demolishing 44 and removing the structure in accordance with all applicable codes and ordinances. The 45 demolition of the structure to be completed within fifteen (15) days after the date of the Council 46 Hearing; and 47 48 49 50 51 52 53 54 5� 56 57 58 59 60 61 62 63 64 65 66 67 68 69 70 71 72 73 74 75 76 77 78 79 80 81 82 83 84 85 86 87 WHEREAS, a hearing was held before the Saint Paul City Council on Wednesday, February 6, 2008 and the testimony and evidence including the action taken by the Legislative Hearing Officer was considered by the Council; now therefore BE IT RESOLVED, that based upon the testimony and evidence presented at the above referenced public hearings, the Saint Paul City Council hereby adopts the following Findings and Order concerning the Subject Property at 619 WELLS STREET. That the Subject Proper[y comprises a nuisance condition as defined in Saint Paul Legislative Code, Chapter 45. � 3. That the costs of demolition and removal of this building(s) is estimated to exceed five thousand dollars ($5,000.00). That there now exists and has existed multiple Housing or Building code violations at the Subject Property. 4. That an Order to Abate Nuisance Building(s) was sent to the then known responsible parties to correct the deficiencies or to demolish and remove the building(s). 5. That the deficiencies causing this nuisance condition have not been conected. 6. That Department of Safety and Inspections has posted a placard on the Subject Property which declares it to be a nuisance condition subject to demolition. 7. That this building has been routinely monitored by Department of Safety and Inspections, Vacant/Nuisance Buiidings. 8. That the known interested parties and owners are as previously stated in this resolution and that the notification requirements of Chapter 45 have been fulfilled. • •�� ' The Saint Paul City Council hereby makes the following order: The above referenced interested or responsible parties shall make the Subject Property safe and not detrimental to the public peace, health, safety and welfare and remove its blighting influence on the community by demolishing and removing the structure in accordance with all applicable codes and ordinances. If the above corrective action is not completed within this period of time Depariment of Safety and Inspections is hereby authorized to take whatever steps are necessary to demolish and remove this structure, fill the site and charge the costs incuned against the Subject Property pursuant to the provisions of Chapter 45 of the Saint Paul Legislative Code. 4. According to our files, it has been a vacant building since November 17, 2006. The current property owner is HSBC Bank c/o Ocwen Loan Servicing, LLC, per AMANDA and Ramsey county property records. The City of St. Paul has boarded this building to secure it from trespass. There have been two (2) SUMMARY ABATEMENT NOTICES since 2006. There has been one (1) WORK ORDERS issued for: - Removal of snow and ice On August 22, 2007, an inspection of the building was conducted, a list of deficiencies which constitute a nuisance condition was developed and photoa aphs were taken. An ORDER TO ABATE A NUISANCE BUILDING was posted on September 13, 2007 with a compliance date of October 15, 2007. As of this date this property remains in a condition which comprises a nuisance as defined by the legislative code. The Vacant Building registration fees are paid. Taxation has placed an estimated market value of $27,600 on the land and $61,300 on the building. As of May 16, 2007, a Code Compliance inspection has been completed. G.F.C.I.: The bathroom is lacking an electrical G.F.C.I. outlet. Permit May Be Required. 8. The stairs have missing ar defective handrails. Provide all interior and exterior stairways and steps of more that three (3) risers with handrails which are grippable and installed 34" to 38" above the nose of the stair treads. 9. Repair all wall defects and finish in a professional manner. 11. There is evidence of a rodent infestarion. Immediately externunate and eliminate all rodents from the entire building. Remove rodent harborages in the yard areas. Tuckpoint the foundation if necessary to rodent-proof the building to prevent re-infestation. Immediately remove any dead rodents from the premises. 12. Smoke Detector: Lack of properly installed and operable smoke detector. Provide functioning smoke detectors in accordance with the attached requirement, within 24 hours. 13. Lack of Water Service. Immediately restore water service. Failure to provide water service will result in these premises being declared Unfit for Human Habitation and ordered vacated for lack of this basic facility. Exterior 14. The chimney is defective, deteriorated or in a state of disrepair. Replace all missing or defective bricks, tuckpoint as needed to restore the chimney to a professional state of maintenance and repair. Pernut may be required. 15. The eaues and soffits are in a state of disrepair or deteriorarion. Repair all defects, holes, breaks, loose or rotting boards, to a professional state of maintenance. Permit may be required. 16. The exterior walls andfor trim of the house has defective, peeled, flaked, scaled or chalking paint or has unpainted wood surfaces. Scrape and repaint to effect a sound condition in a professional manner. 17. The roof is deteriorated, defective, or in a state of disrepair. Repair or replace the roof covering to a sound, tight and water impervious condition. Permit may be required. 18. The exterior walls of the house are defective. Repair all holes, breaks, loose or rotting siding, to a professional state of maintenance. 19. The window and/ar door screens ue missing, defective or in a state of disrepair. Provide proper window and door screens for all openable windows and doors. Screens must be tight-fitting and securely fastened to the frames. As owner, agent or responsible party, you aze hereby notified that if these deficiencies and the resulting nuisance condition is not conected by October 15, 2007 the Deparhnent of Safety and Inspections, Division of Code Enforcement, will begin a substantial abatement process to demolish and remove the building(s). The costs of this action, including administrative costs and demolition costs will be assessed against the property tases as a special assessment in accordance with law. Provide general clean-up of premise. 16. Provide smoke detectors as per the Minnesota State Building Code. 17. Repair soffit, fascia trim, etc. as necessary. 18. Ground the electrical service to the water service within 5'of the entrance point of the water service. 2. Verify/install a separate 20 ampere laundry circuit & a separate 20 ampere kitchen appliance circuit. 3. V erify that fuse or circuit breaker amperage matches wire size. 4. Provide one (1) light for each 200 square feet in unfinished basement. One light must be switch at top of stairs. 5. Repair ar replace all broken, missing or loose light fixtures, switches & outlets, covers and plates. 6. Check a113-wire outlets for proper polarity and verify ground. 7. Through-out building, install outlets and light fixtures, as specified in Bulletin 80-1. 8. Install hard-wired, battery backup smoke detector, as specified in Bulletin 80-1, and other smoke detectors as required by the IRC. PLUMBING All plumbing work requires permit(s) and must be done by a pluxnbing contractor licensed in Saint Paul. 1. Water heater temperature and relief valve discharge piping is not correct. 2. Water meter is removed and not in service. 3. There is no water piping installed. Provide to code. HEATING 1. Clean and Orsat furnace burner. Check all controls for proper operafion. Submit report from licensed contractor. 2. Check fiunace heat exchanger for leaks and provide documentarion. Furnace appears newer. 3. Replace fumace flue venting and provide proper pitch for gas appliance venting. B-vent required for 75,000 BTtl fiunace. 4. Tie furnace and water heater venting into chimney liner. 5. Provide adequate clearance from flue vent pipe on furnace/boiler to combustible materials or provide approved shielding according to Code. 6. Recommend support combustion air duct to Code. 7. Provide support for gas lines to Code. Plug, cap and/or remove all disconnected gas lines. 8. Clean all supply and return ducts for warm air heating system. 9. Ordering the owner to remove ar repair the building(s) at 619 Wells Street wittrin fifteen (IS) days from adoption ofresolution. Mr. Magner stated the building was a one and one-half story, wood frame, single-family dwellzng on a lot of 2,614 square feet and had been vacant since November 17, 2006. A code compliance inspection had been done on May 16, 2007. The vacaut building registration fees were paid and the $5,000 performance bond had not been posted. On Angust 22, 2007, an inspection of the building was done and a list of deficiencies which constitute a nuisance condition was developed. An order to abate a nuisance building was posted on September 13, 2007 with a compliance date of October 15, 2007. To date, the property remained in a condirion which comprised a nuisance as defined by the Legisiative Code. Ramsey County Tasation estimated the mazket value of the land to be approximately $27,600 and the building to be $61,300. Real estate taxes are current. Code Enforcement estimates the cost to repair the building to be approximately $60,000 to $80,000. The cost for demolition was estimated to be approximately $8,260 to $11,260. There had also been two si.nmiiary abatements issued to this property since 2006, two of which went to work order: to secure the building and the City had to baard the building to sacure it from trespass, and remove snow and ice, Mr. Magner stated that he had conversations with the realtor and there were several parties who were interested in the property. The property; however, was in the Invest St. Paul area and the area had on-going redevelopment. Code Enforcement recommends the building be removed within 15 days and would like to see the property redeveloped. Mr. Magner presented photographs of the property. Ms. Moermond asked how they became aware this was a vacant building. Mr. Magner stated that he had found tliat the building was vacant and in foreclosure. The water had been shut off, there were numerous exterior violations, and an emergency boarding had been done. The property owner of record, HSBC Bank c/o Ocwen Loan Servicing LLC, did not appear. Larry Zielke, Shapiro, Nordmeyer & Zielke, appeared and stated that his client was willing to a11ow the building to be demolished. He asked Mr. Magner for a copy of the demolition bids that he had received so he could consult with his client. Ms. Moermond asked for a report from Ms. Spong. Ms. Spong stated that the buiiding was an 1884 bungalow and this property was aiso located near Payne Avenue and with the recent redevelopment of the area, it had been removed from the State's list of historical properties. Ms. Moermond recommended the building be removed within 15 days with no option for repair.
