1 WHEREAS, Deparhnent of Safety and Inspections has requested the City Council to
2 hold public hearings to consider the advisability and necessity of ordering the repair or wrecldng
3 and removal of a two story, wood frame duplex and its two stall, wood frame, detached garage
4 located on property hereinafter referred to as the "Subject Property" and commonly laiown as
5 1194 BEECH STREET. This property is legally described as follows, to wit:

WHEREAS, based upon the records in the Ramsey County Recorder's Office and
information obtained by Deparhnent of Safety and Inspections on or before April 14, 2008, the
following are the now lrnown interested or responsible parties for the Subj ect Property: Hsbc
Bank USA Na Trustee/C/O Wells Fargo, Attn: Foreclosure Dept, 3476 Stateview Blvd, Fort
Mill, SC 29715; Reiter & Schiller, PA, 25 N Dale St, 2" Floor, St. Paul, MN 55102; Katherine
Jones, 7600 Wayzata Blvd, Apt #3b, Golden Valley, MN 55426; Dayton's Bluff District 4
Community Council.
WHEREAS, Deparhnent of Safety and Inspections has served in accordance with the
provisions of Chapter 45 of the Saint Paul Legislative Code an order identified as an"Order to
Abate Nuisance Building(s)° dated July 10, 2008; and
WHEREAS, this order informed the then known interested or responsible parties that the
structure located on the Subject Property is a nuisance btulding(s} pursuant to Chapter 45; and
WHEREAS, this order informed the interested or responsible parties that they must repair
ar demolish the structure located on the Subject Property by August 11, 2008; and
WHEREAS, the enforcement officer has posted a placard on the Subject Property
declaring this building(s) to constitute a nuisance condition; subject to demolition; and
WHEREAS, this nuisance condition has not been corrected and Department of Safety
and Inspections requested that the City Clerk schedule public hearings before the Legislative
Hearing Officer of the City Council and the Saint Paul City Council; and
WHEREAS, the interested and responsible parties have been served notice in accordance
with the provisions of Chapter 45 of the Saint Paul Legislative Code, of the time, date, place and
purpose of the public hearings; and
WHEREAS, a hearing was held befare the Legislative Hearing Officer of the Saint Paul
City Councal on Tuesday, October 14, 2008 to hear testimony and evidence, and after receiving
testimony and evidence, made the recommendation to approve the request to order the interested

or responsible parties to make the Subject Property safe and not detrimental to the public peace,
health, safety and welfare and remove its blighting influence on the community by rehabilitating
this shucture in accordance with all applicable codes and ordinances, or in the alternative by
demolishing and removing the structure in accordance with a11 applicable codes and ordinances.
The rehabilitation or demolition of the structure to be completed within fifteen (15) days after
the date of the Council Hearing; and
WHEREAS, a hearing was held befare the Saint Paul City Council on Wednesday,
November 5, 2008 and the testimony and evidence including the action taken by the Legislative
Hearing Officer was considered by the Council; now therefore
BE IT RESOLVED, that based upon the testimony and evidence presented at the above
referenced public hearings, the Saint Paul City Council hereby adopts the following Findings and
Order concerning the Subject Property at 1194 BEECH STIiEET.
1. That the Subject Property comprises a nuisance condition as defined in Saint Paul
Legislative Code, Chapter 45.
2. That the costs of demolition and removal of this building(s) is estimated to exceed
five thousand dollars ($5,000.00).
3. That there now exists and has existed multiple Housing or Buildang code
violations at the Subj ect Property.
4. That an Order to Abate Nuisance Building(s) was sent to the then lrnown
responsible parties to conect the deficiencies or to demolish and remove the
building(s).

That the deficiencies causing this nuisance condition have not been conected.
That Department of Safety and Inspecrions has posted a placard on the Subject
Property which declares it to be a nuisance condition subject to demolition.
That tlus building has been routinely monitored by Department of Safety and
Inspections, Vacant/Nuisance Buildings.
That the known interested parties and owners are as previously stated in this
resolution and that the notification requirements of Chapter 45 have been fulfilled.

The Saint Paul City Council hereby makes the following order:
1. The above referenced interested or responsible parties shall make the Subject Property
safe and not detrimental to the public peace, health, safety and welfare and remove its

and removing the structure in accordance with all applicable codes and ordinances. The
����iilit�ie�re� demolition and removal of the structure must be completed within
fifteen (15) days after the date of the Council Hearing.
If the above corrective action is not completed wittun this period of time Department of
Safety and Inspections is hereby authorized to take whatever steps are necessary to
demolish and remove this structure, fill the site and charge the costs incurred against the
Subj ect Property pursuant to the provisions of Chapter 45 of the Saint Paul Legislative
Code.
In the event the building is to be demolished and removed by the City of Saint Paul, all
personal property or fixtures of any kind which interfere with the demolition and removal
shall be removed from the property by the responsible parties by the end of this time
period. Tf all personal property is not removed, it shall be considered to be abandoned
and the City of Saint Paul shall remove and dispose of such property as provided by law.
It is further ordered, that a copy of this resolution be mailed to the owners and interested
parties in accordance with Chapter 45 of the Saint Paul Legislative Code.

The building is a two-story, wood frame, duplex dwelling with a detached, two-stall garage, on a
lot of 4,792 squaze feet.
According to our files, it has been a vacant building since November 13, 2007.
The current property owner is HSBC Bank USA, NA c/o Wells Fargo Bank., per AMANDA and
Ramsey county property records.
The City of St. Paul has boarded this building to secure it from trespass.
There have been ten (10) SUMMARY ABATEMENT NOTICES since 2007.
There have been eight (8) WORK ORDERS issued for:
- Removal of improperly stored refuse
- Removal of snow and ice
- Boarding
- Removal of tall grass and weeds
On June 25, 2008, an inspection of the building was conducted, a list of deficiencies which
constitute a nuisance condition was developed and photographs were taken. An ORDER TO
ABATE A NUISANCE BUILDING was posted on July 10, 2008 with a compliance date of
August 11, 2008. As of this date this property remains in a condition which comprises a nuisance
as defined by the legislative code.
The Vacant Building registration fees are paid.
Taxation has placed an estimated market value of $68,000 on the land and $108,700 on the
building.
As of October 10, 2008, a Code Compliance inspection has not been completed.
As of October 10, 2008, the $5,000.00 performance bond has not been posted.
Real Estate taxes are current.
Code Enforcement Officers estimate the cost to repair this structure is $40,000-$50,000. The
estimated cost to Demolish is $12,560 to $16,560.
NHPI, Division of Code Enforcement Resolution submitted for consideration orders the property
owner to repair or remove this structure within fifteen (15) days, if not the resolution authorizes
the Division of Code Enforcement to demolish and assess the costs to the property.

The property was re-inspected on August 11, 2008. There was no compliance and the nuisance
condition remains nnabated, the community continues to suffer the blighting influence of this
property. It is the recommendarion of the Department of Safety and Inspections that the City
Council pass a resolution ordering the responsible parries to either repair, or demolish and
remove this building in a timely manner, and failing that, authorize the Department of Safety and
Inspecrions to proceed to demolirion and removal, and to assess the costs incurred against the
real estate as a special assessment to be collected in the same manner as taxes.

The VacantlNuisance Buildings Unit, Department of the Department of Safety and
Inspections, Division of Code Enforcement, hereby declares the premises located at:
1194 BEECH ST
and legally described as follows, to wit:
A. GOTZIANS RE OF SIGEL'S ADDITION LOTS 12 AND LOT 13 BLK 31
to comprise a nuisance condition in violation of the Saint Paul Legislative Code, Chapter
45.02, and subject to demolition under authority of Chapter 45.11.
On June �5, �008, a Building Deficiency Inspection Report was compiled and the following
conditions were observed.
This list of deficiencies is not necessarily all the deficiencies present at this time.
As first remedial action, a Code Compliance Inspection must be obtained from
the Building Inspection and Design Section, 8 Fourth Street East, Suite 200,
Commerce Building (651)266-9090. That inspection will identify specific defects,
necessary repairs and legal requirements to correct this nuisance condition. You
may also be required to post a five thousand dollar ($5,000.00) performance
bond with the Building Inspection and Design Of�ce before any permits are
issued, except for a demolition permit.

This building(s) is suh}ect to the restrictions of Saint PaulOrdinance Chapter 33.03
and shall not again be used for occupancy until such time as a Certificate of
Compliance or a Certificate of Occupancy has been issued.
This is a two story, wood frame duplex and its two stall, wood frame, detached
garage.
Interior
1. Lacking deadbolt door locks. Provide one-inch throw deadbolt locks for all
entry doors to dwelling unit(s).
2. FliRNACE: Have a licensed heating contractor service and clean the fumace
or boiler and make any necessary repairs. Perform a C/O test on the heating
plant. Then, send the attached form back to the Inspector. Repair of gas fired
appliances requires a permit.
3. G.F.C.I.: The bathroom is lacking an electrical G.F.C.I. outlet. Permit May
Be Required.
4. The inCerior ceilings are defective. Repair all ceiling defects and finish in a
professional manner.
5. The interior walls are defective. Repair all wall defects and finish in a
professional manner.
6. There is evidence of a rodent infestation. Immediately exterminate and
eliminate all rodents from the entire building. Remove rodent harborages in
the yard areas. Tuckpoint the foundation if necessary to rodent-proof the
building to prevent re-infestation. Immediately remove any dead rodents from
the premises.
Smoke Detector: Lack of properly installed and operable smoke detector.
Provide functioning smoke detectors in accordance with the attached
requirement, within 24 hours.
8. The window and/or door screens are missing, defective or in a state of
disrepair. Provide proper window and door screens for all openable windows
and doors. Screens must be tight-fitting and securely fastened to the frames.
9. The windows and/or storm windows are in a state of disrepair. Replace all
missing or broken window glass. Make all necessary repairs to frames,
sashes, hardware and associated trim in a professional manner. Permit may be
required.
10. The foundation is deteriorated, defective or in a state of disrepair. Repair all
foundation defects in a professional manner to a weather-tight, water-tight and
rodent-proof condition. Permit inay be required.

11. There is mold in the basement.
12. There is standing water in the basement.
Exterior
13. The chimney is defective, deteriorated or in a state of disrepair. Replace all
missing or defective bricks, hzckpoint as needed to restore the chimney to a
professionai state of maintenance and repair. Permit may be required.
14. The exterior walls andlor trim of the house and/or garage has defective,
peeled, flaked, scaled or chalking paint or has unpainted wood surfaces.
Scrape and repaint to effect a sound condition in a professional manner.
15. The roof is deteriorated, defective, or in a state of disrepair. Repair or replace
the roof covering to a sound, tight and water impervious condition. Permit
may be required.
As owner, agent or responsible party, you are hereby notified that if these deficiencies and the
resulting nuisance condition is not corrected by August ll, 2008 the Department of Safety and
Inspections, Division of Code Enforcement, will begin a substantial abatement process to
demolish and remove the building(s). The costs of this action, including administrative costs
and demolition costs will be assessed against the property taxes as a special assessment in
accordance with law.
As first remedial action, a Code Compliance Inspection Report must be obtained from the
Building Inspection and Design Section, 8 Fourth Street, Suite #200, Commerce Building,
(651)266-9090. This inspection will identify specific defects, necessary repairs and legal
requirements to correct this nuisance condition.
As an owner ar responsible party, you are required by law to provide fizll and complete
disclosure of this "Order to Abate" to all interested parties, all present or subsequent renters and
any subsequent owners. If you sell, transfer, or convey in any manner, the ownership or
responsibility for this property, you must within seven (7) days, notify the Enforcement Officer
with the names and addresses of any new owners or responsible parties.
The Enforcement Officer is required by law to post a placard on this property which declares it
to be a"nuisance condition", subject to demolition and removal by the City. This placard sha11
not be removed without the written authority of the Department of Safety and Inspections,
Division of Code Enfarcement. The department is further required to file a copy of this "Order
to Abate" with the City Clerk's Office.
If corrective action is not taken within the time specified in this order, the Enforcement Officer
will notify the City Council that abatement action is necessary. The City Clerk will then
schedule dates far Public Hearings before the City Council at which time testimony �vill be
heard from interested parties. After this hearing the City Council will adopt a resolution stating
what action if any, it deems appropriate.

If the resolution calls for abatement action the Council may either order the City to take the
abatement action or fix a time within which this nuisance must be abated in accordance with the
provisions of Chapter 33 of the Saint Paul Legislative Code and provide that if corrective action
is not taken within the specified time, the City shall abate this nuisance. The costs of this
action, including administrative costs will be assessed against the property as a special
assessment in accordance with law.

(15) days from adoption of resoluLion.
Rebecca Schiller, attorney with Reiter & Schiller, appeazed on behalf of her client, Wells Fargo
Bank. No other parties of interest appeared.
Mr. Magner stated the building was a two-story, wood frame, duplex with a detached one and two-
stall garage on a lot of 4,792 square feet and had been vacant since November 13, 2007. A code
compliance inspection had not been done, the vacant building registration fees were current, and the
$5,000 performance bond had not been posted. On June 25, 2008, an inspection of the building was
done and a list of deficiencies which constitute a nuisance condition was developed. An order to
abate a nuisance building was posted on July 10, 2008 with a compliance date of August 11, 2008.
To date, the property remained in a condition which comprised a nuisance as defined by the
Legislative Code. Ramsey County Tasation estimated the market value of the land to be
approximately $68,000 and the building to be $108,700. Real estate taxes were current. Code
Enforcement estimates the cost to repair the building to be approximately $40,000 to $50,000. The
cost for demolition was estimated to be approximately $12,560 to $16,560. There had also been 10
suuunary abatements issued to this properiy since 2007, eight of which went to work order: to
secure the building and the City had to board the building to secure it from trespass, remove
improperly stored refuse, boarding, cut tall grass and weeds, and remove snow and ice. Code
Enforcement recommends the building be repaired ar removed within 15 days. Mr, Magner
presented photographs of the property.
Ms. Moermond asked for a report from Ms. Spong. Ms. Spong stated that this building was built in
1888 as an Italianate-style building. There was a stick-style front porch which appeared to be the
only original exterior detail remaining on the building. She also noted there was an addition that
had been added to the building which was inappropriate given its original character. Although this
property did not lend any historical significance to the neighborhood, she encouraged rehabilitation.
Ms. Schiller stated that her client was requesting additlonal time, perhaps to the end of October, to
obtain bids on the cost to rehab the building. She said that her client also was willing to post the
bond. Premier Asset had prepared a preliminary bid on the orders that had been issued in 7uly
which cost was approximately $12,000. She said that she would review the City's proposed
estimated cost of the rehabilitation with her client.
Mr. Magner stated that he believed what was of greatest importance was obtaining the code
compliance inspecrion so that a contractor would have the list of deficiencies which would need to
be corrected in order to bring the building up to code. He suggested Ms. Schiller go to the DST
Office on Jackson Street as soon as possible to apply for a code compliance inspection.
The following conditions must be met: 1) the property must be maintained; 2) obtain a code
compliance inspection; 3) the $5,000 performance bond must be posted if these conditions are
met, she will recommend continuing the Council Public Hearing to November 19 in order for a
work plan and financial documentation to be provided.

Rebecca Schiller appeared on behalf of her client, Wells Fargo Bank. Ms. Schiller stated that they
had applied for the code compliance inspection; however, they had not received a copy of the report
to date. Since they did not have the report, they were unable to have a contractor draft the work
plan. She said that she had posted the $5,000 performance bond that morning and asked what else
would be required in order to receive a grant of time to rehabilitate the property.
Ms. Moermond requested Mai Vang contact Jim Seeger and Joe Ehrlich in Licensing to expedite
the completion of the code compliance inspection report and transmit the report to Ms. Schiller as
soon as possible.
Mr. Magner stated that the vacant building fees for 2007 were paid in May 2008 and the 2008
vacant building fees were due an owing in the amount of $1,000.
Ms. Moermond stated that the following must be received b}� Tuesday, November 25: 1) $1,000
vacant building fee must be paid; 2) a work plan; 3) financial documentation including a letter or
affidavit committing the funds necessary to complete the rehab. Ms. Moermond said that she will
recommend continuing the Council Public Hearing to December 3.
