PAUL S 75 FT OF LOT 1 BLK 4 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 35 36 37 38 39 40 WHEREAS, based upon the records in the Ramsey County Recorder's Office and information obtained by Deparhnent of Safety and Inspections on or before April 14, 2008, the following are the now lrnown interested ar responsible parties for the Subject Property: Joy Agbara, PO Box 182, Cottage Grove, MN 55016; Wells Fargo Financial of Minnesota, 4130 Blackhawk Rd, #122, Eagan, M1V 55122; Fremont Investment and Loan, 2727 E. Imperial Hwy, Brea, CA 92821; District 6 Planning Council. WHEREAS, Department of 5afety and Inspections has served in accordance with the provisions of Chapter 45 of the Saint Paul Legislative Code an order identified as an"Order to Abate Nuisance Building(s)" dated July 11, 2008; and WHEREAS, this order informed the then known interested or responsible parties that the structure located on the Subject Property is a nuisance building(s) pursuant to Chapter 45; and WHEREAS, this order informed the interested or responsible parties that they must repair or demolish the structure located on the Subj ect Property by Augnst 11, 2008; and WfIEREAS, the enfarcement officer has posted a placard on the Subject Property declaring this building(s) to constitute a nuisance condition; subject to damolition; and WHEREAS, this nuisance condirion has not been corrected and Department of Safety and Inspections requested that the City Clerk schedule public hearings before the Legislative Hearing Officer of the City Council and the Saint Paul City Council; and WHEREAS, the interested and responsible parties have been served notice in accordance with the provisions of Chapter 45 of the Saint Paul Legislarive Code, of the time, date, place and purpose of the public hearings; and WHEREAS, a hearing was held before the Legislative Hearing Officer of the Saint Paul City Council on Tuesday, October 14, 2008 to hear testimony and evidence, and after receiving testimony and evidence, made the recommendation to approve the request to order the interested �� - � 41 42 43 44 45 46 47 48 49 50 51 52 53 54 55 56 S7 58 59 60 61 62 63 64 65 66 67 68 69 70 71 72 73 74 75 76 77 78 79 80 81 82 83 84 85 86 or responsible parties to make the Subject Property safe and not detrimental to the public peace, heaith, safety and welfare and remove its blighting influence on the community by rehabilitating this structure in accordance with all applicable codes and ordinances, or in the alternative by demolishing and removing the structure in accordance with all applicable codes and ordinances. The rehabilitation or demolition of the structure to be completed within fifteen (15) days after the date of the Council Hearing; and WHEREAS, a hearing was held before the Saint Paul City Council on Wednesday, November 5, 2008 and the testimony and evidence including the action taken by the Legislative Hearing Officer was considered by the Council; now therefore BE IT RESOLVED, that based upon the testimony and evidence presented at the above referenced public hearings, the Saint Paul City Council hereby adopts the following Findings and Order concerning the Subject Property at 805 AGATE STREET. That the Subject Property comprises a nuisance condition as defined in Saint Paul Legislative Code, Chaptex 45. 2. � That the costs of demolition and removal of this building(s) is estimated to exceed five thousand dollazs ($5,000.00). That there now exists and has existed multiple Housing or Building code violations at the Subject Property. 4. That an Order to Abate Nuisance Building(s) was sent to the then lrnown responsible parties to correct the deficiencies ar to demolish and remove the building(s). 5. � 7 That the deficiencies causing this nuisance condition have not been corrected. That Deparhnent of Safety and Inspections has posted a placard on the Subject Property wYuch declares it to be a nuisance condition subj ect to demolition. That this building has been routinely monitored by Department of Safety and Inspections, Vacant/Nuisance Buildings. 8. That the known interested parties and owners are as previously stated in this resolution and that the notification requirements of Chapter 45 have been fulfilled. If all personal property is not removed, it shall be considered to be abandoned and the City of Saint Paul shall remove and dispose of such property as provided by law. It is further ordered, that a copy of this resolution be mailed to the owners and interested parties in accordance with Chapter 45 of the Saint Paul Legislative Code. According to our files, it has been a vacant building since September 27, 2007. The current property owner is Joy Agbara, per AMANAA and Ramsey county property records. There have been four (4) SUMMARY ABATEMENT NOTICES since 2007. There have been four (4) WORK ORDERS issued for: - Removal of tall grass and weeds - Removal of improperly stored refuse On June 24, 2008, an inspection of the building was conducted, a list of deficiencies which constitute a nuisance condition was developed and photographs were tal:en. An ORDER TO ABATE A NUISANCE BUILDING was posted on July 11, 2008 with a compliance date of August 11, 2008. As of this date this property remains in a condition which comprises a nuisance as defined by the legislative code. The Vacant Building registration fees are paid. Scrape and repaint to effect a sound condition in a professional manner. The chimney is defective, deteriorated ar in a state of disrepair. Replace all missing or defective bricks, tuckpoint as needed to restore the chimney to a professional state of maintenance and repair. Permit may be required. 8. There is a lack of Water Serviee. 9. FURNACE: Have a licensed heating contractor service and clean the furnace ar boiler and make any necessary repairs. Perform a C10 test on the heating plant. Then, send the attached foml back to the Inspector. Repair of gas fired appliances requires a permit. As owner, agent or responsible party, you are hereby notified that if these deficiencies aud the resulting nuisance condition is not corrected by August 11, 2Q08 the Department of Safety and Inspections, Division of Code Enforcement, will begin a substantial abatement process to demolish and remove the building(s). The costs of this action, including administrarive costs and demolition costs will be assessed against the propert}� taxes as a special assessment in accordance with law. Ordering the owner to remove or repair the building(s) at 805 A�ate Street within fifteen (15) days from adoprion of resolution. The property owner of record, Joy Agbaza, appeared. No other parties of interest appeared. Mr. Magner stated the building was a one and one-half story, wood frame, single-family dwelling on a lot of 6,098 squaze feet and had been vacant since September 27, 2007. A code compliance inspection had been done on September 17, 2008, the vacant building registration fees were assessed in the amount of $1,OOQ and the $5,000 performance bond was posted on August 11, 2008. On June 24, 2008, an inspection of the building was done and a list of deficiencies which constitute a nuisance condition was developed. An order to abate a nuisance building was posted on July 11, 2008 with a compliance date of August 11, 2008. To date, the property remained in a condition wluch comprised a nuisance as defined by the Legislative Code. Ramsey County Taacation estimated the mazket value of the land to be approximately $50,600 and the building to be $48,600. Real estate taxes for 2007-2008 were delinquent in the amount of $2,552.68, plus penalty and interest. Code Enforcement estimates the cost to repair the building to be approximately $60,000 to $70,000. The cost for demolition was estimated to be approximately $8.564 to $11,564. There had also been four suminary abatements issued to this property since 2007, four of which went to work order: remove improperly stored refuse and cut tall grass and weeds. Code Enforcement recommends the building be repaired or removed within 15 days. Mr. Magner presented photographs of the property. Ms. Moermond asked for a report from Ms. Spong. Ms. Spong stated that this building was built in 1880 and was a worker's cottage-style building. She was unsure as to what was original on the exterior of the house and what had been changed since its construction. This was located near the Oakland Cemetery as well as other buildings of historic significance, that being a former homeopathic hospital as well as the Mt. Zion Evangelical Church which were eligible for designation. The residential neighborhood itself, however, had not been suroeyed. She said that given the loss of integrity and the unlaiown history of this property, she did not believe demolition would have an adverse effect on the neighborhood. Ms. Agbara stated that she intended to rehab the property with the intention of having her children live in the house. She had lived in the house for three to four months in 1997 and then moved out and rented out the property. She explained that the tenants who had been living there had destroyed the interior of the house. She had obtained bids for the plumbing and the electrical work that needed to be done. She said that she would be the general contractor for the project and needed to obtain additional bids. She said that once she had obtained a11 of the bids, she was going to go to the bank to secure the necessary financing. Ms. Moermond stated that it appeazed that there were two loans on the property, one with Wells Fargo and the other with Fremont Inveshnent. Ms. Agbara responded that there was only one loan on the property at this time which was with Welis Fargo. Mr. Magner stated that it was his understanding fiom Ms. Agbara that the property was in foreclosure. Ms. Agbara responded that the property was not in foreclosure and that she was working with the bank on a payment plan. She had lost her job which was why she became behind in her mortgage payments and had not paid the property taaces. Ms. Moermond stated that she did not have confidence that she could secure a loan since tbe property tases were delinquent and she had been behind in her mortgage payments. She also questioned her ability to manage the property since there had been four suminary abatements that had resulted in work orders in which the City did the work. Mr. Magner gave a history of the property. This property was a Category III registered vacant building in 1999 which also was subject of a legislative hearing. At that time, Kristine Kujala, Ramsey County Records — Tax Forfeit, appeared at the hearing indicating that this property was going to be auctioned at the Fall auction sale. Ms. Agbara had purchased the property at auction and attended a subsequent legislarive hearing, presented a rehabilitation plan and was given time to complete the rehab. The records indicated that permits were pulled in 1999 and the property received a code compliance certificate in 2000. In 2002, the records indicate that there were a number of complaints conceming the interior of the property. Since 1999 to the present, there were over 35 entries in the system on complaints ranging from utility shut offs, interior complaints, exterior complaints, tall grass & weeds, garbage, rubbish, garbage hauling, as well as other complaints. It was his opinion that this property was not being maintained by this property owner. Ms. Agbara blamed the complaints on the tenants as they would complain any time they had a dispute with her. Ms. Moermond responded that she was responsible for choosing the tenants that lived there and the records indicated that clearly, the City was maintaining the property. Ms. Moermond asked staff to verify that there had not been a sheriff sale of the property as she believed it appeared that it was in foreclosure. Ms. Moermond stated that the following conditions must be met by noon on Wednesday, October 29: 1) the delinquent property taxes must be paid; 2) the property must be maintained; 3) the vacant building registration form must be filed with Vacant Buildings; 4) provide a work plan; and 5) provide financial documentation.
