A RESOLVED, by the Council of the City of Saint Paul, that
subject to the concurrence therein by the County of Ramsey, under an
authorizing resolution of its Board of County Commissioners, the proper
City officers hereby are authorized, in behalf of said City, to execute
'k the presently proposed quitclaim deed by the County of Ramsey and;the
City of Saint Paul, as Grantors, to the Diocese of Saint Paul, a Minnesota
corporation, as Grantee; covering the following described real estate
situate in the County of Ramsey, State of Minnesota, to -i-dt:
'I X11 that part of the Northwest Quarter of the South
west Quarter of Section 11,., Township 29 North, Range
22 West lying Southerly of the North St. Paul Road
and lying Southwesterly of the following described
line: Commencing at the 6outheast corner of said
NorthwestQuarter of the Southwest Quarter; thence
j West 120 feet along the South line thereof to the place
of beginning of the line herein to be described; thence
along a line bearing North /+r22* West to the South-
erly right -of -way line of the North St. Paul Road and
there terminating;
' that it satisfactorily .appears that said hereinabove described real estate
was heretofore conveyed by said City to said County together with other

posed quitclaim deed is necessary to the removal of an existing cloud on
the title of the present owner of the same, the proposed Grantee thereunder,
Diocese of-Saint Paul, and in all equity should be executed and delivered;
RESOLVED FURTHER, that by reference the pertinent letter of the
law firm of Robins, Davis & Lyons, by Sidney S. Feinberg, dated August 11, 1961,
hereby is incorporated herein and made part and parcel hereof and filed herewith.; and
that aai.d proposed quitclaim deed shall be given for a mere nominal consideration.

On July 1, 1955, in a certain Quit Claim Deed the City of St. Paul con-
veyed the following described property to the County of Ramsey:
That part of Section 14, Township 29, Range 22,
described as follows: The South half of the
Northwest Quarter and the North half of the
Southwest Quarter, excepting therefrom the
right of way of the Minneapolis, St. Paul and
Sault Ste. Marie Railway; also subject to the
easements of the Great Lakes Pipeline Company
and the North St. Paul Trunk Sewer; and subject
to the i-ights of the public in White Bear Avenue,
North St. Paul road, and the North St. Paul Road
Connection, containing 159 acres more or less,
except the following described portion thereof:
The West 810 feet of the North half of the South-
west Quarter of Section 14, Township 29; Range
22, and the South 235. 8 feet of the West 810 feet
of the Northwest Quarter of said Section 14, and
the North 52 feet of the South 287. 8 feet of,; the
West 160. 05 feet of said Northwest Quarter.
Subject to White Bear Avenue and North St. Paul
Road Connection, also subject to the easement
for the North St. Paul Trunk Sewer containing
a total of 28. 98 acres.
This conveyance was also made subject to the following restrictive cove-
nants

The subject real estate shall henceforth be restricted to
public use and shall not be alienated or diverted to private
use or private ownership except by the concurrent action
of said first party and said second party.
On December 21, 1956, in order to facilitate the opening of Hazel Street
to North St. Paul Road, the Ramsey County Board of Commissioners
entered into an agreement with the Township of New Canada and the
LaSalle Institute, a Missouri religious corporation, whereby in return
for the LaSalle Institute's conveying to the Township of New Canada a
triangular piece of land described as follows:
That part of the Southwest Quarter of the Southwest
Quarter of Section 14, Township 29 North,:Range 22
West, lying Northeasterly of the following described
line: Commencing at a point on the East line of said
One Quarter -One Quarter section, 110 feet South of
the Northeast corner thereof; thence running to a
point on the North line of said Quarter- Quarter sec-
tion, 120 feet West of the Northeast corner of said
Quarter - Quarter section.
The County of Ramsey conveyed to the LaSalle_ Institute a triangular
piece of land described as follows:
All that part of the Northwest Quarter of the South-
west Quarter of Section 14, Township 29 North, Range
22 West lying Southerly of the North St. Paul Road
and lying Southwesterly of the following described
line: Commencing at the Southeast corner of said
Northwest Quarter of the Southwest Quarter; thence
West 120 feet along the South line thereof to the place
of beginning of the line herein to be described; thence
along a line bearing North 47022" West to the South-
erly right -of -way line of the North St. Paul Road and
there terminating,

It will be noted that the net result of this exchange of property was fan
increase in the area of property available for public use for road pur-
- poses.

Inasmuch as the property conveyed by the County of Ramsey to LaSalle
Institute was subject to the restrictive covenant contained in the Quit
Claim Deed referred to above, and in order to secure compliance with
the terms of this restrictive covenants, it is respectfully requested that
both the Council of the City of St. Paul and the County Commissioners
of Ramsey County, by appropriate resolution, authorize and direct the
proper'City and County officers to join in the execution of a Quit Claim
Deed to the present fee owner of record of the property, the Diocese of
St. Paul, a Minnesota corporation.
