The attention of the City Council is respectfully directed to the pro-
posed City Legislative Bill No. 21, which is a bill for an act amending the
Laws of 1957, Chapter 685, the same being a grant to cities of the first class
certain powers relative to bonding for flood control. There appears to be a
necessity for an increase in bonding authority to a maximum figure in excess
of the $900,000 which is currently being considered. Mr. Eltor A. Dehn, City
Valuation Engineer, advises me as of February 3, 1961, after examination and
appraisal of all the various parcels affected, the final cost of rights -of -way,
easements and borrow pits is now estimated by his office to be approximately
$287,500 rather than the $142,000 estimated by the Corps of Engineers. The
financing plans to date have all been based on estimates and costs furnished
the city by the Corps of Engineers.
It may be stated that until now the City of St. Paul had no means of
estimating right -of -way and easement costs until the project was activated and
complete appraisals made. The Corps of Engineers made a preliminary estimate
of cost of this item based upon the general information then available. It
should be recognized that the estimation of costs of right -of -way, easements,
and borrow pit interests was extremely difficult prior to detailed, parcel -by-
parcel examination and appraisals as has been recently undertaken by the City.
The Corps of Engineers' estimates of city costs were as follows: One
of three elements in city cost is 14.3% of the first construction cost of the
project and is currently estimated at $649,000. The second element in city
costs is the furnishing of all rights -of -way, easements, etc. at no cost to
the Federal Government and this was estimated -by the Corps of Engineers at
$142,000. The third element in city costs would be for those features in the
flood wall which are of exclusively local benefit and requested by the city.
This latter figure is estimated by the Corps of Engineers at $53,000. The
total estimated cost by the Corps was, therefore, $844,000 and this, increased
by $10,000 authorized by the Council for the cost of surveys, engineering and
appraisals is the figure upon which financing plans have been based to date.

In discussing the revised lands and easements estimate on February 3,
1961, with the Senate Legislative Delegation from Ramsey County and with
Messrs. Connelly and Dehn, it was agreed that the proposed legislative bill
should be temporarily.withdrawn and rest9died and that the City Council Legis-
lative Committee should have an opportunity to reconsider the financial needs
of this project and I so recommend. The current estimates for the project,
therefore, are as follows:
14.3% of Construction Cost $649,000
Lands & Easements. .287,500
Local .Improvements 53,000
Engineering, Surveys Appraisals 10,000
Total $999,500
Certain further comments and summaries appear to be in order. The
estimate of construction costs is made much more readily than the lands and
easements estimate and, therefore, would have a greater degree of reliability.
However, even a 10% overrun in costs of construction would, amount to an addi-
tion of almost $65,000 to the city's share. Consequently, provision should
be made for possible overruns in construction costs in the eventual maximum
figure set up for bonding authority. Providing adequately for this element of
possible costs is made difficult by the fact that the schedule of the Corps of
Engineers calls for advertising the first construction contract, from the
westerly end to St. Lawrence Street, in April 1961 at the earliest. Some
eventual reduction in the $53,000 for local improvements is anticipated
through our intention to perform some of this work with city forces or by city
contract, charging the cost of same to street aid funds. Minor design changes,
such as the substitution of walls for earth dike in certain cases will also
affect the finalcost total.
On February 24, 1960, and May 9, 1960, certain letters reporting the
status of the project were received from the Corps and throughout the first
half of 1960 a series of meetings were held with the Corps relative to the
flood wall project. In anticipation of congressional allocation of funds, the
Department of Public Works began preparing legal descriptions for the various
lands, easements and•rights -of -way required.
On May 11, 1960, under Resolution C. F. 197079, the City Council set
up $10,000 for engineering purposes, these costs to be charged to the P.I.R.
fund and eventually to be reimbursed from the $700,000 bond issue presently
authorized.
On September 16, 1960, the Corps of Engineers requested Mayor Vavoulis
to furnish certain assurances of local cooperation. The letter was a result of
and followed closely appropriation of funds by Congress sufficient for com-
mencement of construction.
On September 23, 1960, 1 referred the September 16th letter of the
Corps of Engineers to Mr. Shepard for further action. On September 28, 1960,
Mr. Shepard made a report to the Corporation Counsel and requested that the
indicated action relative to assurances, legal opinion, etc. be undertaken.
On November 14, 1960, 1 wrote to Mr. John Connelly calling his atten-
tion and the attention of the Legislative Committee to the need for additional
legislative authorization for the issuance of city bonds to finance city
obligations on this flood wall project. The enlargement of bonding authority

from $100,000 to $900,000 was suggested and was based on the Corps of Engineers'
estimate of total-city requirements of $854,000. These were the best estimates
then available and were verified with the Corps of.Engineers by Mr. Shepard on
or about September 27, 1960.
On November 18, 1960, and November 25, 1960, three resolutions C. F.
199799, C. F. 199734 and C. F. 199800, were approved by the City Council.
These provided respectively for the selling of $700,000 in currently authorized
bonds for an emergency appropriation in the amount of $200,000, and for provid-
ing the required assurances to the Corps of Engineers..
On or about November 28th, the Corporation Counsel delivered the
assurances to the Corps of Engineers.
On November 29th, the Corps of Engineers acknowledged receipt of the
assurances..
On December 15, 1960, the Corps of Engineers indicated that the assurances
submitted were approved and request was made that the City of St. Paul proceed with
the acquisition of the necessary real estate interests from the westerly end of the
project to St. Lawrence Street. This was the first authority the city had to pro-
ceed with acquisition of right -of -way, although we had previously been furnished
maps and were compiling legal descriptions of the various properties.
On December 14, 1960, upon receipt of informal approval from the Corp of
Engineers, Preliminary Order C. F. 200000, and C. F. 200001 were introduced and
approved by_the City Council. These orders concerned the acquisition of a portion
of the lands and easements required. On December 27, 1960, Preliminary Order
C.V. 200207, which concerned additional portions of lands and easements to be
acquired, was approved by the City Council.. On January 6, 1961, Preliminary Order
C.F. 200334, was approved by the City Council and concerned the acquisition of the
rerpainder of the required lands and easements from the westerly or upper end of
the project to St. Lawrence Street. The previously described four Preliminary
Orders encompassed all the lands and easements required in connection with the
construction of the flood wall from the upper or westerly end of the project to
St. Lawrence Street. Final Orders on two of the above matters were passed on
January 31 and February 7, 1961. Hearings preliminary to anticipated Final Orders
on the balance are scheduled for February 14, and 21, 1961.
