1 WHEREAS, Deparlment of Safety and Inspecfions has requested the City Council to

WHEREAS, based upon the records in the Ramsey County Recorder's Office and
informarion obtained by Deparhnent of Safety and Inspections on or before Apri114, 2008, the
following are the now lrnown interested or responsible parties for the Subject Property:

WFIEREAS, Department of Safety and Inspections has served in accordance with the
provisions of Chapter 45 of the Saint Paul Legislative Code an order identified as an "Order to
Abate Nuisance Building(s)" datad July ll, 2008; and
WHEREAS, this order informed the then known interested or responsible parties that the
structure located on the Subject Property is a nuisance building(s) pursuant to Chapter 45; and
WHEREAS, this order inforxned the interested or responsible parties that they must repair
or demolish the structure located on the Subj ect Property by August 11, 2008; and
WHEREAS, the enforcement officer has posted a placard on the Subj ect Property
declaring this building(s) to constitute a nuisance condirion; subject to demolition; and
WHEREAS, this nuisance condition has not been corrected and Department of Safety
and Inspections requested that the City Clerk schedule public hearings before the Legislative
Hearing Officer of the City Council and the Saant Paul City Council; and
WHEREAS, the interested and responsible parties have been served notice in accordance
with the provisions of Chapter 45 of the Saint Paul Legislative Code, of the time, date, place and
puipose of the public hearings; and
WHEREAS, a hearing was held before the Legislative Hearing Officer of the Saint Paul
City Council on Tuesday, October 14, 2008 to hear testimony and evidence, and after receiving
testimony and evidence, made the recommendation to approve the request to order the interested

or responsible parties to make the Subject Property safe and not detrimental to the public peace,
health, safety and welfaze and remove its blighting influence on the community by rehabilitating
this structure in accordance with all applicable codes and ordinances, or in the alternative by
demolishing and removing the structure in accordance with all applicable codes and ordinances.
The rehabilitation or demolition of the structure to be completed within fdteen (15) days after
the date of the Council Hearing; and
WHEREAS, a hearing was held before the Saint Paul City Council on Wednesday,
November 5, 2008 and the testimony and evidence including the action taken by the Legislative
Hearing Officer was considered by the Council; now therefore
BE IT RESOLVED, that based upon the testimony and evidence presented at the above
referenced public hearings, the Saint Paul City Council hereby adopts the following Findings and
Order concerning the Subject Property at 1219 CYPRESS STREET.
That the Subject Property comprises a nuisance condition as defined in Saint Paul
Legislative Code, Chapter 45.

That the costs of demolition and removal of this building(s) is estimated to exceed
five thousand dollars ($5,000.00).
That there now exists and has existed multiple Housing or Building code
violations at the Subj ect Property.
4. That an Order to Abate Nuisance Building(s) was sent to the then lrnown
responsible parties to correct the deficiencies or to demolish and remove the
building(s).

That the deficiencies causing this nuisance condition have not been corrected.
That Department of Safety and Inspections has posted a placard on the Subject
Property which declares it to be a nuisance condifion subject to demolition.
That this building has been routinely monitored by Department of Safety and
Inspections, Vacant/Nuisance Buildings.
That the lrnown interested parties and owners are as previously stated in this
resolution and that the notification requirements of Chapter 45 have been fulfilled.

The Saint Paul City Council hereby makes the following order:
The above referenced interested or responsible parties shall make the Subject Property
safe and not detrimental to the public peace, health, safety and welfare and remove its
blighting influence on the community by rehabilitating this structure and correcting all

deficiencies as prescribed in the above referenced Order to Abate Nuisance Building(s) in
accordance with all applicable codes and ordinances, or in the altemative by demolishing
and removing the structure in accordance with all applicable codes and ardinances. The
rehabilitation or demolirion and removal of the structure must be completed within
r.r�� ninetv (90) days after the date of the Council Hearing.
If the above conective action is not completed within this period of time Department of
Safety and Inspections is hereby authorized to take whatever steps are necessary to
demolish and remove this structure, fill the site and charge the costs incurred against the
Subject Property pursuant to the provisions of Chapter 45 of the Saint Paul Legislative
Code.
3. In the event the building is to be demolished and removed by the City of Saint Paul, all
personal property ar fixtures of any kind which interfere with the demolition and removal
shall be removed from the property by the responsible parties by the end of this time
period. If all personal property is not removed, it shall be considered to be abandoned
and the City of Saint Paul shall remove and dispose of such property as provided by law.
4. It is further ordered, that a copy of this resolurion be mailed to the owners and interested
parties in accordance with Chapter 45 of the Saint Paul Legislative Code.

This building(s) is a nuisance building(s) as defined in Chapter 45 and a vacant building as defined in Chapter 43 of the Saint Paul
Legislative Code. The owners, interested parties and responsible parties known to the Enforcement Officer were given an order to
repair or remove the building at 1219 CYPRESS ST by August 11, 2008, and have failed to comply with those orders.

The buildin� is a one and one-half story, wood frame stucco, single-family dwelling, on a lot of 6,970
square feet.
According to our files, it has been a vacant building since August 14, 2007.
The current properiy owner is Phase II, LLC (Bob Pilz), per AMANDA and Ramsey county property
records.
The City of St. Paul has boarded this building to secure it from trespass.
There have been three (3) SiJMMARY ABATEMENT NOTICES since 2007.
There have been seven (7) WORK ORDERS issued for:
- Removal of tall grass and weeds
- Removal of improperly stored refuse
- Removal of snow and ice
- Boarding
On June 25, 2008, an inspection of the building was conducted, a list of deficiencies which constitute a
nuisance condition was developed and photographs were taken. An ORDER TO ABATE A
NUISANCE BUILDING was posted on July 11, 2008 with a compliance date of August 1 l, 2008. As
of this date this property remains in a condition which comprises a nuisance as defined by the
legislative code.
The Vacant Building registration fees are paid. ($1,000 Assessed as of 8/26/08)
Taxation has placed an estimated market value of $39,700 on the land and $185,300 on the building.
As of June 17, 2008, a Code Compliance inspection has been completed.
As of August 26, 2008, the $5,000.00 performance bond has been posted.
Real Estate taxes are current.
Code Enforcement Officers estimate the cost to repair this structure is $20,000-$30,000. The estimated
cost to Demolash is $7,581 to $10,581.
DSI, Division of Code Enforcement Resolution submitted for consideration orders the property owner
to repair or remove this structure within fifteen (15) days, if not the resolution authorizes the Division
of Code Enforcement to demolish and assess the costs to the property.

'I`he Department of Safety and Inspecrions has declared this building{s) to constilute a"nuisance"
as defined by Legislative Code, Chapter 45. The Department of Safety and Inspections has
issued an order to the then known responsible parties to eliminate this nuisance condition by
correcting the deficiencies or by razing and removing this building(s).
The property was re-inspected on August 11, 20�8. There was no complaance and the nuisance
condition remains unabated, the community conrinues to suffer the blighdng influence of this
property. It is the recommendation of the Department of Safefy and Inspections that the City
Council pass a resolution ordering the responsible parties to either repair, or demolish and
remove this building in a rimely manner, and failing that, authorize the Depariment of Safety and
Inspections to proceed to demoIition and removal, and to assess the costs incuiTed against the
real estate as a special assessment to be collected in the same manner as taxes.

45.02, and subject to demolition under authority of Chapter 45.11.
On June 25; 2008, a Building Deficiency Inspection Report was compiled and the following
conditions were observed.
This list of deficiencies is not necessarily all the deGciencies present at this time.
As first remedial action, a Code Compliance InspecUon must be obtained from
the Building Irispection and Design Section, 8 Fourth Street East, Suite 200,
Commerce Building (651)266-9090. That imspection will identify specific defects,
necessary repairs and legal requirements to correct this nuisance condirion. You
may aiso be required to post a five thousand dollar ($5,000.00) perfo'rmance
bond with the Building Inspection and Design Office before any permits are
issued, except for a demolition permit.

This building(s) is subject to the restrictions of Saint Paul Ordinance Chapter 33.03
and shall not again be used for occupancy until such time as a Certificate of
Compliance or a Certificate of Occupancy has been issued.
This is a one and one-half story, wood frame, single family dwelling.
Interior
1. The bathroom floor covering is deteriorated or inadequate. Provide floor
covering which is impervious to water and easily cleanable throughout the
bathroom and seal around the edges and fixtures.
2. Lacking deadbolt door locks. Provide one-inch throw deadbolt locks for all
entry doors to dwelling unit(s).
3. FURNACE: Have a licensed heating contractor service and clean the furnace
or boiler and make any necessary repairs. Perform a C/O test on the heating
plant. Then, send the attached form back to the Inspector. Repair of gas fired
appliances requires a permit.
4. G.F.C.L: The bathroom is lacking an electrical G.F.C.I. outlet. Permit May
Be Required.
The stairs have missing or defective handrails. Provide all interior and
exterioz stairways and steps of inore that three (3) risers with handrails which
are grippable and installed 34" to 38" above the nose of the stair treads.
6. The interior ceilings are defective. Repair a11 ceiling defects and finish in a
professional manner.
7. The interior walls are defective. Repair all wall defects and finish in a
professional manner.
8. SANITATION: Immediately remove improperly stored or accumulated refuse
including; garbage, rubbish, junk, vehicle parts, wood, metal, recycling
materials, household items, building materials, rubble, tires, etc., from yard.
The Saint Paul Legislative Code requires all exterior property areas to be
maintained in a clean and sanitary condition. Usable materials must be stored
in an approved manner, so as not to constitute a nuisance.
Smoke Detector: Lack of properly installed and operable smoke detector.
Provide functioning smoke detectors in accordance with the attached
requirement, within 24 hours.
Exterior
10. The eaves and soffits are in a state of disrepair or deterioration. Repair all
defects, holes, breaks, loose or rotting boards, to a professional state of
maintenance. Permit may be required.

11. The exterior walls and/or trim of the house and/or garage has defective,
peeled, flaked, scaled or chalking paint or has unpainted wood surfaces.
Scrape and repaint to effect a sound condition in a professional manner.

12. The foundation is deteriorated, defective or in a state of disrepair. Repair all
foundation defects in a professional manner to a weather-tight, water-tight and
rodent-proof condition. Permit may be required.
13. The exterior wa11s of the house and/or garage are defective. Repair all holes,
breaks, loose or rotting siding, to a professional state of maintenance.
14. STORM DOOR(S}: The storxn doar(s) are in disrepair; repair or replace the
door(s).
15. The window and/or door screens are missing, defective or in a state of
disrepair. Provide proper window and door screens for all openable windows
and doors. Screens must be tight-fitting and securely fastened to the frames.
16. The windows and/or storm windows are in a state of disrepair. Replace all
missing or broken window glass. Make all necessary repairs to frames,
sashes, hardware and associated trim in a professional manner. Permit may be
required.
As owner, agent or responsible party, you are hereby notified that if fhese deficiencies and the
resulting nuisance condition is not corrected by August 11, 2008 the Department of Safety and
Inspections, Division of Code Enforcement, will begin a substantial abatement pxocess to
demolish and remove the building(s). The costs of this action, including administrative costs
and demolition costs will be assessed against the property taxes as a special assessment in
accordance with law.
As first remedial action, a Code Compliance Inspection Report must be obtained from the
Building Inspection and Design Section, 8 Fourth Street, Suite #200, Commerce Building,
(651)266-9090. This inspection will identify specific defects, necessary repairs and legal
requirements to correct this nuisance condition.
As an owner or responsible party, you are required by law to provide full and complete
disclosure of this "Order to Abate" to a11 interested parties, all present or subsequent renters and
any subsequent owners. If you sell, transfer, or convey in any manner, the ownership or
responsibility for this property, you must within seven (7) days, notify the Enforcement Officer
with the names and addresses of any new owners or responsible parties.
The Enfarcement Officer is required by law to post a placard on this property which declares it
to be a"nuisance condition", subject to demolition and removal by the City. This placard shali
not be removed without the written authority of the Department of Safety and Inspections,
Divasion of Code Enforcement. The department is further required to file a copy of this "Order
Co Abate" with the City Clerk's Office.

If corrective action is not taken within the time specified in this order, the Enforcement Officer
will notify the City Council that abatement action is necessary. The City Clerk will then
schedule dates for Public Hearings before the City Council at which time testimony will be
heard from interested parties. After this hearing the City Council will adopt a resolution stating
what action if any, it deems appropriate.
If the resolution calls for abatement action the Council may either order the City to take the
abatement action or fix a time within which this nuisance must be abated in accordance with the
provisions of Chapter 33 of the Saint Paul Legislative Code and provide that if conective action
is not taken within the specified time, the City shall abate this nuisance. The costs of this
action, including administrative costs will be assessed against the property as a special
assessment in accordance with law.

Pursuant to your request the above-referenced property was inspected and the following report is
submitted:
BUILDING
1. Provide weather protection far sheetrock on front porch.
2. Repair or replace stucco as needed. (requires a permit)
3. Totally rebuild porches to code with proper footings and supports or remove.
4. Replace lower set of basement stairs and install handrail to code.
5. Remove lower 2 feet of drywall on basement exterior walls.
6. Replace kitchen cabinets and counter tops.
7. Install fixtures per code in kitchen and hathroom.
8. Insure crawl space has vapor barrier installed and foundation is insulated to R-10 per
code.

8. Ordering the owner to remove or repair the building(s) at 1219 Cvoress Street within fifteen
(15) days from adoption of resolution.
Bob Pilz appeazed on behalf of the property owner, Phase II, LLC. No other parties of interest
appeared.
Mr. Ma�er stated the building was a one and one-half story, wood frame, single-family dwelling
on a lot of 6,970 square feet and had been vacant since August 14, 2007. A code compliance
inspection had been done on June 17, 2008, the vacant building registration fees were assessed in
the amount of $1,000, and the $5,000 performance bond was posted on Aun st 26, 2008. On June
25, 2008, an inspection of the building was done and a list of deficiencies which constihxte a
nuisance condition was developed. An order to abate a nuisance building was posted on July 11,
2008 with a compliance date of August 11, 2008. To date, the property remained in a condition
which comprised a nuisance as defined by the Legislative Code. Ramsey County Taxation
estimated the market value of the land to be approximately $39,700 and the building to be
$185,300. Real estate taxes were current. Code Enforcement estimates the cost to repair the
building to be approximately $20,000 to $30,000. The cost for demolition was estimated to be
approximately $7,581 to $10,581. There had also been three sunmlary abatements issued to this
property since 2007, seven of which went to work order: to secure the building and the City had to
board the building to secure it from trespass, remove improperly stared refuse, boarding, cut tall
grass and weeds, and remove snow and ice. Mr. Magner stated that at the September 23 Legislative
Hearing, 993 Maryland Avenue East was discussed in conjunction with this property. This paxcel
has two dwellings on it and Mr. Pilz indicated that he intended to rehabilitate this building and 993
Maryland would be demolished. He believed this property fit into the character of the
neighborhood and encouraged rehabilitation. He presented photographs of the property.
Ms. Moermond asked for a report from Ms. Spong. Ms. Spong responded that she had reported on
this building at the September 23 hearing. She noted that both buildings were built in 1915 and that
the Maryland building was originally constructed as a store. There was some loss of integrity to the
exterior of the building; however, she encouraged rehabilitation of this building.
Mr. Pilz stated that he had presented financial documentation and a rehabilitation plan for this
property at the September 23 hearing. He said that they planned to invest approximately $40,000 in
repairs to this property with the intention of selling it once the rehab was complete. He believed
they would need approximately three months to complete the rehabilitation.
Ms. Moermond reviewed the work plan and financials documentation. According to the fmancing,
it indicated that Raymond Hall was financing the rehab of this property. She said that the
documentation that was submitted did not indicate the amount of money he was dedicating towards
the rehab of this property. She said she would either need a letter or affidavit from Mr. Hall
dedicating the amount of funding for this specific project.
Ms. Moermond stated that the following conditions must be met by noon on Wednesday, October
29: 1) the property must be maintained; 2) Raymond Hall must provide financial documentation
and a letter or affidavit committing the funds for the rehab of this proj ect. If all of the conditions
aze met, she will recommend granting 90 days to remove or repair the building.
