Milton Rosen, Commissioner Department of Public Works, City of Saint Paul, copy
of which letter is hereto ,attached and made a part hereof by reference, stated
that it is urgently necessary for his companies, in order to handle the movement
of their heavy equipment for said companies to be permitted to remove presently
installed curbing along the south side of Territorial Road in the area•adjacent
Ito the property described as 2625 Territorial Road, Saint Paul, Minnesota; and
WHEREAS, it further appears that the Department of Public Works has
no objection to such curb removal, providing it is done in a manner meeting the
construction requirements of the Department of Public Works of the City of Saint
Paul and adequately protecting the City and the public; now, therefore, be it
RESOLVED, -that upon receipt by the City Clerk of a letter from
Mr. R. E. Short, President of Admiral Transit, Inc., and Merchants Motor Freight,
Inc., agreeing on behalf of said corporations to accept and be bound by the '
terms and conditions of this resolution:a.s hereafter set forth, and upon com-
pliance with the bond,and insurance provisions hereinafter set forth, said
companies are authorized to remove the curbing from the aforementioned area so
as to be able to properly conduct their operation. In, accepting the terms and
conditions of this resolution, Admiral Transit, Inc., and Merchants Motor Freight,
Inc., agree to abide by .anal be bound by the terms, conditions, and -provisions
hereinafter set forth:
1. Permission and authority is hereby granted to 9.dmiral,Transit, Inc.`;
and Merchants Motor Freight, Inc., to enter upon Territorial Road and to remove
-the concrete curb and to carry out the necessary construction work in the area
adjacent to 2625 Territorial Road, 5ai.nt Paul.
2. The aforesaid companies, hereinafter referred to as permittee, shall
secure a licensed and bonded contractor to perform the necessary work. Ill
construction shall conform to the City of Saint Paul Department of Public Works
Specifications for Street and Sewer Construction, dated'April 1, 1959, and the
permittee shall accomplish such construction at no cost to the City of Saint Paul.
3. Plans or sketches shall be prepared and submitted by the permittee
detailing all curb removal and additional construction to be done under this permit,

such plans to be subject to the approval or rejection by the Commissioner of Public
Works and all construction permitted hereunder to be completed by the 30th day of
July, 1961.
4. The permittee or the contractor selected by it, shall procure in-
surance which would be required of a contractor under the insurance and indemni-
fication provisions of the Public Works Specifications for Street and Sewer Con-
struction, dated April 1, 1959, which insurance policy shall be sufficiently
broad in its coverage to protect the City of Saint Paul, its officers, agents,
servants, and employees from all damages, claims, judgments, or expenses of
every kind and nature arising out of the work to be performed within the scope
of this permit.
5. The permittee shall furnish a bond in the penal sum of $10,000
running to the City of Saint Paul, pursuant to which the permittee and its
surety agree to comply with and be bound by all the terms, conditions, and
provisions of this resolution and agree.:, to indemnify and save harmless the City
from any loss, liability, suits, charges, or damages that might arise out of or
in the course of the work contemplated by this permit.
6. The permittee agrees that its letter accepting the terms and con -
ditions•and provisions of this resolution indicates an understanding and acceptance
upon its part that the permit hereby granted is a permit which is revocable -at
the will or discretion of the Council of the City of Saint Paul, and such permis-
sion may be withdrawn at arXy time.
7. Sh0aid the permission hereby granted be revoked by the Council of
the City of 25aint Paul, the permittee agrees to restore the curbing removed by it
pursuant to the provisions of this resolution and to restore the area to the satis-
faction of the Commissioner of Public Works at no expense to the City.
8. The provisions of this resolution shall he incorporated into a
permit ordinance, which ordnance shall be submitted to the Council for its action
as soon -as the same can be prepared by the Corporation Counsel.

This letter is our request for two things as relates to the operation of our
truck lines out of property known as 2625 Territorial Road, St. Paul.
Effective this week -end operations of Admiral Transit Inc. and Merchants
Motor Freight, Inc. will both be conducted at the address on Territorial Road.
We are leasing from U. S. Steel the lot located immediately across the street
from our freight dock for handling the equipment of the combined Admiral -
Merchants operation. In order that we may properly, conveniently and safely
conduct these operations we ask that we be permitted to remove the presently
installed curbing along the south side of Territorial Road and which abuts
the property being leased from United States Steel. We agree to have the
work done by properly licensed and bonded contractor and agree further that
should we at any time give up the lease of the United States Steel property
upon demand from the City of St. Paul, we will replace such curbing at no
expense to the City or to United States Steel. It is also further agreed
that the construction, after the curb removal, shall be installed so as to
meet such reasonable specifications as the City of St. Paul may direct. i
The agreement of United States Steel is attached.
The second request is that there be designated as a "no parking" area nth
sides of Territorial Road between point "A" and point "B" as shown on the
map attached to this letter. As may be seen from the map we own one of the
lots on the south side of Territorial Road. We will have under lease the
United States Steel section. We allow the union to use our lot for parking
in connection With their evening meeting. The two residence lots have al-
ways followed off street parking so there will be no objection to our request.
We believe further that such request is in the interest of greater safety
within the area.
We can only repeat in closing that the need for immediate action on both of
these requests cannot be understated.

This is an emergency ordinance rendered neces-
sary for the preservation of the public peace,
health and safety.
THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN:
Section 1. That the Zoning Code, Chapters'60 to 64
inclusive of the Saint Paul Legislative Code, as amended,
pertaining to Use Districts, Height Districts and Rezoning
of certain properties in the City of Saint Paul, be and
the same is hereby further amended so as to rezone the
following described property from "A" Residence to "C"
Residence District, to -wit:
Lots 8, 9 and 10, Block 30, West End
Addition, at the northeast corner of
Adrian and Elway Streets.
Section 2. This ordinance is hereby declared to be
an emergency ordinance rendered necessary for the preserva-
tion of the public peace, health and safety.
Section 3. This ordinance shall take effect and

to "C" residence property located at the northeast corner of Adrian and
Elway Streets. The Property is described as Lots 8, 9, 10, Block 30, West
End Addition as extended to the center line of the vacated alley upon which
same abuts. The property has been zoned "A" residence since the adoption
of the zoning ordinance in 1922. -
On December 30, 1960, the Commissioner =of Finance reported the petition
sufficient with the owners of 10 of a possible 14 (71.4%) tracts of land
within the required 100 foot radius having signed the petition. The pro-
perty is presently vacant and the applicant proposes to develop it with a
2J story 17 unit apartment building with off - street parking accessory
thereto. This tract has a frontage of approximaialy 150 feet along unim-
proved Adrian Street and 115 feet along unimproved Elway Street and result-
ing in an area of approximately 17,895 square feet.
East and adjoining is a,single- family residence which fronts on Albion -
Avenue; north and adjoining and fronting on West Seventh Street is a
recently constructed filling station and a single- family residence; south
and across unimproved Adrian Street is vacant land classified in a 'LC
residence district; west and across Elway Street is vacant land fronting
oii said street, and a single - family residence fronting on best Seventh
Street. Field investigation discloses no basic objection to this proposed
use as the character of West Seventh Street is changing as evidenced by
the recently constructed filling station adjoining, and a motor motel one
block to the southwest. The proposed development meets the required
standards for density and building ground coverage.
In consideration of the above factors, the Board of Zoning recommends the
granting of the petition to reclassify the above described property from
'W' Residence to "C" residence.
