Resolved, 'Tnat it satisfactorily ap-
pears that neither the, City of Saint
Paul nor any public utility company
or operator now maintains or operates,
or at any time heretofore maintained
or operated any public utility instru-
mentality in any part of the vacated
walk adjoining on the east of Lot 1,
Block 2, Lane's North Dale Park,
vacated by the resolution of this

RESOLVED, That it satisfactorily appears that neither
the City of Saint Paul nor any public utility company or
operator now maintains or operates, or a,�,*•any time heretofore
maintained or operated any public utility instrumentality in
any part of the vacated walk adjoining on the east of Lot 1,
Block 2, Lane's North Dale Park, vacated,by the resolution of.
this Council designated Council File No.'178590, approved
August -15, 1956,-save that Northern States Power Company, a
public utility operator, at the time of said vacation maintained
and operated and has since continued to maintain and operate in
said vacated walk certain overhead electric power lines and
appurtenances; that neither by virtue of said vacation-proceedings
nor by virtue of City of Saint Paul Ordinance No. 339+, as amended,
entitled "An ordinance regulating the procedure and prescribing
the conditions for the vacation of public grounds, streets; alleys
and highways in the City of Saint Paul,Y approved March 16, 1915,
did-said City of Saint Paul for itself or any public utility
company or operator reserve or does now reserve for itself or'any
other person, firm or corporation any easement,or right-in respect
of said vacated walk for the construction, installation, maintenance
or operation therein of any public utility instrumentality, save in
respect of said vacated walk wherein, by virtue of said vacation
proceedings, it reserved an easement or right in favor of said
Northern States Power Company, -as such public utility operator,
for the continued use of said vacated walk for the maintenance and
operation therein of its aforesaid overhead electric power lines
and appurtenances; and that the Corporation Counsel be and hereby
is authorized in behalf of said City to file a certified copy of
this resolution in the pending Ramsey County, Minnesota, District
Court registration of title proceeding affecting said vacated
walk and abutting platted lots entitled, "In the Matter of the
Application of Aldus C. Bentley and Helen Marie Bentley for a new
Certificate of Title to real estate in Ramsey County, Minnesota."
