RESOLVED, By the Council of the City of Saint Paul, that
the Commissioner of Parks and Recreation and „Public Buildings hereby
is authorized, subject to the provisions, terms and conditions of
this Resolution, to issue a permit to Riverview Veterans of Foreign .,.
Wars Post 1697, whereunder and whereby said Riverview Veterans of
Foreign Wars Post 1697 shall be permitted, at said permittee's own
cost and expense,to erect and maintain a flagpole, and to install and
maintain sod, shrubbery and similar public park embellishments in and
upon thetC�ty;'striangular tract of land constituting a public park,
heretofore assigned to said Commissioner by this Council's prior
Resolution C.F. 87797, approved January 6, 1931, and described as follows:
Except Concord Street, Block 52, West Saint Paul
proper, according to the recorded plat thereof
on file and of record in the office of the Register
of Deeds in and for Ramsey County, Minnesota, having
the following frontages: 75 feet on Concord Street,
52 feet on Livingston Avenue and 48 feet on East
Isabel Street;
RESOLVED, Further that neither this Resolution nor said
hereby authorized permit shall impair or prejudice,-in any manner or
degree, the status of said triangular tract of land as a public park
owned by said City and controlled and regulated by said Commissioner,
according to said City's charter;

RESOLVED, Further that said permittee, not later
than sixty (60) days next after the official publication
of this Resolution, file with the City Clerk, its written
acceptance of the same, and agreement binding said permittee
unto said City for said permittee's performance of all obli-
gations thereby imposed upon said permittee, according to the
tenor of the same; and that the operative effect of this
Resolution shall be suspended until such written acceptance
and agreement shall have been so filed and such casualty
insurance shall have been procured and--furnished by said
permittee.

RESOLVED, Further that this Council hereby ex-
pressly reserves the absolute right to terminate such per-
mit by its Resolution providing therefor, based upon its
determination thereunder that such termination is deemed
necessary in the public interest; that the exercise of said
permit by said permittee, at all times, shall be subject
to the supervision, regulation and control by said Com-
missioner, and further subject to all applicable ordinances
of said City and statutes of the State of Minnesota,and
rules and regulations of municipal and state authorities
having cognizance; and that said permittee shall be obli-
gated, at all times, to fully indemnify and hold harmless
t said City against all liability on account of injury to
person or property, attributable to said permittee's exer-
cise of such permit or said permittee's actions or opera-
tions in respect of the subject triangular tract premises,
and said permittee shall be obligated, at its own cost
and expense to furnish, and at all times, provide public
liability casualty insurance fully indemnifying and hold-
ing harmless said City against every such kind of liability,
and to file evidence of the same with the City Comptroller;
and that the same shall constitute insurance coverages in the
amount of $150,000.00 for personal injuries and in the amount
of $25,000.00 for property injuries caused by any separate
accident, and

post would also like permission granting them the exclusive use of the tri-
angle bounded by Concord, Livingston and Isabel Streets, with an eye to
developing a "Riverview Veterans Memorial Park" at the site, and also to
name the triangle likewise.
I have a letter from Eltor A. Dehn, Valuation Engineer, which states:
"Riverview Post No. 1697, Veterans of Foreign Wars, is now occupying
Herman Hall, which is located at the corner of Concord and Onega Streets,
On the real estate described as the west 90 feet of Lot 4, Block 53, West
St. Paul. The triangle„ referred to is�legaly described as (except Concord
Street)-Block 52, West St. Paul; and the app:roxim_ate dimensions are 75 feet

on Concord, 52 feet on Livingston, and 48 feet on Isabel Street.
"In connection with the opening, widening and extending of Concord Street
the city condemned a strip 20 feet wide paralleling the old Concord Street
and accepted a deed from the Standard Oil Company for the entire block.
This conveyance is a warranty deed, recorded in Book 873 of Deeds, page
285, on January 17, 1930, and does not contain any restrictions. We find
tk�at the City�Counncil assigned this triangle to� the Department of Pa s ay-
grounds and Public _Buildings by resolution C. F. 8t,7797, approved January 6,
1931.
I would like a resolution prepared permitting the above described use by the
aforementioned organization. I
