BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: Section 1'. Laws 1959, Chapter 542 is amended to read: Section 1. Subdivision 1. Subd. 2. The city of-Saint Paul, the county of Ramsey, the board of public welfare of the city of Saint Paul and�the county of Ramsey, the board of education of the city of Saint Paul, the port authority of the city of Saint Paul, the housing and redevelopment authority of the city of Saint Paul, the detention and corrections authority, organized pursuant to Laws 1957, Chapter 664, and the hospital facility building commission, organized pursuant to Laws 1957, Chapter 938, shall each be subject to the provisions of this act and shall participate in the purchasing program established pursuant hereto. Subd, 3. Any other political subdivision, municipal corpor- ation or municipal agency any part of which lies within Ramsey county may participate in the purchasing program by action of its governing body, subject to approval by the council of the city of Saint Paul and approval by the board of county commissioners of Ramsey county. Sec. 2. Subdivision 1. There is established in the records of the comptroller of the city of Saint Paul an account described as the purchasing administration account, into which shall be paid the assessed cost of the administration of the purchasing program by the participating units pursuant to Subd. 2. Initially the 1 Stec' :y+ • r governing body of any participating unit is authorized to pay into such-fund such amount as may be lawfully appropriated to the pur- pose of administration of purchasing by such governing body. Subd. 2. The board of county commissioners of the county of ;r Ramsey and the board of public welfare of the county of Ramsey and the governing body of any participating agency, subdivision or municipality shall hereafter do and perform all acts necessary and instrumental to the purchase or contract for all supplies, materials, equipment and contractual services required by any- department -op ageney - a € - the- eeunty- geverzm6at them through facilitied of the purchasing department of the city of Saint Paul and for this service shall pay to the city of Saint Paul the cost incurred in providing such services. Such costs shall be determined through an analysis and evaluation of all purchases processed through December 31, 1959 1961, and thereafter through each succeeding calendar year. The - manner and methods of computing this cost will be the joint respon- sibility of the county auditor and the city comptroller. They shall certify the amount of the exact cost to the beapd -ef-eexxty-eemmis- siexeps -and- the- a}ty- sexxeil- a € - Saint -Paul- governing body of each . s participating unit for the preceding calendar year on or before June 30 in each year. The governing body of each participating unit shall include the cost as certified to it in its next annual budget, and shall pay the funds into the purchasing administration account on or before January 31 of the succeeding calendar year. The members of such committee on standardization shall be chosen by the city council for the city, by the board of county commissioners for the county, and by the board of public welfare for that board. It shall be the duty of the committee to agree on single specifications for all those items commonly used in each of the governmental units in order that their purchasing power may be combined. Sec. 5 4. The revolving fund shall be administered and accounted for by the city of Saint Paul and its purchasing department. Sec. 6 5. The city of Saint Paul and the county of Ramsey axiall may provide adequate warehouse and storage space for all items which are practical to store and the purchase of which, in quantities greater than current needs, will secure a distinct financial advantage to these governmental subdivisions. Sec. 6. Subdivision 1. Notwithstanding the provisions of 3 any statutes in conflict herewith, in all purchases made by the purchasing agent under the authority of this act he shall be governed by the provisions of Laws 1959, Ghapter 643, and acts amendatory thereof. Subd. 2. Subject to the provisions of Subdivision 1, the city council and the county board shall provide by joint agreement proper rules and regulations to control the administrative pro- cedures necessary to,the efficient operation of the joint pur- chasing program. Such rules and regulations, when adopted by the city council and when adopted by the county board, shall have the force and effect of law, and shall supersede any statutory or charter provisions relating to the purchasing and contracting powers and duties of the participating units. Sec. 7. Notwithstanding the provisions of the city charter of Saint Paul, the term of the present incumbent of the purchasing agent Is office terminates as of October 1, 1961. Before July 1, 1961 the civil service commission of the city of Saint Paul shall by rule prescribe qualifications for the purchasing agent of the city of Saint Paul. The civil service commission of the city of Saint Paul shall thereupon and thereafter accept applications from qualified persons, interview and screen applicants as to qualifi- cations, and on or before September 1, 1961 shall certify three names to the Mayor of the city of Saint Paul for appointment as purchasing agent. Subject to the approval of the city council, on or before October 1, 1961 the Mayor shall appoint one of the three certified persons as purchasing agent to serve for a term of six years, to serve until his successor is appointed and qualified. The city council shall establish a salary for the position. The purchasing agent may be removed from office prior to the expiration of his term in accordance with the rules of the civil service com- mission of Saint Paul. Minnesota Statutes Chapter 197 does not apply to the office of the purchasing agent. Successors shall be appointed in like manner for a term of six years. C Sec. 8. The civil service commissions of the city of Saint Paul and the county of Ramsey or their successor bodies shall have power by rule to change job assignments, classifications and job specifications as in their,judgment may be made necegswry by this act or rule adopted purSuarit thereto. All rights of pr686A i _ 1 I I. employees under existing civil service acts are preserved dhd protected against impairment by operation of this act or rule adopted pursuant thereto. Sec. 9. This act shall become effective only after its approval by a majority of the county board of the county of Ramsey and a majority of the city council of the city of Saint Paul.
