RESOLVED, upon the appeal of William P. Tierney therefor,
pursuant to Section 61,..03 of the Zoning Code provision of the Legislative
Code of the City of Saint Paul, that the provisions in said Zoning Code
be and the same hereby are varied as necessary therefor, and hereby
there is established a building setback line on the subject real property,
Lot 15 and the East 10 feet of Lot 16, Block 1, Point Douglas Additions
abutting thereon, 1+ feet distant from and parallel to the south line of

Dear Madam:
This is in the matter of the appeal of William P. Tierney to relax the re-
quired building line set back from McLean Avenue on property located on the
south side of McLean-Avenue between Clarence and English Streets. The pro-
perty is described as Lot 15 and the east 10 feet of Lot 16, Block 1, Point
Douglas Addition. The zoning is "A" residence.
This property is presently developed with a single - family residence which
fronts on Point Douglas Road and the applicant proposes to construct a gar -
age,at the rear of the property which would front on McLean Avenue. It
should be pointed out that this property has a frontage of approximately
50 feet on both McLean Avenue and Point Douglas Road and is subject to a set
back from each street. The average depth between the two streets is 117 feet.
The minimum building line set back from McLean Avenue is 23 feet and if the
applicant were held to this requirement, it would require the utilization of
a large percentage of the present rear yard for the construction of the pro-
posed garage. There is a difference in elevation between the major portion
of the rear yard of this property and McLean Avenue of approximately 3J to
4 feet. The entire area is developed with single - family residences with the
exception of the property to the north across McLean Avenue which is presently
vacant. The residence at the southeast corner of McLean Avenue and Point
Douglas Road has a set back of six feet from McLean Avenue.
The Board of Zoning considered this matter at their regular meeting on
June 15, 1961, and it is their opinion that the request is a reasonable
one. However, they recommend that the minimum set back be held at six
feet. Therefore, the Board of Zoning recommends °tbe granting of the appeal
to relax the required building line set back from McLean Avenue on the above
described property to a minimum of not less than six feet. The applicant's
request was for four feet.
