RESOLVED, upon the appeal by Hillerest Construction Company,
under the Zoning Code, that the provisions of the Zoning Code,
hereby are varied as necessary therefor, and that hereby said
appellant is granted a permit for the division of the land
described as except the southerly 1.7.33 feet thereof, Lot 10,
Robert L. Ware's Eastern Heights Acre Lots, into the following
described three separate parcels and for the development and use
of each of the same for single family residence purposes, such separate
parcels being described as follows:
A. The West 2 of Lot 10, except the southerly 197.33 feet
thereof, Robert L. Ware's Eastern Heights Acre Lots;
B. The North 102 feet of the East 2 of Lot 10, Robert L.
Ware's Eastern Heights Acre Lots;
C. The Southerly 50 feet of the -North 146.00 feet of the
West z and the Southerly 44 feet of the North 1.6.00
feet of the East z of Lot 10, Robert L. Ware's Eastern
Heights Acre Lots; �.
RESOLVED FURTHER, upon said appeal, that'the provisions of the
Zoning Code hereby are varied as necessary therefor and that the
building setback line for said Parcel C hereby is established as that
certain line drawn across said Parcel C 27 feet easterly therefrom and
parallel to the east line of Ruth Street on which said Parcel C abuts.

The City Council requested that you prepare a resolution granting the
appeal of Hillcrest Construction Co. to relax provisions of Sec. 60.25
of the Zoning Code to permit the division of a tract of land into '
3 lots, the property being situated at the southeast corner of Margaret and
Ruth, being all of Lot 10 except the S'ly 147.33 ft. thereof, Robert L.
Ware's Eastern Heights Acre Lots, subject to the condition , however,
that a 27 ft. building line shall be maintained on Ruth St.

Dear Madam:
This is in the matter of the appeal of the Hillcrest Con ruction Company
-to relax the•provisioas of Section 60.25 of the Legislative Zoning Code to
permit the division of a large plot of land into three lots which would each
have sufficient street frontage and lot area. This property is located at
the southeast corner of Margaret and Ruth Streets and is described as all of
Lot' 10 except the southerly 147.33 feet thereof, Robert L. Ware's Eastern
Heights Acre Lots.
The site is presently developed in part with a single - family residence and
garage which front on Margaret Street. The entire tract has a frontage-of
124.82 feet along Margaret Street, and 146 feet along Ruth Street resulting
in an area of 18,224 square feet. The portion of this tract presently de-
veloped with the single - family residence would retain a frontage of 62.41
feet along Margaret Street and 96 feet along Ruth Street producing an area
of 5,991 square feet. One of the new lots would have a frontage of 62.41
feet along Margaret Street and a depth of 102 feet, resulting in an area of
6,366 square feet. The other new lot would have a frontage along Ruth Street
of 50 feet and extend to a depth of 124.82: f-'
feet resulting is an area o5,939
square feet. The entire surrounding area is developed with single - family
residences.
Field investigation discloses no objection as the proposed division would
provide adequate frontage and area for the proposed use of the properties.
It is recommended also that the parcel fronting on Ruth Street maintain a
building line set back of 27 feet as the adjoining residence to the south
Is set back that distance. The building line set back on Margaret Street
has been established at 33 feet by Council Resolution.
In consideration of the above factors, the Board of Zoning recommends the
granting of the appeal to divide the above described property as outlined
above.

in Block three (3) in Robert L. Ware's Eastern Heights Acre,
Lots, including an easement for the purpose of maintaining garage
now existing upon said premises which extends beyone the premises,
herein reserved by sellers for and during the life of said garage
As per instructions and contracts made with the fee owners of the
above described propertyt lair. and Mrs. Ruben G. Wrobel, it is
our wish to sub- divide said property in the manner set forth on
the attached "Certificate of Surveys. Basically this is done
to facilitate the construction of a single family dwelling on
the north - easterly and southern portions of the divided plat. Both
lots conform to the building requirements as set forth in the
city code. A single family dwelling is presently constructed on
the,rema;n?ng portion of land.
