attached appeal of Frank Fabio for relaxation of the 8-ft. side yard
requirement for a parking lot for 13 cars for customers, on the north
side of University Ave. between Hale and St. Albans Sts., on Lot 18,
Block 1, Syndicate No. 1 Addition.

Dear Madam:
This is in the matter of 1) an appeal to relax the required 8 foot side yard
requirement of Chapter 60.23, Sec, 5, Paragraph "d" of the Zoning Code, and
2) an application for a permit,to install a 13 car customer off- street park-
ing lot on property located on the north side of University Avenue between
Dale and St.Albans Streets. The property is described as Lot 18, Block 1,
Syndicate No., 1 Addition and is zoned Ligbt,Industry.
The site is presently vacant formerly having been developed with a store
and warehouse. The applicant proposes to develop the site with an off - street
parking lot with.a capacity of 13 car spaces to be used in connection with
the owners business adjoining on the east. The site has a frontage along
University Avenue O$ 40 feet and extends to a depth of 122 feet, resulting
in an area of 4,880 square feet. East and adjoining is the applicant's place
of business; south across University Avenue are various commercial uses; north
and across a public alley are single - family residences fronting on Sherburne
Avenue and west and adjoining is a multi - residential structure which fronts
on University Avenue. As indicated above, the Zoning Code requires an 8 foot
buffer of screen planting between a parking lot of this capacity and an adjoin-
ing residential development. Due to the width of this lot, it would not be possible
to install a parking lot and still maintain said buffer. Field investigation
discloses that the elevation of the adjoining residence to the west is approxi-
mately four feet above the surface grade of the proposed parking lot and it is
protected by an existing retaining wall and further that the 8 foot buffer in
this case would not serve its normal intended purpose. The Traffic Engineer
and Planning Board staff have reviewed and approved the proposed plan which
meets the standards for this type of facility.
The Board of Zoning considered this matter at their regular meeting on June 15,
1961., and in consideration of the need for off-street parking along University
Avenue and the finding that the relaxation of the planting buffer would not
have a detrimental effect on the adjoining residence, recommends 1) the grant-
ing of the appeal to relax the required 8 foot side yard set back, and 2) the
granting of the permit for a 13 car off - street parking lot in accordance with
plans approved June 15, 196L, on the above described property.

Dear Sirs:
I,'Frank Fabio, request relaxation of the 8 foot side yard setback
requirement at the proposed parking lot which is to be situated on
Lot #18, Block #1, Syndicate #1 Addition (North side of University
Avenue between Dale'and St. Albans).
We are attempting to'get off - street parking for customers and we
need the entire lot width to properly install this parking lot and
meet the City Planning Office standards.
There is an existing retaining wall at the common property line
between the parking lot and the adjacent residence. The elevation
of the ground at the adjacent residence is approximately 4 feet
higher than the level of our proposed parking lot. I/
