1 WI�REAS, Depariment of Safety and Inspections has requested the City Council to
2 hold public hearings to consider the advisability and necessity of ordering the repair or wreclang
3 and removal of a two-story, wood frame duplex with a detached, one-stall gazage located on
4 property hereinafter referred to as the "Subject Property" and commonly lrnown as 955 BURR
5 STREET. TYris property is legally described as follows, to wit:

WHEREAS, based upon the records in the Ramsey County Recorder's Office and
information obtained by Department of Safety and Inspections on or before March 31, 2007, the
following are the now known interested or responsible parties for the Subject Property: Option
One Mortgage Corp, 3 Ada, Irvine, CA 92618; Usset & Weingarden PLLP, 4500 Park Glen Rd,
#120, Minneapolis, MN 55416; Kenneth and Jovy Krahn, 6586 48�' Str Pl N, Oakdale, MN
55128; Payne Phalen District 5 Planning Council.
WHEREAS, Deparhnent of Safety and Inspections has served in accardance with the
provisions of Chapter 45 of the Saint Paul Legislative Code an order identified as an"Order to
Abate Nuisance Building(s)" dated September 18, 2007; and
WHEREAS, this order informed the then known interested or responsible parties that the
structure located on the Subject Property is a nuisance building(s) pursuant to Chapter 45; and
WHEREAS, this order informed the interested or responsible parties that they must repair
or demolish the structure located on the Subject Property by October 18, 2007; and
WHEREAS, the enforcement officer has posted a placard on the Subject Property
declaring this building(s) to constitute a nuisance condition; subject to demolition; and
WHEREAS, this nuisance condition has not been corrected and Department of Safety
and Inspections requested that the City Clerk schedule public hearings before the Legislative
Hearing Officer of the City Council and the Saint Paul City Council; and
WHEREAS, the interested and responsible parties have been served notice in accordance
with the provisions of Chapter 45 of the Saint Paul Legislative Code, of the time, date, place and
purpose of the public hearings; and
WHEREAS, a hearing was held before the Legislative Hearing Officer of the Saint Paul
City Council on Tuesday, January 8, 2008 to hear testimony and evidence, and after receiving
testimony and evidence, made the recommendation to approve the request to arder the interested
or responsible parties to make the Subject Property safe and not detrimental to the public peace,

health, safety and welfare and remove its blighting influence on the community by rehabilitating
this shucture in accordance with all applicable codes and ordinances, or in the alternative by
demolishing and removing the structure in accordance with all applicable codes and ordinances.
The rehabilitation or demolition of the structure to be completed within fdteen (15) days after
the date of the Council Hearing; and
WHEREAS, a hearing was held before the Saint Paul City Council on Wednesday,
February 6, 2008 and the testunony and evidence including the acrion taken by the Legislarive
Hearing Officer was considered by the Council; now therefore
BE IT RESOLVED, that based upon the tesrimony and evidence presented at the above
referenced public hearings, the Saint Paul City Council hereby adopts the following Findings and
Order concerning the Subject Property at 955 BURR STREET.
That the Subject Property comprises a nuisance condition as defined in Saint Paul
Legislative Code, Chapter 45.
2. That the costs of demolition and removal of this building(s) is estimated to exceed
five thousand dollars ($5,000.00).
That there now exists and has existed multiple Housing or Building code
violations at the Subject Property.
4. That an Order to Abate Nuisance Building(s) was sent to the then lrnown
responsible parties to conect the deficiencies or to demolish and remove the
building(s).
5. That the deficiencies causing this nuisance condition have not been conected.
6. That Department of Safety and Inspections has posted a placard on the Subject
Property which declares it to be a nuisance condition subject to demolirion.
7. That this building has been routinely monitored by Department of Safety and
Inspections, Vacant/Nuisance Buildings.
8. That the lrnown interested parties and owners are as previously stated in this
resolution and that the notification requirements of Chapter 45 have been fuifilled.

The Saint Paul City Council hereby makes the following order:
1. The above referenced interested or responsible parties shall make the Subject Property
safe and not detrimental to the public peace, health, safety and welfare and remove its
blighting influence on the community by rehabilitating this shucture and correcting all
deficiencies as prescribed in the above referenced Order to Abate Nuisance Building(s) in

accordance with all applicable codes and ordinances, or in the alternative by demolishing
and removing the structure in accordance with all applicable codes and ordinances. The
rehabilitation or demolition and removal of the structure must be completed within
�F�;.�.,} one-hundred ei�htv (180) days after the date of the Council Hearing.
2. If the above conective action is not completed within this period of time Department of
Safety and Inspections is hereby authorized to take whatever steps are necessary to
demolish and remove this structure, fill the site and charge the costs incurred against the
Subject Property pursuant to the provisions of Chapter 45 of the Saint Paul Legislative
Code.
3. In the event the building is to be demolished and removed by the City of Saint Paul, all
personal property or fixtures of any kind which interfere with the demolition and removal
shall be removed from the property by the responsible parties by the end of this time
period. If all personal property is not removed, it shall be considered to be abandoned
and the City of Saint Paul shall remove and dispose of such property as provided by law.
It is further ordered, that a copy of this resolution be mailed to the owners and interested
parties in accordance with Chapter 45 of the Saint Paul Legislative Code.

The building is a two story, wood frame, duplex with a detached one-stall gazage on a lot of
3,920 square feet.
According to our files, it has been a vacant building since Apri13, 2007.
The current property owner is Option One Mortgage Corp, per AMANDA' and Ramsey county
property records.
The City of St. Paul has boarded this building to secure it from trespass.
There have been four (4) SUMMARY ABATEMENT NOTICES since 2007.
There have been two (2) WORK ORDERS issued for:
- Removal of snow and ice
- Removal of refuse
On August 2, 2007, an inspection of the building was conducted, a list of deficiencies which
constitute a nuisance condition was developed and photographs were taken. An ORDER TO
ABATE A NUISANCE BUILDING was posted on September 18, 2007 with a compliance date
of October 18, 2007. As of this date this property remains in a condition which comprises a
nuisance as defined by the legislative code.
The Vacant Building registration fees are delinquent in the amount of $250.00.
Taxation has placed an estimated market value of $30,000 on the land and $110,000 on the
building.
As of December 21, 2007, a Code Compliance inspection has been completed.
As of January 7, 2008, the $5,000.00 performance bond has not been posted.
Real Estate taxes aze current.
Code Enforcement Officers estimate the cost to repair this structure is $50,000-$60,000. The
esrimated cost to Demolish is $11,200 To $15,200.
NHPI, Division of Code Enforcement Resolution submitted for consideration orders the property
owner to repair or remove this structure within fifteen (15) days, if not the resolution authorizes
the Division of Code Enforcement to demolish and assess the costs to the property.

The Vacant/Nuisance Buildings Unit, Department of the Department of Safety and
Inspections, Division of Code Enforcement, hereby declares the premises located at:
955 BURR ST
and legally described as follows, to wit:

to comprise a nuisance condition in violafion of the Saint Paul Legislative Code,
Chapter 45.02, and subject to demolition under authority of Chapter 45.11.
On August 2, 2007, a Building Deficiency Inspection Report was compiled and the
following conditions were observed.
This list of deficiencies is not necessarily all the deficiencies present at this time. As
First remedial action, a Code Compliance Inspection must be obtained from the
Building Inspection and Design Secrion, 8 Fourth Street East, Suite 200, Commerce
Building (651)266-9090. That inspection will identify specific defects, necessary
repairs and legal requirements to correct this nuisance condition. You may also be
required to post a five thousand dollar ($5,000.00) performance bond with the
Building Inspection and Design Office before any permits are issued, except for a
demolition permit.

This building(s) is subject to the resfricrions of Saint Paul Ordinance Chapter 33.03 and
shall not again be used for occupancy unfil such time as a Certificate of Compliance or a
Certificate of Occupancy has been issued.
This is a rivo-story, wood frame duplex with a detached, one-stall, gazage.
1. The exterior walls and/or trim of the house and/or gazage has defective,
peeled, flaked, scaled or chalking paint or has unpainted wood surfaces.
Scrape and repaint to effect a sound condition in a professional manner.
2. The exterior walls of the house and/or garage are defecrive. Repair all
holes, breaks, loose or rotting siding, to a professional state of
maintenance.
3. The window and/or door screens are missing, defective or in a state of
disrepair. Provide proper window and door screens for a11 openable
windows and doors. Screens must be tight-fitting and securely fastened
to the frames.
4. The windows and/or storm windows aze in a state of disrepair. Replace
all missing or broken window glass. Make all necessary repairs to
frames, sashes, hardware and associated trim in a professional manner.
Permit may be required.
5. The eaves and soffits are in a state of disrepair or deteriorarion. Repair
all defects, holes, breaks, loose or rotting boards, to a professional state
of maintenance. Permit may be required.
6. The chimney is defective, deteriorated or in a state of disrepair. Replace
all missing or defective bricks, tuckpoint as needed to restore the
chimney to a professional state of maintenance and repair. Permit may
be required.
The foundation is deteriorated, defective or in a state of disrepair.
Repair all foundation defects in a professional manner to a
weather-tight, water-tight and rodent-proof condition. Permit may be
required.
8. The roof is deteriorated, defective, or in a state of disrepair. Repair or
replace the roof covering to a sound, tight and water impervious
condition. Permit may be required.
9. Lack of Water Service. Immediately restore water service. Failure to
provide water service will result in these premises being declared Unfit
for Huxnan Habitation and ordered vacated for lack of this basic facility.
10. Lack of basic facilities. Electric andlor gas service shut off.

As owner, agent or responsible pariy, you are hereby notified that if these deficiencies and
the resulting nuisance condition is not conected by October 18, 2007 the Department of
Safety and Inspections, Division of Code Enforcement, will be�n a substantial abatement
process to demolish and remove the building(s). The costs of this action, including
administrative costs and demolition costs will be assessed againsf the property taxes as a
special assessment in accordance with law.
As first remedial action, a Code Compliance Inspecrion Report must be obtained from the
Building Inspecfion and Design Section, 8 Fourth Street, Suite #200, Commerce
Building, (651)266-9090. This inspection will identify specific defects, necessary repairs
and legal requirements to correct this nuisance condirion.
As an owner or responsible party, you are required by law to provide full and complete
disclosure of this "Order to Abate" to all interested parties, all present or subsequent
renters and any subsequent owners. If you sell, transfer, or convey in any manner, the
ownership or responsibility for this property, you must within seven (7) days, notify the
Enforcement Officer with the names and addresses of any new owners or responsible
parties.
The Enforcement Officer is required by law to post a placard on this property which
declares it to be a"nuisance condition", subject to demolition and removal by the City.
This placard shall not be removed without the written authority of the Department of
Safety and Inspections, Division of Code Enforcement. The department is further
required to file a copy of this "Order to Abate" with the City Clerk's Office.
If corrective action is not taken within the tune specified in this order, the Enforcement
Officer wili norify the City Councii that abatement action is necessary. The City Clerk
will then schedule dates for Public Hearings before the City Council at which fime
testimony will be heard from interested parties. After this hearing the City Council will
adopt a resolution stating what acrion if any, it deems appropriate.
If the resolution calls for abatement action the Council may either order the City to take
the abatement action or fix a time within which this nuisance must be abated in
accordance with the provisions of Chapter 33 of the Saint Paul Legislative Code and
provide that if corrective action is not taken within the specified time, the City shall abate
this nuisance. The costs of this action, including administra6ve costs will be assessed
against the property as a special assessment in accordance with law.

Pursuant to your request the above-referenced property was inspected and the foilowing report is
submitted:
BUILDING
L Insure basement cellar floor is even, is cleanable, and all holes are filled.
2. Tnstall provide hand and guazdrails on a11 stairways and steps as per attachment.
3. Install plinth blocks under posts in basement as needed.
4. Tuck Point interior/exteriar foundarion.
5. Install floor covering in the bathroom and kitchen that is impervious to water.
6. Install twenty minute fire-rated doors, with a self-closing device, between common
azeas and individual units.
7. Provide thumb type dead bolts for all entry doars. Remove any surface bolts.
8. Repair ar replace any deteriorated window sash, broken glass, sash holders, re-putty
etc. as necessary.
9. Provide storms and screens complete and in good repair for a11 door and window
openings.
10. Repair walls and ceilings throughout, as necessary.
11. Re-level structure as much as is practical.
12. Where wall and ceiling covering is removed, attic, replace doors and windows,
(insulation, glass, weather stripping, etc.) shall meet new energy code standards.
13. Prepaze and paint interior and exterior as necessary (take the necessary precautions if
lead base paint is present).
14. Any frazning members that do not meet code (where wa11 and ceiling covering is
removed, members that aze over-spanned, over-spaced, not being carried properly,
door and window openings that are not headered, etc.) aze to be reconstructed as per
code.
15. Provide general clean-up of premise.
16. Provide smoke detectors as per the Minnesota State Building Code.
17. Repair soffit, fascia trim, etc. as necessary.

22. Install screw down cover on water meter hole in basement or concrete in hole.

24. Install one hour fire raring between house and garage on garage wall per code.
25. Repair siding and trim on outside to meet Chapter 34 of SPLC.
26. Insure one hour fire rating between units.
ELECTRICAL
1. Bond around water meter with a copper wire sized far the electrical service per
Article 250 of the NEC.
2. Verify that fuse/circuit breaker amperage matches wire size.
3. Repair or replace a11 broken, missing or loose heaters, light fixtures, switches and
outlets, cover and plates.
4. Certify heater wiring done to code. Installed within last five (5) years without a
pernut.
PLUMBING
All plumbing work requires permit(s) and must be done by a pluinbing contractor licensed in
Saint Paul.
1. Install a temperature and pressure relief valve at the water heater (required).
2. The water heater gas venting and water piping are incorrect.
3. The water meter is removed and not in service.
4. Remove meter from pit.
5. Repair or replace all corroded, broken or leaking water piping.
6. The water piping sizing is incorrect.
7. The water piping has improper fitting or usage.
8. The water piping has improper piping or usage.
9. The water piping boiler fill water line requires backflow assembly or device.
10. Provide H20 piping to a11 fixtures.
11. The range gas shutoff, connector or piping is incorrect.
12. Remove and cap all unused piping.
13. The soil and waste piping has no front sewer cleanout; no soil stack base cleanout.
14. The basement soil and waste piping has improper pipe supports.
I5. The soil and waste piping has improper connections, transirions, fitfing or pipe usage.
16. The first floor water closet and bathtub waste is incorrect and unvented.

17. The first floor water closet fixture is broken or parts missing.
18. The second floor bathtub water and water piping are incorrect.
19. The second floor lavatory and kitchen sink waste are incorrect and unvented.
HEATING
1. Clean and Orsat furnace/wall burner. Check all controls for proper operation. Check
furnace heat exchanger for leaks and provide documentation from a licensed
contractor that the heating unit is safe.
2. Vent clothes dryer to code.
3. Provide adequate combustion air and support to code.
4. Provide support for gas lines to code. Plug, cap and/or remove all disconnected gas
lines.
5. Install approved lever handle manual building shutoff gas valve in an accessible
location ahead of the first branch tee.
6. Provide heat in every habitable room and bathrooms.
7. Attach metal tag to expansion tank valve stating that this valve must be OPEN at all
times except when draining the expansion tank.
8. Provide witnessed test for hot water/steam heating and check for leaks.
9. Install boiler pressure relief valve and/or pipe boiler relief valve discharge to within
18" of the floor.
10. Provide back flow preventer on city water fiil line to hot water/steam heating system.
11. Appropriate mechanical permits are required for this work.
12. Electric heat for first and second floor.
13. If boiler is abandoned remove boiler and all piping related. Plug, gas and venting
according. Also install approved level handle manual building gas shutoff valves the
following (page 2) if boiler to remain.

This house was inspected as a duplex.

1. Ordering the owner to remove or repau the building(s) at 955 Burr Street within fifteen (15)
days from adoprion of resolution.
Mr. Magner stated the building was a two-story, wood frame, duplex with a detached one-stall
garage on a lot of 3,920 square feet and had been vacant since Aprii 3, 2007. A code compliance
inspection had been done on December 21, 2007. The vacant building registration fees were
delinquent in the amount of $250 and the $5,000 performance bond had not been posted. On
August 2, 2007, an inspection of the building was done and a list of deficiencies which constitute a
nuisance condition was developed. An order to abate a nuisance building was posted on September
18, 2007 with a compliance date of October 18, 2007. To date, the property remained in a condition
which comprised a nuisance as defined by the Legislative Code. Ramsey County Taxation
estimated the market value of the land to be approximately $30,000 and the building to be
$110,000. Real estate taaces are current. Code Enforcement estimates the cost to repair the building
to be approximately $50,000 to $60,000. The cost for demolition was estimated to be
approximately $11,200 to $15,200. There had also been four summary abatements issued to this
property since 2007, two of which went to work arder: to secure the building and the City had to
board the building to secure it from trespass, remove snow and ice, and remove refuse. This
property was located in the Invest St. Paul area and was a subject property that had been brought to
their attention by the local neighborhood groups as something that needed to be dealt with. Code
Enforcement recommends the building be repaired or removed within 15 days. Mr. Magner
presented photographs of the property.
Ms. Moerxnond asked how they became aware this was a vacant building. Mr. Magner stated that
he had found the building to be unoccupied with multiple code violations. The utilities had been
turned off, the exterior paint was peeling, the foundation was cracked, the siding was broken, and
the shingles were damaged on the building.
The property owner of record, Option One Mortgage Corp., did not appear. Scot Sorum appeazed
and stated that he had a signed purchase agreement to purchase the property dated December 7.
The closing on the purchase was scheduled for January 22.
Ms. Moermond asked whether any summary abatements had been issued since December 7. Mr.
Magner responded that a suminary abatement had been issued on December 6 and a work order was
sent on December 10 to clean the yard and to clean the sidewalk.
Ms. Moermond asked far a report from Ms. Spong. Ms. Spong stated that she did not have the 106
form from the state on this building. This property had not been surveyed and in reviewing the
photos, it appeared to haue a loss of integrity which included loss of windows, porch, and it
appeared the siding may have been changed. There was only one house on Burr that had been
inventoried. She said that Payne Avenue had been identified as an important historic azea and the
State had identified it as being eligible for the national register.
Mr. Sorum stated that he had built several houses on empty lots over the past several years. He
presented a work plan, financial documentation as well as a copy of the purchase agreement for
review. He had a copy of the code compliance and was committed to bringing the property into
code compliance.

Ms. Moermond asked Mr. Sorum whether he was a licensed contractar. Mr. Sorum responded that
he was not and that he planned to hire 7ohn Oliver Construction as the general contractor for this
project. He had also had a plumbing contractor, electrician, as well as other contractors look at the
property to determine whether it was feasible to repair.
Ms. Moermond stated that she would recommend granting the time to rehabilitate the property on
the condifion that the following be provided by the end of business on Friday, February L• 1) the
vacant bwlding fees must be paid; 2) the $5,000 performance bond must be posted; 3) provide
financial documentation demonstrating the capacity to make the repairs; 4) a work plan with
timelines must be completed; and 5) the property must be maintained.
