That the Zoning Code, Chapters 60 to 64, inclusive, of the Saint Paul Legislative Code, pertain- ing to UfiLe Districts, Height Districts, and Rezoning of certain properties in the City of Saint Paul, as amended, be•and the same is hereby further amended so as to rezone the following described property from 41A11 Residence District to Commercial District;' to -wit: Lot 10 and the east one -half of Lot 11, Block 1, Clifton Dale Ramsey County Minnesota; on the south side of Larpenteur Avenue between Lexington Parkway and Dunlap Street. O'Connell City Clerk Building Dear Madam: This is in the matter of the petition of R. G. Ragon Inc. to rezone from it A" residence to commercial di'strict property located on the south side of Larpenteur Avenue between Lexington Parkway and Dunlap Street. The property is described as Lot 10 and the east one -half of Lot ll, -Block 1, Clifton Dale'Addition. This property has been zoned "Alt residence since the adoption of the Zoning Ordinance in 1922. On June 1,'1961, the Commissioner of Finance reported the petition sufficient with the owners of 12 of a possible 12 (100%) tracts of land within the pre- scribed 100 foot radius having signed the petition. The site is presently vacant, and if rezoned, the petitioner proposes to erect a 1i story office building. In a letter dated May 31, 1961, the petitioner states that no retail sales will be conducted within the building. This property has a frontage of 60 feet along Larpenteur Avenue and extends to a depth of 125.5 feet, resulting in an area of 7,530 square feet. South and across a public alley are single - family residences fronting on California Avenue; east and adjoining is a dental clinic; north across Larpenteur Avenue is \the Roseville Shopping Center; west and adjoining is vacant land for which the petitioner has entered into a contract for deed. Field investigation discloses no objection to this proposed use as it would provide a proper transitional use between the single - family residences to the south and the commercial uses across Larpenteur Avenue. The proposed Land Use Plan indicates the highest and best use of this land would be for commercial purposes. It does not appear that this proposed use would have a detrimental effect on the adjoining residences to the south as there will be no retail sales conducted in conjunction with the proposed use as mentioned above. In consideration of the above factors, the Board of Zoning recommends the granting of the petition to rezone the above described property from "A" residence district to commercial district.
