AN ORDINANCE AMENDING THE ZONING CODE CHAPTERS 60 TO 64 INCLUSIVE OF THE SAINT PAUL LEGISLATIVE CODE, AS _ AMENDED,. PERTAINING TO USE DISTRICTS, HEIGHT DISTRICTS AND REZONING OF CER- TAIN PROPERTIES IN THE CITY OF SAINT PAUL. THIS IS AN EMERGENCY ORDINANCE RENDERED NECESSARY FOR THE PRESERVA- TION OF THE PUBLIC PEACE, HEALTH AND SAFETY. THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN: Section 1. T hat the Zoning Code, Chapters 60 to 64 inclusive of the Saint Paul Legislative Code, as amended, pertaining to Use Districts, Height Districts and Rezoning of certain properties in the City of Saint Paul, be and the same hereby is further amended so as to rezone the follow- ing described property from "A" Residence to Commercial District: Lots 18 and 19,' Block 2, Aurora Addition, on the north side of Ross Avenue between White Bear Avenue and Van Dyke Street. subject to the following express exceptions and conditions: 1. That, subject to any further reclassification of the hereinabove described real estate by virtue of proceedings therefor hereafter instituted, conducted and completed according to applicable provisions of said Zoning Code, as amended, and applicable provisions of the statutes of the State of Minnesota, hereby, the employment of said real estate henceforth is restricted and limited to the following specified uses, to -wit:, (a) Residential District uses permitted by the regulatory provisions of the said Zoning Code, as amended, in "A`.' Residence District, "B" Residence District and "C" Residence District, thereby established, and (b) Commercial Uses which shall include no more than the establish- ment, maintenance and conduct of a special pur- pose off - street parking facility, subject to all applicable statutes, ordinances, rules and regu- lations prescribed and promulgated by governmental agencies having cognizance. That the owner of said real estate, within the period of 60 days next succeeding the publi- cation of this ordinance, shall file with the City Clerk, in two (2) fully executed counter- parts, said owner's written acceptance of this - ordinance, incorporating, among other things, said owner's grant unto said City of Saint Paul of a negative easement affecting said real estate for the imposition, maintenance and en- forcement of the aforesaid restrictions and limitations upon the employment and use of the hereinabove described real estate, approved as to form and execution by the Corporation Counsel and recordable in the office of the Register of Deeds. That said owner's written acceptance and grant,of negative easement shall contain additional effective provision for the restriction of said real estate to uses per- mitted in one or more of said Residential Dis- tricts from and after any future sale, transfer or alienation of the present ownership of the same, or "'use or occupancy of the same. 3. That, in addition to other requirements therefor, said written instrument of acceptance and grant shall incorporate a certified copy of this ordi- nance, and immediately upon the aforesaid filing of the same the City Clerk shall cause one of such counterparts thereof to be filed of record in the office of the Register of Deeds in and for Ramsey County, Minnesota. Section 2. This ordinance is hereby declared to be an emergency ordinance rendered necessary for the preserva- tion of the public peace, health and safety. Section 3. This ordinance shall take effect and be in force upon its passage, approval and publication. O'Connell City Clerk Building Dear Madam: This is in the matter of the petition of Walter Hansen to rezone from "A" residence to commercial district property located on the north side of Ross Avenue between White Bear Avenue and Van Dyke Street. The property is described as Lots 18, and 19, Block 2, Aurora Addition, and, has been classified in the "A""residence district since the adoption of the Zoning Ordinance in 1922. On May 22, 1961, the Commissioner of Finance reported the petition suffi- cient with the owners of 13 of a possible 18 (72.2 %) tracts of land within the prescribed 100 foot radius having signed the petition. This property is presently being used in part for off = street parking purposes in connec- tion with the commercial activities fronting on White Bear Avenue to the west. If rezoned, the petitioner proposes to use the site for off - street parking purposes. The property has a frontage along Ross Avenue of 80 feet, extending to a depth of 123 feet,resulting in an area of 9,840 square feet. East and adjoining is a single - family residence fronting on Ross Avenue; south and across Ross Avenue is an off - street parking lot used in connection with a supermarket farther to the south which fronts on White Bear Avenue; west and adjoining is a vacant lot which fronts on both Ross and White Bear Avenues, and also two store buildings also fronting on White Bear Avenue; north and across a public alley is a dry - cleaning estab- lishment fronting „on East Seventh Street. The Board of Zoning considered this matter at their regular meeting on June 1, 1961, and it is their opinion that there would be no objection to the rezoning of this property if the use is restricted to parking purposes only as the need of off - street parking in the area is very acute. There- fore, the Board of Zoning recommend the granting of the petition to rezone the above described property from "A11 residence to Commercial district for the purpose of off - street parking use only.
