08-1161Council File # Q�0/�/ Green Sheet # 3060757 RESOLUTION Presented by PAUL, MINNESOTA r� 1 WHEREAS, on March 19, 2008, the City Council of the City of Saint Paul adopted Council File #03-272, 2 said Resolution being the Memorialization of an Appeal to a Letter of Deficiency for property at 288 Laurel Avenue; and 4 5 WHEREAS, the Legislative Hearing Officer recommended denying the appeal and granting an extension 6 to August 1, 2008 to complete the repairs; and 7 8 WHEREAS, the L,egislatave Hearing is now recommending granting an additional extension for the owners 9 to compiete the tile work to the front porch in a historically appropriate fashion and to finance the work 10 over two yeazs. 11 12 THEREFORE, BE IT RESOLVED, that an extension is hereby granted to May 31, 2009 to complete the 13 repairs; and 14 15 BE TT FURTHER RESOLVED, that Council File #08-272 is hereby amended to reflect this change and 16 the Department sha111ift the revocation of the Certificate of Occupancy resulting from non-compliance 17 with the August 1, 2008 deadline, conditioned on the building remaining code compliant in other ways. Neis, Department of Safety anc3 Inspection (DS�j - Fire Prevention; and Mai Vang, City Council Offices 1. Appeal of Lori Belair, Tara Fahey, Amy Muse, and Doug Piullips to a Certificate of Occupancy Deficiency List for property at 288 Laurel Avenue, Units 1. 2. and 3. Amy Muse appeared on behalf of all of the groperiy owners on this appeal. Mr. Neis stated the he inspected the exterior ottiy of the property on February 3, 2008 on a wncem that the front porch was settling and was a potential hazard to the gas line. He then issued a x� inspection for the interior of the property for February I 1 and when he went into the basement, he did not find the sagging of the porch to be a hazard to the gas line. He issued new orders dated February 13 which iucluded to provide a signed affidavit that there aze worlang smoke detectors and to submit a fuel bnming safety test report to their office. He noted that he had also removed the language conceming the porch being a potential hazard on the new ozders and the deadline for the work to be completed is Mazch 11, 2008. Ms. Muse stated that tlus building was a row house of flu wndos and was built in 1887. They were aware that the issue with the front parch needed to be addressed; however, it was going to be an expensive undertakiug and finances were an issue. They did receive a bad in the amount of $6,000 to remove and completely re-build the front porch. She asked whether they would be able to repair the porch rather than removing and replacing it. Ivls. Moermond responded that the orders did indicate that the porch be removed or repaired and if there were no other stzuctural issues that were found, they would be able to make repairs. Mr. Neis stated that 8iis was a concrete porch with tile overlay which was sagging approximaYely three inches and he could not determine the source of the saggiug. His main concern would be leveling the floor so that it did not remain a trip hazazd. Ms. Moermond statad that she would recommend granting aa extension to August 1, 2008 to repair the porch provided there was no further deterioration and it did not pose a hazazd to the gas line. 2. Appeal of Shauna Lewis Yo a Certificate of Occupancy Revocation, which includes Condemnation, for properry at 2188 Glenrid�e Avenue. DSI-Fire lifted the condemnafion prior to the hearing.
