This is in the matter of the appeal of Earl Balzer to relax the eight foot
side yard requirements for parking lots adjoining a residential use. This
property is located on the north side of Grand Avenue between South Victoria
and South Avon Streets, and is described as Lot 19 and the west 25 feet of
Lot 20, Block 18, Summit Park Addition. The property is zoned commercial
and has been since the adoption of the Zoning Ordinance in 1922:
This property was developed in 1894 with a 2J story frame dwelling. This
structure-still remains on the site as well as a three -car garage. The
structure is presently used by the applicant as a restaurant and was pre-
viously used as a beauty parlor. In addition to the existing structure on
this site, there is an off - street parking lot accessory to the restaurant
which has not as yet received Council approval. The applicant proposes to
continue the restaurant use and legalize the off- street parking facility.
This property has a frontage along Grand Avenue of 65 feet and extends to a
depth of 150 feet, resulting in an area of 9,750 square feet. The land uses
in�this particular block consist of various type residential uses and commer-
cial uses. Directly east and adjoining is a 2J story apartment building,
crest and adjoining is a two - family residence. Directly south and across Grand
Avenue are various type residential uses; north and across a public alley are
the rear yards of residences fronting on Summit Avenue.
The request of the applicant at this time is to legalize the existing parking
lot as well as securing a relaxation of the 8 foot side yard requirement. It
i& the opinion of the Board of Zoning that the 8 foot side yard requirement
should be maintained which would still allow sufficient space on the applicant's
property to park seven cars in addition to the present three -car garage spaces.
Therefore, the Board of Zoning, after considering this matter at several of
the regular board meetings (March 16, April 6, April 20, May 4, 1961)
recommend the denial of the appeal to relax the 8 foot required side yard
set back.

said parking lot on any day after 10 p. m.; that said permittee shall
cause all parking lot lights thereon to be turned out at 10 p. m. daily;
that no car parked thereon at 10 p. m. shall be suffered or permitted
by said permittee to remain thereon after 11 p. m. on any day; and that
-a small entrance area in the rear of said parking lot area shall be maitained
by said permittee open and accessible for the delivery of goods and merchandise
to and for the operation of said restaurant.
RESOLVED FDRTAER, that the Council expressly reserves the right

application for a parking lot at 841 Grand Avenue.
In accordance with your request, at 2 P.M. on June 21, I con-
ferred with Mr. Mark Gehan and Mr. Paulos, attorneys for the
objectors and for Mr. Balzer respectively, together with Mr. and
Mrs. Pearson, the objectors, and have effected a compromise
agreement with all parties concerned.
The following provisions have been agreed to by both parties and
it is recommended that the necessary resolutions and ordinances
be passed incorporating the following in the approvals granted.
There are two appeals before the City Council, one is to grant a
ten car parking lot and the second is to waive the eight foot
setback.
All parties have agreed to and recommend the waiver of the eight
foot setback. They.have also agreed to recommend the granting of
a ten car parking lot with the understanding that the parking lot
will be closed at 10 P.M. daily and that a chain with appropriate
reflective signs be placed across the entrance from Grand Avenue
at 10 P. M., also that all of the parking lot lights shall be
turned out at 10 P.M. daily, and that the cars on the parking
lot after the closing hour of 10 o'clock will be allowed approxi-
mately one hour and then will be asked to leave, that the rear of
the parking lot will be.closed off at approximately 11 o'clock
and that a small area in the rear of the property be left open --
this area to be directly in back of 841 Grand Avenue and to be
away from the apartment house and to be used for the delivery of
goods and merchandise.

Both sides have expressed a desire that in the event, after some
period of time on a trial basis, this is not satisfactory they -
reserve the right to come back and ask for changes. The
undersigned recommends all of the above referred to conditions.

You laid over to June 20, 1961 an appeal of Earl W. Balzer,
who has made application for a 14 car parking lot at 841
Grand Avenue, and referred the matter to the undersigned,
with instructions to effect a compromise agreement between
the parties concerned. You also requested that I determine
whether or not there is any other property in the immediate
vicinity, which is available for a parking lot site.
I have personally surveyed the entire area for several
blocks around and there are no parking lots available for
this use within one block. There are some private parking
lots owned by other persons within one or two blocks, but
these are for other sp6dific uses.
A meeting was held in my office on June 7, 1961 which was
attended by Mr. and Mrs. Frank Pearson,and James Paulus, at-
torney for the applicant, and Mr. Mark Gehan, attorney.
Several suggestions were made by the petitioner, other sug-
gestions were made by the opponents, and I made several sug-
gestions in the nature of compromise agreements. We were un-
able to secure unanimous agreement on any basis of compromise.
The opponents presented additional information in the nature
of photos and records, which information the Council has not
received, and, on the basis of this information, compromise
was offered but the applicant refused to accept it.
Therefore, I am returning this file with no suggestion for
compromise that will be approved by both parties.

The City Council laid over to June 20th an appeal of Earl
Balzer and his application for parking lot, as more fully described
in the attached letters of H. C. Wieland, and requested that the City
Architect confer with the applicant and his attorney and certain
objectors in the vicinity, particularly Mr. and Mrs. Frank W. Pearson,
owners of an apartment building at 833 Grand Avenue, and their attorney
Mark H. Gehan, to effect a compromise agreement.
The Council also requested that the Architect determine whether
or not any other property in the immediate vicinity of the restaurant
might be available as an alternate site for a parking lot.
James Paulos appeared as attorney for Mr. Balzer.
We also attach a petition of 71 persons and several letters
of residents opposing the operation of the parking lot after 9 p. m.
Mr. Gehan said that they would approve operation of the parking lot
to 10 p. m., provided that it be not used after that hour.

Dear Madam;
This is in the matter of the application of Earl Balzer for a
permit for a ten -car customer off-street parking lot on property
located on the north side of Grand Avenue between South Victoria
and South Avon Streets. The details regarding this application
• are fully outlined in the letter of appeal which is also before
the Council at this time.
The applicant has submitted preliminary plans for review by our
staff and the Traffic Engineer. A final plan has not been sub-
mitted as the final parking lot layout will depend on the Council's
action on the appeal. In view of the fact that Grand Avenue is
zoned commercial, and curb parking as well as off - street parking
in this area is in great demand, it appears the off - street parking
application is a reasonable request. However, because of the fact
tbatitbis lot is in use until two and three a.m. and the adjoining
use is that of an apartment building, it is recommended that the
applicant construct a louvered, or basket -type wood fence running
parallel to the mutual property line.
The Board of Zoning recommdnds the granting of the application
for tt ten -car customer off- street parking lot on the above described
property subject to the plans and actual lay -out of the parking lot
meeting all the design standards for this type facility. It should
be pointed out that the Board did not consider the nuisance problem
generated by this facility as claimed by the owner of the adjoining
apartment building. It is the opinion of the Board of Zoning, that
they should consider only whether the zoning is proper, and whether
or not the plans meet the required standards for this type facility,
leaving all other considerations to the Council for determination.

the Petition
We, the undersigned, earnestly petition the City "Council of St. Paul to
restrict might time parking at the pizza house parking lot at 841 Grand Ave., after
9:00 P.M. which are the normal hours for rest and sleep.
The Pizza House`
The pizza house,and parking lot are located.in the middle of the block
completely surrounded by residential structures.
Open Hours
Thty are open until 2:00 A.M. Monday through Twumsoeand 3:00 A.M. on Friday
and 'Saturday.
Reasons for-Abatement
The bright lights together with the extremely late hours and the nighttime
parking lot noises has made it a match less desirable location in which to live both
for the home owner, and tenants.
Parking Lot Encourages Misbehavior
Because the parking lot is somoWha.t romoved from the street and public view
the sometimes boisterous element feel much less inhibited on the lot than on a more
public and open site, especially at the late hour.
Noise and Foul Talk
We who are within earshot of the lot are at times exposed to extremely
noisy conditions during the normal hours of sleep and rest. Besides_the. frequent _
starting of motors, loud talk and slamming of doors there is foul cursing and vulga
talk about sex.-

Dear Sirs:
This is in reference to the application of Earl W. Balzar
for a permit for off - street parking at his pizza house at 841
Grand Ave.
I own and live in the apartment house at 827 Grand Ave.
I also own the apartment house accross the street at 824 Grand
Ave.
The pizza lot has been used since Dec. 1960 without a
permit and we have had time to gbserve the conditions.
Especially late at night there is often dirty swearing
and loud talk besides car noises. Cars gun their motors up
and down the alley in back of our place keeping us awake. On
Friday and Saturday daylight is coming when they leave.
On property Within 200 feet of the pizza house there are
23 children under adult age. I have two teenage daughters and

Dear Sirs:
Reference File 15325 - Application for Permit for Off- Street
parking for the Pizza House at 841 Grand Avenue.
I am a tenant and live at 833 Grand Avenue, adjacent to the
parking lot which is only eight (8) feet from my living and bed
room windows. The Pizza House and lot are open until 2:00 and
3:00 a.m: formal sleep and living conditions are impossible
because of the noise - care starting, doors slamming; yelling
and cursing, etc.
Yes, a tenant can move at considerable expense: I an litterally
being driven out of a location and residence which I like*
The night time noise in the parking lot has destroyed the west
side of this building for normal comfortable living. Parking
in this lot should be forbidden after 6:00 p.m.
Surely tenants are not excluded from legal protection from
nuisance conditions such as this.
The people I have talked to in this neighborhood are 100% againat
night -time parking in this lot.
