PAUL FOENCIL NO. _ OFFICE OF THE CITY CLERK COUNCJL RESOLUTION- GENERAL FORM PRESENTED BY ` COMMISSIONER RESOLVED., upon the appeal of Cities Service Oil Company therefor, pursuant to Section 64.03 of the Zoning Code provisions of the Legislative Code of the City of Saint Paul, that the provisions of said Zoning Code hereby are varied to the extent necessary therefor, and.a permit hereby is granted unto said appellant for the extension of the permissible commercial use of the premises described as Lots 28 and 29, and except street Lot 30, Block L,., Kuhl's Iddition, situated at the northwest corner of Minnehaha and White }sear avenues, so that the-same ishall cover the entire aforesaid premises in a. single ownership and ::1-assified under said Zoning Code partially in a Commercial District and partially in an "A" Residence District., to accommodate the reconstruction and operation of existing filling station facilities un said premises. O'Connell City Clerk Building Dear Madam: This is in the matter of 1) the appeal of the Cities Service Oil Company for the extension of commercial use to cover the entire site, and 2) an application to reconstruct an existing filling station operation on pro- perty located at the northwest corner of Minnebaba and White Bear Avenues. The property is described as Lots 28 and 29, and except street,-Lot 30, Block 4, Kuhl's Addition.' This property has a frontage of 136 feet along White Bear Avenue and ex- tends to a depth of 120 feet along Minnehaha Avenue, resulting in an area of 16,320 square feet. The east 100 feet of this property is zoned commer- cial, and the west 20 feet is zoned "A" residence. The applicant is request- ing the extension of commercial use to include the entire site. This property was originally developed for filling station use in 1926, and was remodeled in 1940. In 1949, the filling station use was enlarged to include all of Lot 28. However, the need for the extension of. commercial use was apparently overlooked. The immediate area is developed as follows: west and adjoining is a single - family residence fronting on Minnehaba Avenue and which lies approximately seven feet above the.grade of Minnebaba Avenue; east across White Bear Avenue, southeast across the intersection of White Bear and Minnebaba Avenues, and south across Minnebaba Avenue are various commercial uses; north across a public alley is a doctor's clinic building which fronts on White Bear Avenue, and a single - family residence which fronts on Reaney Avenue. The Traffic Engineer and the Highway Department have reviewed and approved the applicant's plan which meets the standards for this type of facility. Field investigation discloses no basic objection to this proposal as all of the standards bf the city and state will be complied with. In consideration of the above factors, the Board of Zoning recommends the granting of 1) the appeal for the extension of commercial use to include'all of the above described property, and 2) the application for a permit to re- f construct the existing filling station on the above described property in accordance with plans approved•May 18, 1961.
