as more fully described in the attached letter of the Zoning Board,
in accordance with plans approved May 18, 1961.

Dear Madam;
This is in the matter of the application of McDonald Drive -Ins for a permit to
'install and operate a drive -in restaurant on property bound by Clarence Street
on the west and Prosperity Avenue on the south and east. The property is described
as, except the north 153 feet, that part of the northwest one - quarter of the
north -west one - quarter of Section 27, Township 29, Range 22.
On December 16, 1947, the City Council approved the reclassification of this
property from Heavy Industry District to an 11A11 residence district as part of
a larger tract. On April 6, 1954, the City Council again reclassified this
property as part of a larger tract from an t1A" residence district to a commer-
cial district. The site is presently vacant, and the applicant proposes to
develop it with a drive -in restaurant with a 50 car customer off - street parking
lot. This property is triangular in shape, having a frontage of 323.13 feet
along Prosperity Avenue, 266.62 feet along unimproved Clarence Street and
183.42 feet along the north property line which results in an area of approximately
24,451 square feet.
North and adjoining is a filling station which fronts on both Maryland and
Prosperity Avenues; south across Prosperity Avenue is vacant land, farther
south is the Pbalen Shopping Center; east across Prosperity Avenue is vacant
land and the rear yard of a single - family residence which fronts on Maryland
Avenue; west and across unimproved Crarjgtce Strebt is vacant property ;: to the
northwest and southwest are single - family residences.
The Traffic Engineer has approved the plan which meets the standards for this
type of facility. Field investigation discloses no basic objection as the
zoning is proper and the proposed Land Use Plan indicates the highest and
best use for,the property is for commercial uses.
In consideration of the above factors, the Board of Zoning recommends the
granting of the application for a drive -in restaurant on the above described
property in accordance with plans approved May 18, 1961.

Dear Madam:
This is in the mattbr of the application of Dr. Harold Pomeroy to
install and operate a wheel,alignment and tire - changing facility on
property located on the north side of Eighth Street between Jackson
and Temperance Streets. The property is described as the southwest-
erly 73 feet of Lot -8, V. D. Walsh's Rearr. of Lots 1 and 2, Block 16,
Robert and Randall's Addition, and Block 7, Hoyt's Addition and is
in the light industry district,
The site-is presently being used as a parking lot. The General Tire
Company proposes to develop it with a service garage building, and in
addition provide off-street parking for cars awaiting servicing. This
property has a frontage of approximately 73 feet along East Eighth Street
and extends to an average depth of approicimately88 feet, resulting in
a total area of approximately 6,424 square feet. East and adjoining is
the Pomeroy Animal Hospital which fronts on Eighth Street; west and
across a 15 foot alley is the General Tire Company and filling station;
north and adjoining is a private parking lot which fronts on Temperance
Street; south and across Eighth Street is a parking lot.
The Traffic Engineer has approved the plans which meet the standards
for this type of facility. Field investigation discloses no basic
objection as the proposed use will not have a detrimental effect on
the adjoining uses in the area.
In consideration of the above factors, the Board of Zoning recommends the
granting of the permit to install and operate a wheel alignment and
tire changing facility on the above described property in accordance
with the applicant's plans approved May 4, 1961,

McDonald Drive -in for permit to install and operate a drive -in
restaurant on the intersection of Prosperity and Clarence
which was scheduled for a public hearing before the City Council
at 10 :00 A.M. on June 15 9 1961, has been postponed one week, to
June 22r, 1961 at 10:00 A.M. in the Council Chambers of the City
Hall and Court Rouse Building.
This postponement is necessitated by reason of the Annual Convention
of the League of Minnesota Municipalities. This convention is being
held on June 14th, 15th, and 16th, and, as a number of the Council
members will be attending, there will not be a sufficient number for
a quorum of the City Council.
