O'Connell City Clerk Building Dear Madam; This is in the matter of the application of McDonald Drive -Ins for a permit to 'install and operate a drive -in restaurant on property bound by Clarence Street on the west and Prosperity Avenue on the south and east. The property is described as, except the north 153 feet, that part of the northwest one - quarter of the north -west one - quarter of Section 27, Township 29, Range 22. On December 16, 1947, the City Council approved the reclassification of this property from Heavy Industry District to an 11A11 residence district as part of a larger tract. On April 6, 1954, the City Council again reclassified this property as part of a larger tract from an t1A" residence district to a commer- cial district. The site is presently vacant, and the applicant proposes to develop it with a drive -in restaurant with a 50 car customer off - street parking lot. This property is triangular in shape, having a frontage of 323.13 feet along Prosperity Avenue, 266.62 feet along unimproved Clarence Street and 183.42 feet along the north property line which results in an area of approximately 24,451 square feet. North and adjoining is a filling station which fronts on both Maryland and Prosperity Avenues; south across Prosperity Avenue is vacant land, farther south is the Pbalen Shopping Center; east across Prosperity Avenue is vacant land and the rear yard of a single - family residence which fronts on Maryland Avenue; west and across unimproved Crarjgtce Strebt is vacant property ;: to the northwest and southwest are single - family residences. The Traffic Engineer has approved the plan which meets the standards for this type of facility. Field investigation discloses no basic objection as the zoning is proper and the proposed Land Use Plan indicates the highest and best use for,the property is for commercial uses. In consideration of the above factors, the Board of Zoning recommends the granting of the application for a drive -in restaurant on the above described property in accordance with plans approved May 18, 1961.
