7 WHEREAS, the City of Saint Paul, Minnesota is a participant in the Livable Communities Act's Housing
8 Ince�tives Program for 2008 as detezmined by the Metropolitan Council, and is therefore eligible to make
9 application for funds under its Tax Base Revitalization Account; and

i� WHEREAS, the City has identified environmental investigation and clean-up projects within the City t3iat
t2 meet the puipQSes and criteria of the Con2amircation Investigation and Cleanup Grant Program of tFte
i 3 Department of Employment and Economic Development, and the Tax Base Revitalization Accounz Grant
1a Program of the Meb Council;

�6 NOW, THEREFORE, BE IT RE50LVED, that the City Council of the City of Saint Paul, Minnesota
�7 hereby approves the contaminarion investigarion and cleanup grant applications submitted to the
i 8 Depaitment of Employment and Economic Development and the Metropolitan Council on November 3,
19 2008 by the City of Saint Paul for the New Horizon Charter School, Nova Classical Academy, the Penfield,
20 Lexington Commons, and Commercial Club sites; and

2z BE TT F+[JRTHER RESOLVED, that the City of Saint Paul, Minnesota agrees to act as legal sponsor for
z3 the projects contained in the cleanup grant applications submitted to DEED and the Met Council on
24 November 3, 2008 and that the Director of the Depaftment of Planning and Economic Development is
25 hereby authorized to apply to DEED and the Met Council foc funding of these projects on behalf of the
26 New Horizon Chazter School, Nova Classieal Academy, the Penfield, Lexington Coinmons, and Commercial Club
27 sztes; and

29 BE IT FURTHER RESOLVED, that the City has the legal authority to apply for financial assistance, and
3o flie institurional, managexial and financial eapability to ensure adequate project administration; and

32 $E IT FURTHER RESOLVED, that the sources and amounts of the local match identified in the
33 applications are committed to the pzoyects identified; and
34
35 BE IT FURTHER RESOLVED, the City of Saint Paul certifies that it has not violated any Federal, State
36 or local laws pertaining to fraud, bribery, graft, kickbacks, collusion, conflict of interest, or other unlawful
3� or cormpt practice and that it will comply with all applicable laws and regulations as stated in the contract
38 agreemants; and

4o BE IT FURTHER RESOLVED that upon approval of its applicarions by the Department of Employment
41 and Economic Development and the Metropolitan Council the City of Saint Paul may enter into agreements
4z with the State of Minnesota for the above-referenced projects, and that the City of Saint Paul certifies that it
43 will coinply with all applicable laws and regularion as stated in all conttact agreements;

as NOW THEREFORE BE IT FINALLY RESOLVED, that the Mayor and City Clerk of the City of Saint
a6 Paul are hereby authorized to execute such agreements as aze necessazy to implement the projects on behalf
