George Vavoulis�, Mayor, and Members of the City Council Court House I St. Paul 2, Minnesota G Gentlemen: We respectfully request the privilege of withdrawing our signatures to the application for rezoning of the property formerly owned by the Cherokee Sanatorium Corporation, 334 Cherokee, St. Paul 7, Minnesota, from Zone "A" to {Zone "C." This property is bounded by Alice Court and Orleans Street. We own the property across Orleans to the West. At the time we gave our consent to the application for re- zoning, we were informed by Mr. Paul Villaume that it was actually not necessary to have our signatures because they had enough pledged already, but that they wanted to keep us informed and also wanted to give us the opportunity to have a voice in the matter. 1 There are a numberlof reasons for our change in attitude, as follows: I f 1. Mr. Villaume stated that they were planning on rezoning the entire piece of property; 8 lots, as one unit. We have just re- cently learned that the property has been divided so that the two South lots are separated from the rest and are now owned individually by Mr. Baumeister and Mr. Bettenburg. This was done in order to create two more "'adjacent voting lots." We understand this procedure is legal but we feel that itlis circumventing the entire purpose of obtaining approval from adjoining property owners on such applications. 2. Mr. Villaume also stated at the time the property was purchased by the firm of Bettenburg and Baumeister that if the Planning Board turned down the application for rezoning to permit the building of the proposed apartments, they would build seven small dwellings on the lots. Naturally, we would much prefer seeing the very attractive cooperative apartment building which they described, with units costing $35,000 to $40,000 each, together with the proposed adequate parking facilities. 3. Mr. Villaume told us originally that they would have adequate garage space, either underground or on the surface. After seeing the proposed plans, it;is now our understanding that the area To the Mayor and Council - 2 - 4.26.61 intended for this purpose i' completely inadequate for garages for the number of apartments which they now propose to build, and that, in fact, they do not now contemplate the construction of any garages, but merely plan to have outdoor parking. Naturally, the neighbors now feel that they would be deprived of parking space in front of their own residences as a result of this situation. 1 4. The plans as presented show a driveway to the South of the property for cars entering the parking area. However,, it is quite apparent when measuring the map area that it would be necessary to have this drive placed on adjoining property in order to permit adequate space. 5. It is our understanding that Mr. Villaume has offered to pay several of the neighbors for their signatures, and the impli- cation has therefore been m�de in the neighborhood that we have also benefited as a result of signing the application. We have attempted to reassure the neighbors that such is not the case. It is apparent that a great deal of hard feeling has been engendered in the neighbo respectfully request that from the application for rhood, and, under the circumstances, we wefbe permitted to withdraw our signatures rezoning the property at 334 Cherokee. O'Connell City Clerk Building Dear Madam: i I This is in the matter of the petition of Bettenberg and Baumeister to rezone from "A" residence to "C" residence property located on the south side of Cherokee Avenue between'Orleansland Alice Streets. The property is described as Lots 23, 24, 25, 26, Block 5; Dawson's Addition, aid Lots 1 and 2, Block 13, Oliver's Addition to West St. Paul, also a strip of land 5 feet in width lying easterly of and adjoining.Lot 11, Block 13, Oliver's Addition. The property has been zoned " "W,' residence since the enactment of the Zoning Ordinance in 1922. This property, in part, was developed in 1899 with a three - story, red sandstone single - family residence. Some time prior to the enactment of the Zoning Ordi- nance it was converted to a sainitorium which was known as the Cherokee Sanitorium. In 1959, the StateIfBoard of Health ordered the operation discon- tinued until certain remodeling was accomplished. Because of the discontinuance of this operation, the property 11 owners were informed that the use could not be reinstated without first reclassifying the property to a "C" residence district. The site has since been sold to I the petitioner. If suddessful in rezoning the site, the petitioner proposes to remove the existing structure and erect nine exclusive row -type apartment buildings as shown on the applicant's plan and perspective drawing for a total of 29 or 30 units, with the necessary off- street parking accessory thereto. This is an irregularly shaped tract ofiland having street frontage on three streets, and resulting in a total area of approximately 47,670 square feet. The pro- posed development generously meets the required standards for density and building ground coverage. j North across Cherokee Avenue is the Cherokee Heights park property; west and across Orleans Street is an existing three - family residence fronting on Oberokee Avenue; the other uses in the area are single and two - family resi- dences with Alice Park on the east. The Board of Zoning considered this matter at their regular meeting on April 6, 1961 and recommend the granting of the petition to rezone the above described property from "A" residence to "C" residence.
