WHEREAS, Department of Safety and Inspecrions has served in accordance with the provisions of Chapter 45 of the Saint Paul Legislative Code an order identified as an "Order to Abate Nuisance Building(s)" dated June 19, 2008; and WHEREAS, this order informed the then known interested or responsible parties that the structure located on the Subject Property is a nuisance building(s) pursuant to Chapter 45; and WHEREAS, this order informed the interested or responsible parties that they must repair ar demolish the structure located on the Subject Property by July 21, 2008; and WHEREAS, the enforcement officer has posted a placard on the Subject Property declaring this building(s) to cox�stitute a nuisance condition; subject to demolition; and WHEREAS, this nuisance condition has not been corrected and Department of Safety and Inspections requested that the City Clerk schedule public hearings before the Legislative Hearing Officer of the City Council and the Saint Paul City Council; and WHEREAS, the interested and responsible parties have been served notice in accordance with the provisions of Chapter 45 of the Saint Paul Legislative Code, of the time, date, place and purpose of the public hearings; and WHEREAS, a hearing was held before the Legislative Hearing Officer of the Saint Paul City Council on Tuesday, September 23, 2008 to hear testimony and evidence, and after receiving testimony and evidence, made the recommendation to approve the request to order the ��-�t�E( 40 41 42 43 44 45 46 47 48 49 50 51 52 53 54 55 56 57 58 59 60 61 62 63 64 65 66 67 68 69 70 71 72 73 74 75 76 77 78 79 80 81 82 83 84 SS interested or responsible parties Yo make the Subject Property safe and not detrimental to the public peace, health, safety and welfare and remove its blighting influence on the community by rehabilitaring this structure in accordance with all applicable codes and ordinances, or in the alternative by demolishing and removing the struchu in accardance with all applicable codes and ordinances. The rehabilitarion or demolition of the sriucture to be completed within fifteen (15) days after the date of the Council Hearing; and WHEREAS, a hearing was held before the Saint Paul City Council on Wednesday, October 15, 2008 and the testimony and evidence including the action taken by the Legislative Hearing Officer was considered by the Council; now therefore BE IT RESOLVED, that based upon the testimony and evidence presented at the above referenced public hearings, the Saint Paul City Council hereby adopts the following Findings and Order concerning the Subject Property at 877 FRONT AVENUE. That the Subject Property comprises a nuisance condition as defined in Saint Paul Legislative Code, Chapter 45. 2. 3. That the costs of demolirion and removal of this building(s) is estimated to exceed five thousand dollars ($5,000.00). That there now exists and has existed multiple Housing or Building code violations at the Subject Property. 4. That an Order to Abate Nuisance Building(s) was sent to the then known responsible parties to correct the deficiencies or to demolish and remove the building(s). 5. � � That the deficiencies causing this nuisance condition have not been conected. That Deparhnent o£ Safety and Inspections has posted a placazd on the Subject Property which declares it to be a nuisance condition subject to demolition. That this building has been rourinely monitored by Department of Safety and Inspections, Vacant/NuisanceBuildings. If the above correcrive action is not completed within this period of time Department of Safety and Inspections is hereby authorized to take whatever steps are necessary to demolish and remove this shucture, fiA the site and charge the costs incurred against the Subject Proper[y ptusuant to the provisions of Chapter 45 of the Saint Paul Legislative Code. In the event the building is to be demolished and removed by the City of Saint Paul, all personal property or fixtures of any kind which interfere with the demolirion and removal shall be removed from the property by the responsible parties by the end of this time period. According to our files, it has been a vacant building since December 3Q 2005. The current property owners are Steven and Antoinette Dunn, per AMANDA and Ramsey county property records. The City of St. Paul has boarded this building to secure it from trespass. There have been nine (9) SLJMMARY ABATEMENT NOTICES since 2005. There have been ten (10) WORK ORDERS issued for: - Removal of snow and ice - Removal of tali grass and weeds - Removal of improperly stoted refuse and debris On May 2$, 2008, an inspection of the building was conducted, a list of deficiencies which constitute a nuisance condition was developed and photographs were taken. An ORDER TO ABATE A NUISANCE BUILDING was posted on June 19, 2008 with a compliance date of July 21, 2008. As of this date this property remains in a condirion which comprises a nuisance as defined by the legislative code. The Vacant Building registration fees are delinquent in the amount of $1,000. Taxation has placed an estimated mazket value of $37,600 on the 1and and $78,600 on the building. As of November 14, 2007, a Code Compliance inspection has been completed. The eaves and soffits are in a state of disrepair or deterioration. Repair al] defects, holes, breaks,loose or rotting boards, to a professional state of maintenance. Permit may be required. The exterior walls and/or trim of the house has defective, peeled, flaked, scaled or chalking paint or has unpainted wood surfaces. Scrape and repaint to effect a sound condition in a professional manner. The foundaxion is deteriorated, defective or in a state of disrepair. Repair all foundation defects in a professional manner to a weather-tight, water-tight and rodent-proof condition. Permit may be required. 5. There are missing or defective guardrails. Provide all stairways, porches, decks or steps which are more than 30" high with guardrails and intermediate rails with openings in the guardrail no more than four (4) inches apart and in accordance with the State Building Code. 6. The stairs have missing or defective handrails. Provide a11 interiox and exteriar stairways and steps of more that three (3) risers with handrails which are grippable and installed 34" to 38" above the nose of the stair treads. 7. STORM DOOR(S): The storm door(s) are in disrepair; repair or replace the door(s). 8. DEFECTNE STAIRS. Stairs are broken, defective, or in disrepair. Repair in a professional manner. 9. Lack of Water Service. Immediately restore water service. Failure to provide water service will result in these premises being declared Unfit for Human Habitation and ordered vacated for lack of this basic facility. 10. The window andlor door screens aze missing, defective or in a state of disrepair. Provide proper window and door screens for all openable windows and doars. Screens must be tight-fitting and securely fastened to the frames. 11. The windows andlor storm windows are in a state of disrepair. Replace all missing or broken window glass. Make all necessary repairs to frames, sashes, hardware and associated trim in a�rofessional manner. Permit may be required. June19,2008 877 FRONT AVE page 3 VD �'�'�t As owner, agent or responsibie party, you are hereby notified that if these deficiencies and the resulting nuisance condition is not conected by July 21, 2008 the Department of Safety and Inspections, Division of Code Enforcement, will begin a substantial abatement process to demolish and remove the building(s). The costs of this action, including administrative costs and demolition costs will be assessed against the property taYes as a special assessment in accordance with law. As first remedial action, a Code Compliance Inspection Report must be obtained from the Building Inspection and Design Section, 8 Fourth Street, Suite #200, Commerce Building, (651)266-9090. Any framing members that do not meet code (where wall and ceiling covering is removed, members that are over-spanned, over-spaced, not being carried properly, door and window openings that are not headered, etc.) are to be reconstructed as per code. Ordering the owner to remove or repair the building(s) at 877 Front Avenue within fifteen (15) days from adoption ofresolution. The property owners of record, Antoinette and Steven Dunn, appeazed. Ms. Dunn stated that they had purchased the property at auction in 2007; however, the closing did not occur until May 2, 2008. They were waiting for the outcome of this hearing before they determined how to proceed on either rehabbing or demolishing the building. Mr. Magner stated the building was a rivo-story, wood frame, duplex on a lot of 2,614 square feet and had been vacant since December 30, 2005. A code compliance inspection had been done on November 14, 2007, the vacant building registraUon fees were delinquent in the amount of $1,000, and the $5,000 performance bond had been posted on August 5, 2008. On May 28, 2008, an inspection of the building was done and a list of deficiencies which constitute a nuisance condition was developed. An order to abate a nuisance building was posted on June 19, 2008 with a compliance date of July 21, 2008. To date, the property remained in a condition which comprised a nuisance as defined by the Legislative Code. Ramsey County Taxation estimated the market value of the land to be approximately $37,600 and the building to be $78,600. Real estate taaces were current. Code Enforcement estimates the cost to repair the building to be approximately $50,000 to $60,000. The cost for demolition was estimated to be approximately $9,100 to $12,1OQ. There had also been nine suuunary abatements issued to this property since 2005, ten of which went to work order: to secure the building and the City had to board the building to secure it from trespass, remove improperly stored refuse, cut tall grass and weeds, and remove snow and ice. Mr. Magner said that the property owners had contacted him indicating that they had gutted the interior of the building and were waiting for a determination at this hearing. Code Enforcement recommends the building be repaired or removed within 15 days. Mr. Magner presented photographs of the property. Ms. Moermond asked for a report from Ms. Spong. Ms. Spong stated that this building was an 1889 workers cottage-style building which had not been surveyed. She said that were three houses on Front that were of historical significance as they were located across from Calvary Cemetery. She also noted that the front parch of the building had been removed, the siding had been covered, and there was no potenrial historic significance of this property. Mr. Magner stated that although the property was inspected as a duplex and had been operated as a duplex, he believed it was non-conforming given the size of the lot. He said that a building permit had been pulled on July 25 with a value of $30,000. Ms. Dunn stated that it was her intention to rehabilitate the building as a duplex and use it as an inveshnent property. Ms. Moermond stated that the vacant building fees needed to be paid, a work plan must be submitted which would need to include timelines and cost for the rehab as well as any contractor bids, and a financial plan must be submitted indicating the commihnent of funds to complete the project. She asked Ms. Dunn how long she believed it would take to complete the project. Ms. Dunn responded that she wouid need the 180 days as provided under the bond. She did have a construction loan and was in the process of hiring a general contractar to do the project. She explained that the contractor would not receive the funds from the bank until work on the project September 23, 2008 Legislative Hearing Minutes C� Page 5 was underway and items were completed. The financial provisions for the project were listed in the settlement statement wluch she could provide. Mr. Manger explained that under the conditions of the bond, the bond would be returned if the work was completed and signed off on within 180 days. The building official did have the authority to grant an additional 180 days provided that 50 percent of the work was completed within the first 180 days. Ms. Dunn stated that they had also received bids to demolish the building with the intent of then re- building. Mr. Magner stated that if that were the case, upon request, the department may consider rehuning the $5,000 performance bond. He also said that they would need to hire a licensed contractor to do the demolirion and a contract would need to be signed prior to the October 15 Council Public Hearing. He said that the department would also waive the vacant building fees for 2009 provided the rehabilitation was completed by May 5, 2009. Ms. Dunn stated that she believed she had received a letter in May indicating that the vacant building fees were only $500. Mr. Magner responded that the fees should have been paid at the time of closing; however, if she had the letter that was sent in May indicating that the vacant building fees were in the amount of $500, he would accept that amount from her as payment for the vacant building fees for 2008. Ms. Moemiond stated that the following must be provided by the end of business on Tuesday, October 7: 1) the vacant building fees must be paid; 2) a work plan must be provided; and 3) financial documentation indicating the amount of financing available to complete the rehab. If all conditions were met, she would then recommend granting 180 days to repair or remove the building.
