BY FINAL ORDER IN CONDEMNATION ���' PROCEEDINGS Council File 'No. 202017 — By Milton Rosen— FINAL ORDER IN CO] taking the matter of condemning and taking or easement in the land nec- CEEDINGS essary for slopes, cuts and fills, al sup- C ing the righR of removal of lateral sup` port from sub' -- wand_ or re, orcar - In the matter of condemning and taking an easement in the land necessary for slopes, cuts and fills, i -Including the right of removal of lateral support from subject land or remainder thereof occasioned by excavations thereof or construction of slopes in grading and surfacing with bituminous material Manton Street from Idaho Avenue to Larpenteur Ave., and Idaho Ave. from Birmingham Street to Hazelwood Street under Preliminary Order 200935 approved February 21, 1961 Intermediary Order 201571 approved April 13, 1961 A public hearing having been had upon the above improvement upon due notice, and the Council having heard all persons, objections and recommendations relative thereto, and having fully considered the same; therefore, be it RESOLVED, By the Council of the City of Saint Paul that the precise nature, extent and kind of im- provement to be made by the said City is condemning and taking an easement in the land necessary for slopes, cuts and fills, including the right of removal of lateral support from subject land or remainder thereof occasioned by excavations thereof or construction of slopes in grading and surfacing with bituminous material Manton Street from Idaho Avenue to Larpenteur Ave. and Idaho Ave. from Birmingham Street to Hazelwood Street and the Council hereby orders said improvements to be made. RESOLVED FURTHER, that the following land, lands or easements therein be and the same are hereby ordered to be taken, appropriated and condemned for the purpose of making said improvements, viz.: For slopes, cuts and fills, including the right of removal of lateral support from subject land or remainder thereof occasioned by excavations thereof or construction of slopes in grading and surfacing with bituminous material Manton Street from Idaho Avenue to Larpenteur Ave. and Idaho Ave. from Birmingham Street to Haze',lwodd Street to the extent shown on the plan on file in the office of the Commissioner of Public Works. RESOLVED FURTHER, That the Commissioner of Public Works be and is hereby instructed and directed to prepare plans and specifications for said improvement, and the proper city officials are hereby authorized and directed to proceed with the making of said improvement in accordance therewith.
