O'Connell City Clerk Building Dear Madam: OF SAINT PAUL SAINT PAUL Z, MINNESOTA I t May 3, 1961 This is in the.matter•of the appeal of Norbert Bisanz,to relax the building line set back on property located on the north side of St. Paul Avenue and the south side of Morgan Avenue between Edgcumbe Road and Davern Street. y The property is described as Lots 1, 2, 3, and the east 2.4 feet of Lot 4, Block 3, also Lots 6 thru 14, Block 4,_all being in Granport Addition. This property was rezoned to "C" residence on November 19, 1960, C. F. 199483. The site is presently vacant and the applicant proposes to develop it with a two,- story, brick -faced apartment building containing 62 units of housing for senior citizens with accessory parking thereto. The property has a frontage of 575.2 feet on both Morgan and St. Paul Avenues and a distance between the two streets of 138.8 feet (this includes a vacated alley adjoining St.Paul Avenue on the north) resulting_iu an area of approximately 79,867 square feet. Inasmuch as this property has frontage on both St. Paul and Morgan Avenues, it is subject to a set back of 20% of the average depth of the lots because a portion of the block is still classified in 4be "A" residence district. This would mean a normal set back of 28 feet from both streets. The applicant is requesting a 24 foot set back from Morgan Avenue and a 14 foot set back along St. Paul Avenue. The 14 foot set back along St. Paul Avenue would pertain to only 120 of the 575 feet of frontage. The remaining portion of the building would set back approximately 63 feet from St. Paul Avenue. The applicant's proposed building is "II" shaped, having a north -south length of 100 feet. As the property has a depth of only 138.8 feet, it is necessary to secure a re- laxation of the required building line set back to permit a reasonable develop- ment of the site. South and across St. Paul Avenue is vacant land proposed to be developed as a Jewish Community Center; east and adjoining is vacant land, farther to the east is a single - family residence fronting on Davern Street; north and across Morgan Avenue aretbree single - family residences, the remaining land to the north is vacant and undeveloped; west and adjoining is vacant land zoned "C" residence. Field investigation discloses no objection to this relaxation as it will not have any material or detrimental effect on any of the adjoining and surrounding properties. The request is a reasonable one, and in keeping with the purpose and intent of the Ordinance. In consideration of�tbe above factors, the Board of Zoning recommends the granting of the appeal to establish a 24 foot set back from Morgan Avenue an a 14 foot set back from St. Paul Avenue on the above described property. r Si cerely JCW :FGI 8. MI 8 -3814 and City Council and Court House April 33 1961. �WJ Yb� Pursuant to Chapter 64.03 Paragraph J, of the legislature zoning code, we request relaxation of the building setback requirements covering lots 6 through 14 of Block 4, Granports Addition. These lots are presently vacant and lay between Morgan and St. Paul Avenue and between Wheeler and Davern Avenues. The land is classified Zone "C" residential and we intend to build*a 68 unit apartment building on this site. This property faces on both St. Paul'Avenue and on Morgan Avenue which in effect causes double frontage. Present setback requirements are 271 on both Streets as per Chapter 62 of the above mentioned Code. �1 We ask that St. Paul Avenue be established as our frontage and the setback requirements be changed to 141 off St. Paul Avenue and 241 off Morgan Avenue.
