IL RESOLUTION— GENERAL FORM
WHEREAS, in the matter of Comptroller t s Contract L- 6178 -A for
the Grading and Paving of Forest Street from E. Seventh Street
to Maryland Avenue and the construction of a Storm Sewer from
Case Avenue to Cook Avenue, Ashbach Construction Company, con-
tractor, the specified date of completion is January 18, 1960,
and
WHEREAS, the Contractor has prosecuted the work diligently, but
due to delay in placing extra gravel sub -base and concrete
base work required between Bush Avenue and Wells Street not in-
cluded in the original Plans, it was not possible to complete
the Contract by'said date of completion, therefore, be it
j RESOLVED, that the proper City Officials be and they are hereby
authorized and directed to execute an amendment to said con-
tract extending the time of completion to AUGUST 25, 1960, pro-
vided, however, that this Resolution shall have no force or
effect unless the Sureties on the Contractor's Bond consent
thereto in writing and file such consent with the City Comp-
troller, and be it
FURTHER RESOLVED, that the City of St. Paul hereby waives all
claim fcr liquidated damages and that no engineering and in-
spection costs on this Project will be charged by the City on
account of such extended period.
