LOT 11 BLK 74 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 35 36 37 38 39 WHEREAS, based upon the records in the Ramsey County Recarder's Office and information obtained by Department of Safety and Inspections on or before April 14, 2008, the following are the now known interested or responsible parties for the Subject Property: Derek Akore, 1360 University Ave W, Suite #104, St. Paul, MN 55104; Derek Akore, 168� Clear Ave, St. Paul, MN 55106; Payne-Phalen District 5 Planning Council. WHEREAS, Department of Safety and Inspections has served in accordance with the provisions of Chapter 45 of the Saint Paul Legislative Code an order identified as an"Order to Abate Nuisance Building(s)" dated June 19, 2008; and WHEREAS, this order informed the then known interested or responsible parties that the structure located on the Subject Property is a nuisance building(s) pursuant to Chapter 45; and WHEREAS, this order informed the interested or responsible parties that they must repair or demolish the structure located on the Subject Property by July 21, 2008; and WHEREAS, the enforcement officer has posted a placard on the Subject Property declaring this building(s) to constitute a nuisance condition; subject to demolition; and VJHEREAS, this nuisance condition has not been corrected and Deparhnent of Safety and Inspections requested that the City Clerk schedule public hearings before the Legislative Aearing O£ficer of the City Council and the Saint Paul City Council; and WHEREAS, the interested and responsible parties have been served notice in accordance with the provisions of Chapter 45 of the Saint Paul Legislative Code, of the time, date, place and puxpose of the public hearings; and WHEREAS, a hearing was held before the Legislative Hearing Officer of the Saint Paul City Council on Tuesday, September 23, 2008 to hear testunony and evidence, and after receiving testimony and evidence, made the recommendation to approve the request to order the interested or responsible parties to make the Subject Property safe and not detrimental to the D� /�z z 40 41 42 43 44 45 46 47 48 49 50 51 52 53 54 55 56 57 58 59 60 61 62 63 64 65 66 67 68 69 70 71 72 73 74 75 76 77 78 79 80 81 82 public peace, health, safety and welfare and remove its blighting influence on the community by demolishing and removing the structure in accordance with all applicable codes and ordinances. The demolition of the shucture to be completed within fifteen (1S� days after the date of the Council Heazing; and WAEREAS, a hearing was held before the Saint Paul City Council on Wednesday, October 15, 2008 and the testimony and evidence including the action taken by the Legislarive Hearing Officer was considered by the Council; now therefore BE IT RESOLVED, that based upon the testimony and evidence presented at the above referenced pubiic hearings, the Saint Paul Gity Council hereby adopts the following Findings and Order concerning the Subject Property at 1096 SIMS AVENUE. 1. That the Subject Property comprises a nuisance condition as defined in Saint Paul Legislative Code, Chapter 45. 2. That the costs of demolirion and removal of this building(s) is estimated to exceed five thousand dollars ($5,000.00). 3. That there now exists and has existed mulriple Housing or Building code violations at tha Subject Property. 4. That an Order to Abate Nuisance Building(s) was sent to the then known responsible parties to correct the deficiencies or to demolish and remove the building(s). 5. That the deficiencies causing this nuisance condition have not been corrected. 6. That Department of Safety and Inspections has posted a placard on the Subject Property which declares it to be a nuisance condition subject to demolition. 7. That this building has been rourinely monitored by Department of Safety and Inspections, VacantiNuisance Buildings. 8. If the above conecrive action is not completed within this period of time Deparhnent of Safety and Inspections is hereby authorized to take whatever steps are necessary to demolish and remove this strucrixre, fill the site and chazge the costs incurred against the Subject Property pursuant to the provisions of Chapter 45 of the Saint Paul Legislative Code. 3. In the event the building is to be demolished and removed by the City of Saint Paul, all personal property or fixtures of any kind which interfere with the demolition and removal shall be removed from the property by the responsible parties by the end of this time period. If all personal property is not removed, it shall be considered to be abandoned and the City of Saint Paul shall remove and dispose of such property as provided by law. 100 4. According to our files, it has been a vacant building since April 13, 2008. The current property owner is Derek Akore, per AMANDA and Ramsey county property records. The City of St. Paul has boazded this building to secure it from trespass. There have been two (2) ST_JMMARY ABATEMENT NOTICES since 2008. There have been two (2) WORK ORDERS issued for: - Removal of improperly stored refuse and debris - Boarding On 7une 11, 2008, an inspection of the buiiding was conducted, a list of deficiencies which constitute a nuisance condition was developed and photographs were taken. An ORDER TO ABATE A NLTISANCE BUILDING was posted on June 19, 2008 with a compliance date of July 21, 2008. Lcking deadbQit door locks. Provide one-inch throw deadbolt locks for all entry doors to dwelling unit(s). 3. Lack of Electricity. Immediately restore electricai service. Failure to provide proper electrical service will result in these premises being declared Unfit for Human Habitation and ordered vacated for lack of this basic facility. Use of candles, fuel operated lighting or extension cord wiring is not permitted while the power is off. 4. FURNACE: Have a licensed heating contractor service and clean the furnace or boiler and make any necessary repairs. Perform a C{O test on the heating plant. Then, send the attached form back to the Inspector. Repair of gas fired appliances requires a permit. 5. Lack of Natural Gas Service. Immediately restore natural gas service. Failure to provide natural gas service will result in these premises being declared Unfit for Human Habitation and ordered vacated for lack of this basic facili�y. 6. G.F.C.I.: T'he bathroom is lacking an electrical G.F.C.I. outlet. Permit May Be Required. 7. The stairs haue missing or defective handrails. Provide a11 interior and exterior sCairways and steps of more that three (3) zisers with handrails which are grippable and instalied 34" to 38" above the nose of the stair treads. 8. The interior ceilings are defective. Repair all ceiling defects and finish in a professional manner. 9. The interior walls are defecrive. Repair all wall de£ects and finish in a professional manner. 10. There is evidence of a rodent infestation. Immediately exterminate and eliminate a11 rodents from the entire building. Remove rodent harbarages in the yard areas. Tuckpoint the foundation if necessary to rodent-proof the building to prevent re-infestarion. Iinmediately remove any dead sodents from the premises. SANITATION: Immediately remove improperly stored or accumulated refuse including; garbage, rubbish, junk, vehicle parts, wood, metal, recycling materials, household items, building materials, rubble, rires, etc., from yard. The Saint Paul L�gislative Code requires ai1 exterior property areas to be maintained in a ctean and sanitary condition. Usable materials must be stored in an approved manner, so as not to constitute a nuisance. 12. Smoke Detector: Lack of properly installed and operable smoke detector. Provide functioning smoke detectors in accordance with the attached requirement, within 24 hours. 13. DEFECTIVE STAIRS. Stairs are broken, defective, or in disrepair. Repair in a professional manner. Exterior 14. The eaves and soffits are in a state of disrepair or deterioration. Repair all defects, holes, breaks, loose or rotting boards, to a professional state of maintenance. Permit may be required. 15. The exterior walls andlar trim of the house and/or garage has defective, peeled, flaked, scaled or chalking paint or has unpainted wood surfaces. Scrape and repaint to effect a sound condition in a professional manner. 16. There are missing or defective guardrails. Provide all stairways, porches, decks or steps which are more than 34" high with guardrails and intermediate rails with openings in the guardrail no more than four (4) inches apart and in accordance with the State Building Code. 17. The exterior walls of the house are defective. Repair all holes, breaks, loose or rotting siding, to a professional state of maintenance. 18. STORM DOOR(S): The storm doar(s) are in disrepair; repair or replace the door(s). 19. The window andlor door screens are missing, defective or in a state of disrepair. Provide proper window and door screens for all openable windows and doors. Screens must be tight-fitting and securely fastened to the frames. 20. The windows andfor storm windows are in a state of disrepair. Replace all missing or broken window glass. Make all necessazy repairs to frames, sashes, hardware and associated trim in a professional manner. Permit may be required. As owner, agent or responsible paxty, you are hereby notified that if these deficiencies and the resulting nuisance condition is not corrected by July 21, 2008 the Department of Safety and Inspections, Division of Code Enforcement, will begin a substantial abatement process to demolish and remove the building(s). If you sell, transfer, or convey in any manner, the ownership or responsibility for this property, you must within seven (7) days, notify the Enfarcement Officer with the names and addresses of any new owners or responsible parties. The Enforcement Officer is required by law to post a placard on this property which declares it to be a"nuisance candiYion", subject to demolition and removal by the City. Tbis placard shall not be removed without tYie written authority of the Department of Safety and Inspections, Division of Code Enforcement. The department is further required to file a copy of this "Order to Abate" with the Citv Clerk's Office. If corrective acfion is not taken within the time specified in this order, the Enfarcement Officer will notify the Ciry Couneil that abatement acfion is necessary. The Ciry Clerk will then scbedule dates for Public Aearings befare the City Council at which time testimony will be heard from interested parties. After this hearing the City Council will adopt a resolution stating what action if any, it deems appropriate. If tl�e resolution calls for abatement action the Cauncil may either order the City to take the abatement action or fix a time within which this nuisance must be abated in accardance with the pmvisions of Chapter 33 of the Saint Paul Legislative Code and provide that if cotrective action is not taken within the specified time, the City shall abate this nuisance. The costs of this action, ineluding administrative costs wi11 be assessed against the property as a special assessment in accordance with law. Ordering the owner to remove or repair the building(s) at 1096 Sims Avenue within fifteen (15) days from adoption of resolution. The property owner of record, Derek Akore, did not appear. No other parties of interest appeared. Mr. Magner stated the building was a one-story, wood frame, singie-family dwelling with a detached garage on a lot of 4,792 square feet and had been vacant since April 13, 2008. A code compliance inspection had not been done, the vacant building registration fees were current, and the $5,004 performance bond had not been posted. On June 11, 2008, an inspection of the building was done and a list of deficiencies which constitute a nuisance condition was developed. An order to abate a nuisance building was posted on June 19, 2008 with a compliance date of July 21, 2008. To date, the property remained in a condition which comprised a nuisance as defined by the Legislative Code. Ramsey County Taxation estunated the market value of the land to be approximately $40,000 and the building to be $135,000. Real estate taxes were current. Code Enforcement estimates the cost to repair the building to be approximately $50,000 to $60,000. The cost for demolition was estimated to be approximately $8,200 to $11,200. There had also been two snmmary abatements issued to this property since 2008, two of which went to work arder: to secure the building and the Gity had to boazd the building to secure it from trespass, remove improperly stored refuse, and boarding. Code Enforcement recommends the building be repaired or removed within 15 days. Mr. Magner presented photographs of the property. Ms. Moermond asked for a report from Ms. Spong. Ms. Spong stated that this building was built in 1916 and was a bungalow-style house. She noted that there had been some alterations to the exteriar of the building and there was a significant loss of integrity due to a fire. The building also was not located in any potential historic dish Ms. Moermond recommended the building be removed within 15 days with no option for repair.
