WHEREAS, Deparhnent of Safety and Inspections has requested the City Council to
hold public hearings to consider the advisability and necessity of ordering the repair or wrecking
and removal of a single story, wood frame, single family dwelling located on property
hereinafter referred to as the "Subject Property" and commonly laiown as 993 MARYLAND
AVENiIE EAST. This property is legally described as follows, to wit:

WHEREAS, based upon the records in the Ramsey County Recorder's Office and
information obtained by Department of Safety and Inspections on or befare Apri114, 2008, the
following are the now known interested or responsible parties for the Subject Property:
Deutsche Bank Nat Trust Co/Co Option One Mortgage, 6501 Irvine Center Drive, Irvine, CA
92618; Reiter & Schiller, 25 N Dale St, 2" Floor, 5t. Paul, MN 55102; Payne Phalen District 5
Planning Council.
WHEREAS, Department of Safety and Inspections has served in accordance with the
provisions of Chapter 45 of the Saint Paul Legislative Code an order identified as an"Order to
Abate Nuisance Building(s)" dated June 19, 2008; and
WHEREAS, this order informed the then lrnown interested or responsible parties that the
structure located on the Subject Property is a nuisance building(s) pursuant to Chapter 45; and
WHEREAS, this order informed the interested or responsible parties that they must repair
or demolish the structure located on the Subject Property by July 21, 2008; and
WHEREAS, the enforcement officer has posted a placard on the Subject Property
declaring this building(s) to constitute a nuisance condition; subject to demolition; and
WHEREAS, this nuisance condition has not been conected and Department of Safety
and Inspections requested that the City Clerk schedule public hearings before the Legislative
Hearing Officer of the City Council and the Saint Paul City Council; and
WHEREAS, the interested and responsible parties have been served notice in accordance
with the provisions of Chapter 45 of the Saint Paul I.egislative Code, of the time, date, place and
purpose of the public hearings; and
WF3EREAS, a hearing was held before the Legislarive Hearing Officer of the Saint Paul
City Council on Tuesday, September 23, 2008 to hear testimony and evidence, and after
receiving testimony and evidence, made the recommendation to approve the request to order the

interested or responsible parties to make the Subject Property safe and not detrimental to the
public peace, health, safety and welfare and remove its blighting influence on the community by
demolishing and removing the structure in accordance with all applicable codes and ordinances.
The demolirion of the shucture to be completed witlun fifteen (IS) days after the date of the
Council Hearing; and
VJHEREAS, a hearing was held befare the Saint Paul City Council on Wednesday,
October 15, 2008 and the testimony and evidence including the action taken by the Legislative
Hearing Officer was considered by the Council; now therefore
BE IT RESOLVED, that based upon the testimony and evidence presented at the above
referenced public hearings, the Saint Paul City Council hereby adopts the following Findings and
Order concerning the Subject Property at 993 MARI'LAND AVENUE EAST.
That the Subject Property comprises a nuisance condition as defined in Saint Paul
Legisiative Code, Chapter 45.

That the costs of demolition and removal of this building(s) is estimated to exceed
five thousand dollars ($5,000.00).
That there now exists and has existed multiple Housing or Building code
violations at the Subject Property.
4. That an Order to Abate Nuisance Building(s) was sent to the then known
responsible parties to correct the deficiencies or to demolish and remove the
building(s).

That the deficiencies causing this nuisance condirion have not been corrected.
That Depathnent of Safety and Inspections has posted a placard on the Subject
Property which declares it to be a nuisance condition subject to demolition.
That this building has been routinely monitored by Department of Safety and
Inspections, VacantlNuisance Buildings.
That the lrnown interested parties and owners are as previously stated in this
resolution and that the notification requirements of Chapter 45 have been fulfilled.

accordance with all applicable codes and ordinances. The demolition and removal of the
structure must be completed within fifteen (15) days after the date of the Council
Hearing.
2. If the above corrective action is not completed within this period of tune Department of
Safety and Inspections is hereby authorized to take whatever steps are necessary to
demolish and remove this structure, fill the site and charge the costs incurred against the
Subject Property pursuant to the provisions of Chapter 45 of the Saint Paul Legislative
Code.
In the event the building is to be demolished and removed by the City of Saint Paul, all
personal property or fixtures of any kind which interfere with the demolition and removal
shall be removed from the property by the responsible parties by the end of this time
period. If all personal property is not removed, it shall be wnsidered to be abandoned
and the City of Saint Paul shall remove and dispose of such property as provided by law.
4. It is fizrther ordered, that a copy of this resolution be mailed to the owners and interested
parties in accordance with Chapter 45 of the Saint Paul Legislative Code.

The building is a one-story, wood frame, single-family dwelling on a lot of 6,970 square feet. There was
also another house on the same pazcel with an address of 1214 Cypress Street.
According to our files, it has been a vacant building since Apri14, 2008.
The current property owner is Deutsche Bank National Trust Co c/o Option One Mortgage, per
AMANDA and Ramsey county property records. Bob Pilz and his partner Kyle Benning recently
purchased the property.
The City of St. Paul has boarded this building to secure it from trespass.
There haue been four (4) SUMMARY ABATEMENT NOTICES since 2008.
There have been five (5) WORK ORDERS issued for:
- Removal of tall grass and weeds
- Removal of improperly stored refuse and debris
- Boarding
On May 20, 2008, an inspection of the building was conducted, a list of deficiencies which constitute a
nuisance condition was developed and photographs were taken. An ORDER TO ABATE A NUISANCE
BUILDING was posted on June 19, 2008 with a compliance date of July 21, 2008. As of this date this
property remains in a condition which comprises a nuisance as defined by the legislative code.
The Vacant Building registration fees are paid.
Taxation has placed an estimated market value of $39,700 on the land and $185,300 on the building.
As of September 19, 2008, a Code Compliance inspection has not been completed.
As of September 19, 2008, the $5,000.00 performance bond has not been posted.
Real Estate taxes are current.
Code Enforcement Officers estimate the cost to repair this structure is $30,000-$40,000. The estimated
cost to Demolish is $6,380 to $9,380.
NIIPI, Division of Code Enforcement Resolution submitted for consideration orders the property owner
to repair or remove this structure within fifteen (15) days, if not the resolution authorizes the Division of
Code Enforcement to demolish and assess the costs to the property.

property. IY is the recflmmendation of the IIepartment of Safety and Inspecuons that the City

remove this building in a timely manner, and failing that, authorize the Department of Safety and
Inspecrions to proceed to demolirion and removal, and to assess the costs incuned against the

to comprise a nuisance condition in violation of the Saint Paul Legislative Code, Chapter
45.02, and subject to demolition under authority of Chapter 45.11.
On May 20, 2008, a Building Daficiency Inspection Report was compiled and the following
conditions were observed.
This list of deficiencies is not necessarily all the de�ciencies present at this time.
As first remedial action, a Code Compliance Inspection must be obtained from
the Buffding Inspecrion and Design Section, 8 Fourth Street East, Suite 200,
Commerce Building (651)266-9090. That inspection will identify specific defects,
necessary repairs and legal requirements to correct this nuisance condition. You
may also be required to post a five thousand dollar ($5,000.00) performance
bond with the Building Inspection and Design Office before any permits are
issued, except for a demolition permit.
This building(s) is subject to tbe restrictions of Saint Paul Ordinance Chapter 33.03
and shall not again be used for occupancy until such time as a Certificate of
Compliance or a Certificate of Occupancy has been issued.

Exterior
1. The eaves and soffits are in a state of disrepair or deterioration. Repair all
defects, holes, breaks, loose or rotting boards, to a professional state of
maintenance. Permit may be required.
2. The exterior walls and/or trim of the house has defective, peeled, flaked,
scaled or chalking paint or has unpainted wood surFaces. Scrape and repaint
to effect a sound condition in a professional manner.
3. The foundation is deteriorated, defecrive or in a state of disrepair. Repair all
foundation defects in a professional manner to a weather-tight, water-tight and
rodent-proof condition. Permit may be required.
4. The xoof is deteriorated, defecrive, or in a state of disrepair. Repair or replace
the roof covering to a sound, tight and water impervious condition. Permit
may be required.
5. STORM DOOR(S): The storm door(s) are in disrepair; repair or replace the
door(s).
6. The window andJor door screens are missing, defective or in a state of
disrepair. Provide proper window and door screens for all openable windows
and doors. Screens must be tight-fitting and securely fastened to the fiames.
The windows andlor storm windows are in a state of disrepair. Replace all
missing or broken window glass. Make all necessary repairs to frames,
sashes, hardwue and associated trim in a professional manner. Permit may be
required.
A Condemnation Report was prepared on March 31, 2008 by James Thomas. The
following details the deficiencies from this report:
Remove the accumulation of snow or ice from the public and private
sidewalk abutting this property.
SPLC 34.23, MSFC 110.1 - This occupancy is condemned as unsafe or
dangerous. This occupancy must not be used until re-inspected and
approved by this office. No water service
SPLC 34.11 (6), 3434 (3) - Provide service of heaYing facility by a
licensed contractor which must include a carbon monoxide test. Submit a
completed copy of the Saint Paul Fire Marshal's Existing Fuel Surning
Equipment Safety Test Report to this office.

supply to all water closets, sinks, showers and tubs.
5. SPLC 39.02(c) - Complete and sign the provided smoke detector affidavit
and return it to this office.
As owner, agent or responsible party, you are hereby notified that if these deficiencies and the
resulting nuisance condition is not conected by July 21, 2008 the Department of Safety and
Inspecrions, Division of Code Enforcement, will begin a substantial abatement process to
demolish and remove the building(s). The costs of this action, including administrative costs
and demolition costs will be assessed against the property taYes as a special assessment in
accordance with law.
As first remedial action, a Code Compliance Inspection Report must be obtained from the
Building Inspection and Design Section, 8 Fourth Street, Suite #200, Commerce Building,
(651)266-9090. This inspection will identify specific defects, necessary repairs and legal
requirements to correct this nuisance condition.
As an owner or responsible party, you are required by law to provide full and complete
disclosure of this "Order to Abate" to all interested parties, all present or subsequent renters and
any subsequent owners. If you sell, transfer, or convey in any manner, the ownership or
responsibility for this property, you must within seven (7) days, notify the Enforcement Officer
with the names and addresses of any new owners or responsible parties.
The Enforcement Officer is required by law to post a placard on this property which declares it
to be a°nuisance condition", subject to demolition and removal by the City. This placazd shall
not be removed without the written authority of the Department of Safety and Inspections,
Division of Code Enforcement. The department is further required to file a copy of this °Order
to Abate" with the City Clerk's Office.
If corrective action is not taken within the time specified in this order, the Enforcement Officer
will notify the Ciry Council that abatement action is necessary. The City Clerk will then
schedule dates for Public Hearings before the City Councii at which time testimony will be
heard from interested parties. After this hearing the City Council will adopt a resolution stating
what action if any, it deems appropriate.
If the resolution calls for abatement action the Council may either order the City to take the
abatement action or fix a time within which this nuisance must be abated in accordance with the
provisions of Chapter 33 of the Saint Paul Legislative Code and provide that if corrective action
is not taken within the specified time, the City shall abate this nuisance. The costs of this
action, including administrative costs will be assessed against the property as a special
assessment in accordance with law.

4. Ordering the owner to remova ar repair the building(s) at 993 Marvland Avenue East within
fifteen (15) days from adoption of resolution.
The property owner of recard, Bob Pilz, appeared. He stated that he and his partner, Kyle Benning,
purchased this properiy on August 22, 2008 as well as the house on 1219 Cypress Street which was
located on the same parcel of land. The hearing for 1219 Cypress was scheduled for October 14
and it was there intention to rehab that structure and remove the building at 993 Maryland. Mr. Pilz
presented a letter of commirinent from Raymond Hall, Allied Funding, LLC, and a proposed wark
plan far the rehabilitation of 1219 Cypress.
Mr. Magner stated the building was a one-story, wood frame, single-family dwelling on a lot of
6,970 squaze feet and had been vacant since April 4, 2008. A code compliance inspection had not
been done, the vacant building registratian fees were current, and the $5,000 performance bond had
not been posted. On May 20, 2008, an inspection of the building was done and a list of deficiencies
which constitute a nuisance condition was developed. An order to abate a nuisance building was
posted on June 19, 2008 with a compliance date of July 21, 2008. To date, the property remained in
a condition which comprised a nuisance as defined by the Legislative Code. Ramsey County
Tasation estimated the market value of the land to be approximately $39,700 and the building to be
$185,300. Real estate taxes were current. Code Enforcement estimates the cost to repair the
building to be approximately $30,000 to $40,000. The cost for demolition was estimated to be
approximately $6,380 to $9,380. There had also been four summary abatements issued to this
property since 2008, five of which went to work order: to secure the building and the City had to
board the building to secure it from trespass, remove improperly stored refuse, cut tall grass and
weeds, and boarding. Code Enforcement recommends the building be repaired or removed within
15 days. Mr. Magner presented photographs of the property.
Ms. Moermond asked for a report from Ms. Spong. Ms. Spong stated that both buildings were built
in 1915 and that the Maryland building was originally constructed as a store. She noted that there
was a loss of integrity to both buildings and even though both were located on comers, they were
set back too far to be an anchor to the corner. She did not believe demolition of this property would
have any adverse effect on the neighborhood.
Mr. Pilz stated that the Cypress property was in good shape and they wanted to remove the
Maryland property conditioned on the grant of time to rehabilitate Cypress. He said that they had
paid the vacant building fees for both properties, paid all of the outstanding assessments, had posted
the bond far the Cypress property, and had gotten the code compliance inspection for the Cypress
property. He also said that Raymond Hall was their financier and would be paying the cost for the
rehabilitation of 1219 Cypress.
Ms. Moermond responded that she was unable to conduct a hearing on the Cypress property since
legal notification had been sent for the October 14 hearing date. She suggested that he could pull
permits and begin the work on the Cypress property if he wished to do so. Ms. Moermond
reviewed the work plan and said that it was inadequate as she required a more detailed, thorough
plan which included timelines for completing the work as well as contractor bids. She also said that
she needed additional financial information other than what was presented in the letter of
commitment from Raymond Hall. She asked Mr. Piiz why Mx. Hall was financing the rehab. Mr.
Piiz responded that he owed Mr. Hall from his past working relationship wlth him.

Mr. Magner suggested he could explain. Phase Two LLC acquired the properiy and Raymond Hail
is operating as the financier for the LLC to operate. In reviewing the commitment letter, he said
that an additional letter would need to be provided indicating that Mr. Hall was dedicating the
amount of funding required to demolish the Mazyland properry and to rehabilitate the Cypress
property. He said that if Mr. Pilz desired to do the demolition themselves, he would need to have a
signed contract between the LLC and the contractor prior to the October 15 Council Public Hearing.
The demolition contractor would then be required to pull a permit to do the demolition and noted
that the City's bids did not include the cost of the MPCA inspecrion and removal of any asbestos
from the property.
Ms. Moermond stated that Mr. Pilz was welcome to demolish the building himself condirioned on a
si�ed contract with a contractor by October 15. Otherwise, the City would demolish the building
and assess the cost to the property taates. She recommended the building be removed within 15
days with no option for repair.
