WIIEREAS, the CITY has progamming at varioas recreation centers that can utilize additiona] staff to enhance and
provide quality programming to the public and;
WI�REAS, the tJNIVERSIT'Y OF IOWA has the ability to provide a number of intemship eligible students to work at
the recreation centers, along side CITY employees to help enhance pro�aznming, and;
WHEREAS, a partnership with the LINNERSITY OF IOWA will not displace current certified employees, and;
WHEREAS, both parties wish to enter into an agreement to further the mission of both organizations, by working
together on an on-going basis in providing internship opportunities for students to support CITY employees in providing qualiry
recreation programming, and for the students academic enrichment and;
WHEREAS, neither organization is obligated to make payments of any kind to the other organization and;
THEIiEFORE, BE IT RESOLVED, that the City of Saint Paul and the Saint Paul Ciry Council authorizes the
Division of Parks and Recreation to enter into a three yeaz agreement with the LINIVERSITY of IOWA.

The University of Iowa has approached Pazks and Recreafion about being a site for their intemship program. Pazks would have no
financial responsibility for this program and it would be an educational experience for students to get credit. These intems W OiJLD
NOT take the piace of any certified staff.
AdvaMages If Approved:
Pazks would be engaging in the education process and mutnring fizture leaders in Pazks and Recreation. Although these interns would
not supplant certified staff, they could certainly enhance programming.
Disadvantages If Approved:
None
Disadvantages If Not Approved:
Parks would lose out in pazticipating with an educational ins6tution of ]vgher learning to promote careers in the field. Pazks may also
lose out on intems that would supplement programming.

Saint Paul Parks and Recreation
This Agreement is made and entered into this day of , 200_, by and between
The University of Iowa ("University") and Saint Pau! Parks and Recreation ("Facility").
WHEREAS, the parties wish and intend by this Agreement to set forth the terms and conditions of
engaging in a cooperative program for the purpose of providing undergraduate internship
experiences for academic credit.
NOW, THEREFORE, in consideration of the foregoing and the mutual promises set forth herein,
University and Facility agree as follows:
PURPOSE
University offers an educational program (hereafter "Program") for academic
credit in order to provide a learning environment outside the ciassroom for the transfer of
concepts, principles, theories and modeis fearned by undergraduate students in the
Interdepartmental Studies Program to the professionaf practice setting.
il. RESPOIVSIBILITIES OF UNIVERSITY
A. University, after consultation with appropriate representatives of
Facility, will pian and conduct the educational program for students' experiences, and wiil provide
Facility with specific Program objectives, academic assignments for student reports and projects,
and student evaluation mechanisms.
B. University will provide reasonable opportunities for the staff of Facility to
participate in joint planning and evaluation of student experiences and to participate in the
development of student schedules.
C. University wiil provide advance information to Facility concerning
academic procedures and policies of the Program, names of students and dates to ailow Facifity
time and opportunity to reasonably accommodate the University's Program.
D. University will inform and explain to students of Program that during the
Program at Faciiity, they wili be under the jurisdiction of Facility o�cials for training purposes and
will foliow Facility rules to the extent that such rules relate directly fo education and training in
Program.

E. University wifl determine the course of action when a student is
determined unacceptable for the Program dy Universify or Facility. University will withdraw a
Student from the Program at Faciiity if Student is academically ineligible, or aRer consultation with
Facility in accord with Paragraph III.D, tlniversity determines such action to be warranted,
Universiiy will provide Facifity wrttten notificadon of such withdrawal.
lll. RESPONSIBILITIES OF FACILITY
A. Facifity wiii provide a suitabie environment for tearning experiences for
University Students which are pianned, organized, and administered by quafified staff in
conjunction with designated University personnei, in accordance with mutuaily agreed upon
education objectives and guidelines.
B. Facility will provide or arrange fior emergency treatment in the event of
accident or iliness to Students associated with their learning experience whiie at the Faciiity for
the Program, such care to be provided at the Students' expense.
C. Facility will provide the facilities, equipment, and supplies which are
necessary to achieve the educational objectives of the Program and which may be required by
federal andlor state law and regulations.
D. Facility reserves the right, exercisable in its discretion after consultation
with University in accord with Paragraph II.E, to exclude any student from its premises in the
event that such students' conduct or state of health is deemed objectionable or detrimentaf to the
proper administration of Facility, subject to the non-discrimination provision of Paragraph VI. To
assist University in its due process obligations to student excluded or withdrawn from Program,
Facility agrees to provide a written statement of the reason or reasons for the withdrawal or
exclusion.
E. Faciliiy acknowledges that many student educational records are
protected by the Family Educational Rights and Privacy Act ("FERPA"), and that student
permission must be obtained before releasing specific student data to anyone other than
University. University agrees to provide guidance to Faci(ity with respect to complying with
FERPA.
IV. TERM AND TERMINATION
A. This Agreement is for a term of three (3) years beginning on the effective
date of this Agreement, and may be renewed by mutuai written consent of the parties for an
uniimited number of renewal terms of three (3} years each.
B. This Agreement may be terminated for any reason by ei{her party upon
one hundred twenty (120) days written notice. Should notice of termination be given, students
assigned to the Facility shall be allowed to complete any previous(y scheduled internship
assignment then in progress at Facility.

V. LlA6(LITY
A. Faciiity agrees to indemnify, defend, and hold University harmless from
any and all claims arising from patient or client care provided or supervised by Fac+lity.
B. University agrees to be responsible for any and af{ cfaims and liability for
injury to persons or property arisi�g out of or caused by the negligence of its agents, employees,
or officers in the performance of the duties and obiigations contempiated in the Agreement to the
extent permitted 6y Chapter 669 of the Code of lowa.
VI. NON-DISCRIMINATION
Each party shall be separately responsibie for compliance with all anti-
discrimination laws that may be applicable to their respective aefivit+es under this Program.
Neither party wifl discriminate against any student in the Program on the basis or race, national
origin, color, re{igious beiief, sex, age, maritai status, affectionai or associational preference, or
disability.
VII. CONSIDERATION
A. Under the terms of this Agreement, neither party is obiigated to make
any payments of any kind to the other party.
B. Services rendered by students covered by this Agreement are
considered to be educational in nature, and therefore, no monetary compensation shall be paid to
students by Facility, or patientsJciients thereof. Nothing in the execution or performance of this
Agreement shall be construed to establish an employer-empfoyee, an agency, a partnership or a
joint venture relationship among the University, the Faci�ity, and the students.
Vill. GOVERNING LAW
This Agreement shall be governed by and construed under the laws of the State
of lowa which shall aiso be the venue for any disputes arising hereunder.

iX. ENTIRE AGREEEMENT
This Agreement cons5tufes the entire understanding between the parties with
respect to the subject matter hereof, and supersedes any and afl prior understandings and
agreements, orai or written, relating hereto. Any amendment hereof must be made in writing and
agreed to by all parties.
