RESOLVER, upon consideration of an application of Josephine Sabesta

for the removal of stone therefrom on the land abutting upon the south line

section with the prolongation of the 5W'ly line of Rankin
S t. at 'a distance of 70 ft. from the SE'ly corner of
Lot 32, Block 2, Youngman and Lamm's Add. as measured
along the said prolongation;
that said application be granted and that such permit for said purposes affecting
said land be issued to said applicant as permittee, subject to all applicable
provisions of Sections 60.21, 60.22, 462.01 to 462.05 inclusive, of the Legislative
Code of the City of Saint Paul, ,and further subject to the operative effect of
necessary rezoning proceedings under the Zoning Code provisions of said Legislative
Code now in process and-as the same shall be required, to the end that such
quarrying -and stone removal operations shall be consistent with said Zoning Code
as-the same shall be amended;
RESOLVED FURTHER, that said operations under said permit shall;be extended
to include the following additional adjacent. areas for the same purposes, until
June 1, 1962, to -wit: an additional area in Shepard Road right of way lying
southerly of building situate on Lot.25, Fort Street Out Lots above the elevation_.
to which said area and sai right of way in said Lots 25 pAgf26,. Fort Street Out
Lots heretofore has-been guarried, and that additional area lying in Lots 25 and
26 and the East 4 of Lot 27, Fort Street Out Lots and a line southerly of Stewart
Avenue and northea$terly of Shepard Road right of way above the elevation to which
the area in said right of way in said Lots 25 and 26 heretofore h4p—been a,»rrigd;

RESOLVED FURTHER, that -all applicable requirements-and provisions of
said Sections of said Legislative Code shall be observed and compliance therewith
made by said permittee, provided, nevertheless, that in respect of requirements of
same for the furnishing of a surety bond only one surety bond shall be required -
to be furnished by said permittee, and the same shall be in the sum of X51,000,
conditioned for said permittee's observance and faithful performance of all the
terms and requirements of said Sections of said Legislative Code and to protect
and save harmless the City of Saint Paul and all other persons from all,loss and
damage by reason of said permittee's operations under said permit, which bond
shall stand first for the protection and security of said City and second after
all things of said City have been satisfied, for the benefit of dry andzall persons
damaged or injured by reason of maintenance or operation of eny such quarries or,
quarrying operations by slid permittee under said permit;
RESOLVED FURTHER, that .additional to the foregoing requirements hereby
imposed upon said permittee, said permittee shall, at said permittee's own cost
and expense, procure and maintain policies of public liability, insurance indemni-
fying said permittee and said City of and from :all liability on -account of injury
to person or property arising therefrom or connected therewith in operations of
said permittee under said permit for the sufferance of said operations by said
City thereunder, in the amount of at least $100,000 on account of any single
accident in respect of personal injuries and. 1$101000 on account of any one accident
in respect of injury to property. Such policies of insurance shall be approved as
to form by the Corporation Counsel and shall be maintained throughout the operative
period of said permit.
