DeCourcy —Robert F: Peterson — Milton Rosen—, 2_010490 Resolved, That this Council, being f duly advised in the premises, finds that, by reason of unforeseen and, ggx�cessive claims which have accrued % charges against the same, or thel Accrual whereof as charges against thel same is certain and imminent, the City funds appropriated therefor and cred -i ited to the Board of Education Fund 15, are inadequate to Properly protect ii ^ RESOLVED, That this Council, being duly advised in the premises, finds that, by reason of unforeseen and excessive claims which have accrued as charges against the same, or the accrual whereof as charges against the same is certain and imminent, the City funds appropriated therefor and credited to the Board of Education Fund 15, are inade- quate to properly protect the public interests, and there has been created and now exists a sudden and unforeseen 1. emergency, on such account; that to meet said emergency it has become and is necessary that pursuant to Section 206 of the City Charter, the City borrow, temporarily, not to exceed the sum of $100,000.00, to be credited to said Board of Education Fund 15, Subfund Judgment and Compromise Item 15.65; that the Mayor and the Comptroller be and hereby are authorized and directed, for the purpose aforesaid, to borrow, in the City's behalf, not to exceed the sum of $100,000.00 and to-execute and deliver to the party or, parties making such loan, the promissory note of the City in the same principal sum, payable to such party or parties, bearing interest not to exceed five�per cent per COUNCILMEN Adopted by the Council 19— Yeas Nays DeCourcy Holland Approved 19— Loss Tn. O'Connell, City Clerk Bureau of Records 386 Court House St. Paul 2, Minnesota Dear Mrs. O'Connell: Herewith I am transmitting to you a copy of a reso- lution adopted by the Board of Education at its regular meeting on January 17, 1961, requesting the City Council to declare an emergency to exist under the provisions of the City Charter and authorizing the borrowing of an amount not to exceed $100,000 to be credited to the Board of Education, Judgment and Compromise Fund, for the purpose of paying the settlement in the Geraldine Fincel case. No. 3101 Mr. Louis Sheahan, Corporation Counsel, who represented the Board, stated that both the City Council and the Board of Education were sympathetic in this matter, but that•in fairness to the citizens of Saint Paul they would like to ascertain the liability before passing an enabling ordinance. Motion carried. * 15 - Joint Recreational Facilities between Board of Education and Depart- ment of Parks and Recreation and Public Buildings.- B.F. No. 3102 MOTION - Upon motion by Mrs. Paul, seconded by Mr. Mielke and carried, the following resolution was adopted: RESOLVED, by the Board of Education of the City of Saint Paul, that Chapter 407, Laws of Minnesota for 1959, approved on the 24th day of April, 1959, entitled "An act pertaining to the City of Saint Paul and authorizing the Board of Education of the City of Saint Paul and the Department of Parks and Recreation and Public Buildings of said City, upon concurrence by the Board of Education and the Council of the City, to engage in joint projects, and author- izing joint financing of such projects:" , a certified copy whereof is filed in the office of the City Clerk, shall be and said Act is hereby in all things approved; RESOLVED FURTHER, that the City Clerk, as the chief clerical officer of said City of Saint Paul, shall forthwith file with the Secretary of State a certificate in form prescribed by the Attorney General stating the essential facts necessary to said approval of said Act hereunder and including a copy of this resolution of approval of said Act. 16 - City and County Picnic - B.F. No. 3103 MOTION - Upon motion by Mr. O'Donnell, seconded by Mrs. Paul and carried, the following resolution was adopted: WHEREAS, the date of Thursday, July 23,, 1959, has been selected as the date for the City and County employes annual picnic to be held in Highland Park, and WHEREAS, the members of the Board of Education feel that this event does much to promote a wholesome and beneficial relationship among the City and County employes and desire to encourage the attendance of the employes; therefore, be it RESOLVED, that the proper school officials be and they are hereby authorized and directed to release those employes who wish to attend and participate in the picnic on July 23, provided, however, that department heads shall arrange for and maintain such skeleton crews as are necessary to conduct the business of their respective departments. V - ADJOURNMENT - MOTION - Upon motion by Mr. O'Donnell, seconded by Mrs. Paul and carried, the meeting adjourned at 5 :40 p.m. I hereby certify that Item 15 is a true and correct copy of Board File No. 3102 adopted by the Board of Education at its regular meeting on Tuesday, May 19, 1959.
