That the Zoning Code, Chapters 60 to 64 inclusive of the Saint Paul Legislative Code, as amended, pertaining to Use Districts, Height Districts'and Rezoning of certain properties in the City of Saint Paul, be and the same is hereby further amended so as to rezone the following described property from "A" Residence District to Commercial District: Easterly 10 feet of Lot 23, and all of Lots 24, and 25, Block 2, L. T. Lawton's SubdivisioncCx t7M of Kerwin' s,0utlots, subject to the following express exceptions and conditions: ° 1. Sauer to rezone from "A" residence to commercial property located on the north side of Hoyt Avenue'between White Bear Avenue and Flandrau Street. The property.is described as the easterly 10 feet of Lot 23, and all of Lots 24, and 25, Block 2, L. T. Lawton's Sub. of Lot 8 of Kerwin's Outlots. On November 10, 1960, the Commissioner of Finance reported the petition sufficient with the owners of 16 of a possible 19 (84 %) tracts of land within the prescribed 100 foot radius having signed the petition. The site is presently vacant and if rezoned, the petitioner proposes to develop it with an office building for pro- fessional people with off-street parking accessory thereto. The petitioner is agreeable to attaching a negative easement to this rezoning to limit the proposed commercial use of this property to those mentioned in the petition. l The property under consideration has a frontage along E. Hoyt Avenue of 90 feet extending to a depth of 126 feet, resulting in a total area of 11,340 square feet. South across Hoyt Avenue are single - family residences; west and adjoining are also single - family resi- dences; east and adjoining is vacant, commercially zoned land proposed to be developed by the Lincoln Federal Savings and Loan; north and across an improved public alley is vacant land classified "C" residence. The Board of Zoning considered this matter at their regular meet- ing on December 15, 1960, and recommend the granting of the petition to rezone the above described property from "A" residence to commercial sub ect to a negative easement limiting the commercial use to that o an office or clinic type building for doctors, dentists or othe p ofessionals with off- street parking accesssory thereto. / Sincerely, • H.'
