THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN:
Section 1. That the Zoning Code, Chapters 60 to 64 inclusive
of the Saint Paul Legislative Code, as amended, pertaining to
Use Districts, Height Districts and Rezoning of certain proper-
ties in the City-of Saint Paul, be and the same is hereby
further amended so as to rezone the following described property
from "A" Residence District to Commercial District:

according to the plat thereof on file and
of record in the Office of the Register
of Deeds in and for Ramsey County, �
Minnesota, being located on the south-
easterly side of Carter Avenue_just

2. That the owner of said real estate, within
the period of 60 days next succeeding the publi-
cation of this ordinance, shall file with the
City Clerk, in two (2) fully executed counter-
parts, said owner's written acceptance of this
ordinance, incorporating, among other things,
said owner's grant unto said City of Saint Paul
of a negative easement affecting said real estate
for the imposition, maintenance and enforcement
of the aforesaid restrictions and limitations
upon the employment and use of the hereinabove
described real estate, approved as to form and
execution by the Corporation Counsel and re-
cordable in the office of the Register of Deeds.
3. That, in addition to other requirements therefor,
said written instrument of acceptance and grant
shall incorporate a certified copy of this
ordinance, and immediately upon the aforesaid
filing of _ the__same the City.-Clerk-shall cause one
of such counterparts thereof to be filed of record
in the office of the register of Deeds
in and for Ramsey County, Minnesota.
Section 2. This ordinance is hereby declared to be
an emergency ordinance rendered necessary for the preserva-

Dear Madam:
This is in the matter of the petition of Mary Ann Milton, asking to rezone
Lot 36, Block 38, Si. Anthony Park, to a, "commercial" district. The
zoning classification of this property has been "A Residence" since the
enactment of the Zoning Code in 1922. The property is located on the
southeasterly side of Carter Avenue just southwest of Como Avenue.
On December 1, 1960, the Commissioner of Finance reported this petition
sufficient, in that the owners of 8 of a possible 11 tracts of land within
the prescribed 100 -foot radius of the property under consideration signed
the petition, or 72.7%.
This property has a frontage of 50 feet along Carter Avenue and a depth
of 150 feet which results in an area of 7,500 sq. ft. It is presently
developed with a sub - standard 3 -car garage of concrete block construction.
It should be pointed out that the major portion of this lot lies approxi-
mately seven (7) feet below the street grade of Carter Avenue. The
petitioner's intent is to develop this lot and the adjoining unimproved pub-
lic alley, now petitioned to be vacated and which will be considered by
the City Council on January 18, with an off - street parking lot for approxi-
mately 28 cars. This lot would be used in connection with the commercial
uses adjoining and fronting on Como Avenue.
Southwesterly and adjoining are single - family residences fronting on, and
established at, the street grade of Carter Avenue; northwesterly across
Carter Avenue is another single - family residence; directly north and
across Carter Avenue is a small sheet -metal shop, also a drug store
which fronts on both Carter and Como Avenues; northeasterly and across
the adjoining unimproved public alley is the property that wo uld be served
by the proposed parking facility; southeasterly and adjoining is the Common-
wealth Nursing Home which fronts on Commonwealth Avenue.
Field investigation discloses no objection to reclassifying this property
to a "commercial" district so that it may be used for off - street parking.
It appears there is a need for additional parking space in this area to
serve the commercial activities along Como Avenue. However, it is the
feeling of the Zoning Board that the commercial use of this property
should be limited to that of a parking lot only and, further, that the "C"

rezoning of Lot 36, Block 38, St. Anthony Park North, to Commercial District,
with the limitation, however, that said Commercial use be limited to tha f

in the immediate area if developed for parking purposes at the present
low elevation of the property and if it is properly screened.
In consideration of the above findings, the Board of Zoning recommends
the granting of this petition to reclassify the above - described property
to a "commercial" district with the limitation that said commercial
use be that of, a parking lot only.

Enclosed herewith please find Petition in Opposition to the rezoning of the
above described property for presentation to the City Council at the hearing
on the petition which is scheduled for December 29, 1960, at 10 :00 o'clock
A. M.
Please be advised that on behalf of the persons who signed the Petition in
Opposition. we will challenge the sufficiency of the petition. The owner of
Lot 6, Block 31, is shown on the petition as Elsie W. Finlayson. We are
advised that she is the fee owner and that Kenneth Mueller, 2278 Como
Avenue, is the contract vendee or is, as of now, the fee owner. You will
note that Mr. Mueller has signed the Petition in Opposition.
The owner of Lot 9, Block 31, is listed as Peter E. Fooshe. We are ad-
vised that Mr. Fooshe is merely the fee owner and that John B. Smith,
2249 Carter Avenue., is the contract vendee and is in possession. Mr. Smith
has also signed the Petition in Opposition. Under these circumstances,
the petition does not contain the required two - thirds consent.
