An ordinance prohibiting the furnishing, sale
or distribution commercially of obscene books,
and materials to minors, providing penalty for
the violation thereof, and repealing Sections
475.01 and 475.02 of the Saint Paul Legislative
Code. This is an emergency ordinance rendered
necessary for the preservation of the public
peace, health and safety.
THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN:
Section 1. Any person who knowingly gives, furnishes,
sells, offers to sell, distributes commercially, or has in his
possession with the intent to give, furnish, sell, offer to sell,
or distribute commercially to any minor or to any person for sale
or resale to any minor any obscene, lewd, lascivious or filthy
book, pamphlet, picture, motion picture, film, paper, letter,
writing, print or other matter of indecent character, shall be
guilty of a misdemeanor.
Sec. 2. Any person violating the provisions of
Section ,l of this ordinance shall, upon conviction thereof, be
punished by a fing not exceeding One Hundred Dollars ($100.00)
or by imprisonment for not more than ninety (90) days.
Sec. 3, Sections 475.01 and 475.02 of the Saint
Paul Legislative Code, pertaining to the sale "or distribution ,.
commercially to minors of certain books, -- magazines, comic
and other printed papers, be and the same are hereby, in all
things, repealed.
Sec. 4. This ordinance shall be deemed a part of .t_.—
the Saint Paul Legislative Code and shall be incorporated therein
and given an appropriate chapter number and /or section number at
the time of the next revision of the said Legisla ive Code.
Sec. 5. This ordinance is hereby declaimed t be an
emergency ordinance rendered necessary for the preser ti of of the
public peace, health and safety.
Sec, -6. This ordinance shall take effect and be in
force from and after its passage, approval and publication.
