This matter has a long and tortuous history part of which we share below. The essence, however, is that work performed on this street has never met the specifications initially designed by the City, has caused significant loss to the residents, damaged a historically important roadway and continues to be a source of ridicule by tradesmen and visiting friends. The vibrations caused by vehicles traveling this street can be felt in our homes, potentially damaging structures, feft by our cars when traveling the road and most likely lessens property values over future years. It is a source of constant irritation for which the City is now asking for an assessment almost finrice the 2006 base street assessment when this project began. Sadly, this never had to occur. Some on this block questioned the need to rip out the whole street to repair two smaller areas that had settled due to past water main problems (also, not repaired properly). We sought and were given assurances that the City knew what they were doing and understood the value that this street had to the surrounding community and us. This block is one of two remaining sections in St. Paul with the original sandstone cobbles that used to decorate this City. There are other biocks that have cobbles, or rather brick, of a later age, but only this block and another on lower Osceola still reflect the beauty and durability that we and many in this City have grown to love and value. The street has required no maintenance for over ninety years, saving City funds over asphalt construction that needs frequent resurfacing and repair. We on the block have nonetheless paid annual street maintenance fees for these ninety years without objection. The City has collected well over $50,000 in just that component directed at asphaR repair, which was never required or performed on this block. This upset some of us, but we heid our opinions. We value this City and respect its historical character. When the City informed us of their intentions to "repair" our street, many of us attended meetings, called and discussed concerns with the City, and sought reassurances that proper care in reconstruction would ensue. It appeared to some of us that littie thought, and even less knowledge, was being given to this work. We were informed after the street was ruined that these concems were not only true, but even worse — the City had sought little or no input into the construction methods, design needs, or even pursued inputs provided by the citizens on our block. After countless meetings, emaif and tefephone conversations, over the first year of this project the City agreed, `The street surface is not acceptable."' What they did next shocked us. Rather than seek appropriate compliance with the contracted specifications, they arbitrarily changed the specfications, claimed that the previously smooth surFace was only due to wear over 90 years of use, and asserted that the extremely rough surface was good for traffic calming! Driving over 15 mph is indeed difficult, but that is not a positive value. The City also agreed to "monitor the corrective effort and document tolerance measurements." We assert that that, if done, this was of the most cursory nature (many of us are present during the work day). After a second attempt to repair this street, it is still out of compliance — not only with the contracted specifications, but also with the waiver the City provided to make this go away. When this was repeatedly brought to their attention, the City cVaimed that a special binder material would be added to stabilize the cobbles, smooth the surface and avoid the washouts that were occurring on the hilly portion of the road. The washouts are still occurring though less so and there was no other pos+tive effect. The City finally admitted that it did not understand the task and would seek information from the City of Minneapolis and others on how to "fix" the block. That also never happened. The list of improper work is lengthy: cracks in concrete driveways and walks, cheap sod that doesn't grow even when fertilized and watered and driveways out of alignment. The contractor even killed a beautiful old tree, tearing roots out so badly the tree was in danger of failing over — simple carelessness. The contractor, under the supervision of the City, was incompetent and failed to restore a beautifui and historic street. We are incensed at having to pay premium assessment fees for work that is not only sub-standard; it failed to meet contracted spec�cations. The Citizens of 800-900 Block of Osceola recognize that the City has financial woes and our request recognizes this difFcultly. Many do not feel that we should pay anything for such incompetent work that taxed us so severely during the construction and will now and in the future. We were repeatedly ignored, though our input would have saved the City much. tiowever, this is our City and we would suggest a compromise. The standard rate for "City-wide residential street paving was $30.41 per foot in 2006." The "calculation of Assessment rates for Osceola, Milton to Victoria 9-7-06"' for the actual cost of construction was: $8.86 for Granite Curb work and $25.08 for the sandstone pavers or $33.94 per foot. To this latter number an arbitrary and unexplained amount of $9.41 ($30.41-$21) was added on top from the "standard ' Letter from Bruce Beese, Director of Public Works, dated May 22, 2007 2 ibid. 3 Public hearing Notice, Public Improvement Construction, dated April 5, 2006 4 Worksheet provided by Public Works, dated 9-7-06 rate," $2.52 above the "standard assessment" was added for Engineering and Inspection and $.97 was added as the difference between costs and Council Approval without explanation. Of these last costs, there was clearly no Engineering and inspection and the other charges have no support. Any additionaf costs incurred on the project beyond those quoted cannot be seen as anything other than rework necessitated by the initial failure to meet the contractual specfications or possibly resultant from a Water Departrnent project that was added later and not part of this assessment. We would like not to pay this assessment at all. We would like our street fixed. We would like recognition of the maintenance savings the City has enjoyed and will confinue to enjoy. Fiowever, we propose a compromise for this assessment. Either assess using the standard assessment of $30.41 per foot (most fair) or the construction estimate for sandstone and granite installation of $33.94 per foot. We thank you for your consideration. The work performed in 2006 as part of the larger Chatsworth Goodrich RSVP has left our street almost un-drivable and does not meet the contracted specifications for that work. Our attempts to raise these concerns began during the construction phase and have been communicated in email, in person and in several meetings, without adequate response. We wish to raise this issue to your attention and to seek remedial actions. As you may know, our street is historic cobblestone — its value to the larger neighborhood is great and an asset to our city. We agreed to be assessed at a higher rate than nearby reconstruction, even though we felt the street is of City importance. There are only two such sections remaining. This cobblestone is dearly held by the neighborhood and appropriate care in reconstruction is important to us. As early as July of 2006 we requested information from the Department of Public Works concerning the Contractor's qualifications. Your Project Engineer, Lisa Falk, assured us that the chosen Contractor and his subcontractor were qualified and capable although they had not previously done such work specifically. In September of 2006, we requested further information concerning the contracted specifications and suggested that certain items be included. Those items included proper compaction, roll/density verification tests of sub-base, crown elevations, joint widths, surface planarity, fill materials, bond lines and so forth. We again stressed the importance of contractor skill and, more so, the need for close supervision to ensure proper task completion. Your departmenYs reply; "the list of items you had as concems are all addressed in the specifications that are included in the contract. We will be working closely with the subcontractor as they start the work, to help him resolve concems he or we have with how it is going." We recognize that large projects can have issues. In the street repair work completed on our block, there have been many difficult issues, some of which were quickly addressed, others not. The project itself was delayed often as the Public Works Department and the Water Department struggled with competing priorities and budgets. Indeed, there is some sympathy for the Subcontractor who, affected by those delays, re-laid cobblestones in very cold weather. However, those difficulties are not a pardon for inadequate supervision or contract compliance. We do not welcome the thought of additional remedial street work again this summer. However, we have a street that is significantly worse than before it was removed and replaced last year. In our most recent request to have the contracted specifications adhered to, we felt rebuffed again. We requested specification compliance and were advised "the Contractor will be returning to make adjustments and repairs to the pavement." The entire tone of the response, it's lack of appropriate attention, even avoidance, to the Page 1 requested specification compliance left us very unhappy and concemed. We are uncertain as to the City's intent. We do not want to be assessed for a street that clearly does not meet your own specfications and is poorer quality than the one we had. Additionally, we feel that its current condition will only accelerate the need for on-going long term maintenance when clearly the intent was to have less. We are writing to request that the City: 1. Meet with the neighborhood and gathes a list of all outstanding work to be done (among those items: a smoother street as the primary priority; curbs improperly installed; washouts along gutters; cracked and broken sidewalk panels and driveway aprons, what to do about vibrations that are shaking homes, proper cleaning of construction debris, etc.) 2. Provide a written document declaring when and what work will be performed. 3. Provide assurances that contracted specifications will be met. 4. Provide adequate supervision, including the testing for contact compliance, to ensure proper completion of the work — prior to sign-off or payment to contractors. 5. Provide a list of what on-going maintenance will be completed on a yearly basis on our street including repairing wash-outs, loose cobblestones, top- dressing with joint sand and the like. We already have "no parking" signs taped to trees, indicating some work expected for the month of May. We woutd appreciate meeting with City personnel, including supervisors of the project staff, and completion of an agreed plan of action prior to the end of May.
