RESOLUTION
1 WHERE , e Street Grille, Inc. d/b/a Eagle Street Grille, located at 174 7th Street West in
2 Saint Paul, has requested a waiver of the 15-day notice requirement for expansion of the liquor service area
3 into 1200 square feet of basement space previously used for stoxage, which would increase the total seat
4 count to 148 seats; and

WHEREAS, the West 7th Fort Road Federation has agreed to the waiver of the notice
requirements; and
9 WHEREAS, the Council finds that the application is in order and there are no grounds for denial of
10 the license and that the failure to grant the waiver and the consequent delay in approving the license would
11 cause exceptional and unusual hardship to the license applicant; and
12
13 WHEREAS, the licensee agrees that in the event a complaint is received prior to the expiration of
14 the 15-day period and the complaint provides a basis for adverse action against the license, that the Office
15 of License, Inspections, and Environmental Protection may direct the licensee to immediately discontinue
16 all operations until a public hearing is scheduled, and that the licensee shall comply with said directive;
17 now, therefare, be it,

19 RESOLVED, that the IS day notice requirements of § 40911 ofthe Saint Paul Legislative Code
20 are hereby waived and expansion of the liquor service area into the basement is hereby approved for
21 Eagle Street Grille, Inc. d/b/a Eagle Street Grille, located aT 174 7th Street West in Saint Paul, subject to
22 the agreement stated above; and be it

2�} FURTHER RESOLVED, that the expanded space shall not be occupied until a Certificate of
25 Occupancy is issued by the City of Saint Paul Building Official.

We at Eagle Street Grille would like to expand our private dining area in the basement of Eagle
Street into the new side for liquor and beverage service. We have existing service down stairs and
upstairs. We also have existing service in the upstairs of new proposed side which was expanded in
