3 WHEREAS, Robert D McCullough, in File No. 08-122-138, has submitted for City Council approval the .
4 attached preliminary and final plat for McCuilough Addition, NE corner of Jackson St. and 9th St., to create
5 three commercial parcels; and

7 WHEREAS, the appropriate City departments have reviewed the plat and found, subject to the recommended
8 conditions, that it meets the requirements of Chapter 69 of the Zoning Code; and

l0 WHEREAS, notice of a public hearing before the City Council was duly published in the official newspaper of
11 the City and notices were mailed to each owner of affected property including all property situated within 350
12 feet of the subject property; and

14 WHEREAS, the City Council heid a public hearing on the proposed plat on September 17, 2008, where all
15 interested parties were given the opportunity to be heard, and the Council considered all the facts and
t6 recommendations concerning the plat;

1. A parkland cash dedication in the amount of $4,513 is paid prior to the city clerk signing the finai plat.
2. The required ingress, egress, and emergency access easements are recorded after recording of the
final plat.
3. All building openings at the property line must be fire blocked in accordance with section 704.7 of the
2006 Internationai Building Code with 2007 Minnesota amendments. A permit for this work shall be
obtained prior to the city clerk signing the final plat.
4. The applicant shall file a copy of the Council Resolution approving the Final Plat with the Ramsey
County Recorder's Office.
AND BE {T FURTHER RESOLVED, that the City Clerk sha41 mail a copy of this resolution to the Applicant,
the Zoning Administrator, and the Planning Administrator.

A. PURPOSE: Combined Plat for McCuliough Addition to create three commercial parcels
B. PARCEL SIZE: 149.69 ft. (Jackson St.); 140.85 ft. (9�' St.) total area of 20,584 sq. ft.
C. EXISTING LAND USE: Commercial structures and parking lot
D. SURROUNDING LAND USE: The site is surrounded by downtown mixed uses, including
residentiaf, commercial, and parking
ZONING CODE CITATION: §69.301 states that platting is required when a subdivision (1) creates
five or more lots or parcels each of which is 2'/ acres or less in size, or (2) requires paved streets,
alleys and other public improvements, or (3) is previously unplatted land. §69.304 lists conditions for
lot spiits and adjustments of common boundaries. §69.406 provides criteria for review of subdivision
applications. These criteria are covered below under "Required Findings." §69.511 regulates
parkland dedication.
HISTORY/DISCUSSION: During the 1950's and 1960's, a series of four permits were approved for
parking lots on a portion of this site.
DISTRICT COUNCIL RECOMMENDA710N: District 17 had not commented at the time this staff
report was prepared.
H. REQUIRED FINDINGS: § 69.406 of the Zoning Code requires that all of the following findings shall
be made prior to approval of a subdivision:
1. All the applicable provisions of the Legrslative Code are comptied with. City staff have
reviewed the proposed plat and have determined that, subject to the recommended conditions,
all appiicable provisions of city codes are met.
2. The proposed subdrvision will not be defrimental to the present and potential surrounding land
uses. The proposed plat is consistent with the surrounding land uses and will not be
detrimentai to present and future use of surrounding land. ,
3. The area sur�ounding the subdivision can be planned and devefoped in coordination and
compatibility with the proposed subdivisron. The area surrounding the proposed plat is already
devetoped and compatibfe with the proposed plat.
4. The subdivision is in conformance with the comp�ehensive ptan. The subdivision is in
conformance with the Downtown Development Strateav, a chapter of the comprehensive
plan amended and adopted in 2005, which shows commercial uses at this location on its land
use map. It is also in conformance with redevelopment plans for the area.
5. The subdivision preserves and incorporates the site's importanf existing natural features
whenever possible. The site is in a fully-developed part of St. Paul with no remaining natural
features.
6. All land intended for building sites can be used safely without endangering residents by pe�il
from f/oods, erosion, continuously high �vater tabte, severe soii conditions or othe� menace.
The site is a flat, fully developed area with no flooding, erosion, high water table or soil
condition problems. �

7. The subdivision can be economically served with public facilities and services. The subdivision •
can be economically served with public facilities and services from surrounding streets.
I. PARKLAND DEDICATION: §69.511 requires dedication of two (2) percent of the total land area
of the plat for public use, for parks, playgrounds, trails, open space, or conservation purposes. At
the discretion of the City Council, a cash dedication in lieu of land may be paid prior to the city
clerk's signing of the final piat.
For this subdivision, staff recommends cash dedication in the amount of $4,513 in lieu of
dedication of land.
J. STAFF RECOMMENDATION: Based on required findings 1 through 7, staff recommends approval
of the preliminary and final plat for McCullough Addition subject to the foAowing conditions:
1. A parkland cash dedication in the amount of $4,513 is paid prior to the �ity clerk signing the
final plat.
2. The applicant shall file a copy of the Council Resolution approving the plat with the Ramsey
County Recorder's Office.

On July 23, 2008, you submitted an application for a Combined Plat for McCullough Addition to
create three commerical parcels at the northeast corner of Jackson Street and 9` Street. City
staff have reviewed the preliminary plat and have identified the following issues:
Department of Public Works (contact is Colleen Paavola, 651-266-6104):
1. The properfy immediately adjacent and nartheasterly of this praposed plat has been platted
as PRIfVTERS ROW ADDITION. This plat should acknowledge and show this existing plat
as required by MN § 505.021 Subd. 4. Additionally, the aforementioned plat dedicated
Temperance Avenue through a portion of the adjacent property within 100 feet of the
boundary of this proposed plat; per City of Saint Paui Development Code § 69.401 Subd. B
sub-section 4. This street should be shown on the preliminary plat.
2. The dimension shown along the easterly line of proposed Lot 3 differs from the dimension
shown for the same line on the underlying AUDITOR'S SUBDtVISIQN No. 24. The
difference should be explained by the indication of plat and measured disfances.
3. The proposed easements as shown on the fourth sheet of this submittal (For "Trash Area"
and "Ingress/ Egress" must be created and recorded separate from fhis proposed plat.
PED Zoning (contact is Paul Qubruiel, 651=266-65&3): No issues.
Department of Safety and Inspections (DSI) (contact is Mary Mantgomery, 651-266-9088):
1. Provide a copy of the proposed ingress/egress and trash easements.
2. Submit a site plan for a site plan review. Some of the issues will be storm water
management and storm water easements, parking issues, trash collection area
requi�ements.
3. Does the underground telephone line on lot 2 only serve lot 2 or is this an easement issue?
4. From Plan Review staff: openings at the property line aren'f allowed per code sectian tabfe
704.7 of the 2006 IBC with the 2007 Minnesota amendments. Applicant will be required to
meet alf state building code requirements.

Tfie ingress/egress easement needs to have an added statement about access for emergency
responders. All of these properties are required to have fire department_access per the 2Q07
Minnesota State Fire Code.

Division of Parks and Recreation (contact is Jody Martinez, 657-266-6424):
Parks and Recreation has reviewed the subdivision per the Parkiand Dedication Ordinance, §.
69.511 of the St. Paui Leg. Code, and has determined tfiat the parcel of land (.01 acres)
required as dedieation is not of a suitable size or location to meet the criteria of desirable land
for park development. Staff will thus recommend to the Gity Council that cash dedication in the
amount of 4 573 be accepted in fieu of land. This recommendation will be forwarded to the
Council for their decision at the public hearing on the preliminary and final plats.
Based on these commet�ts, staff approves the prefiminary plat subject to the following
condition(s):
Issues raised by the Department of Public Works regarding the plat are addressed and the
plat is revised accordingly.
2. Amend easement document(s} as necessary ko address Fire Prevention concems, and
provide a copy of the easement documents for review by the Department of Safety and
inspections prior to recording.
Please submit 10 fuil - sized copies of the revised final plat and one copy of the finai pfat
reduced to 8'/ X 11 to the Zoning Desk, 1400 City Hall Annex, so that a public hearing can be
