RESOLVED, that City of Saint Paiil Ordinances Nos. 12159, 12160 and 121619 respectively, granting and providing for the issuance of several permits for the construction and maintenance of Vehicular'Ramps, Areaways, and other public use street installations,'*ithin the several public'street "areas therein defined, unto The Dayton Company, et al,.'shall be deemed incorporated herein by reference and made part of this Resolution; that it is determined that the installation of subsurface sheeting or comparable supporting material abutting the outer curb line and extending, within the vehicular roadway area of , ,9sid several sections of public streets, in each instance, by the applicable ordinance was contemplated as a necessary inci- dent to the subject construction w.ork in the exercise of the pertinent permit,-by the permittee or permittees designated and shall be deemed to have been authorized by the applicable ordinance in each case and the permit issued pursuant to the same; that the permittee'or permittees, under each such ordinance and the surety and Irnsurer of the permittee or permittees, in each such case, shall be deemed obligated to hold harmless -and fully indemnify the City of Saint Paul against all liability for damages on account_of...any injury to person or property resultant "- from'any such installation of sheeting or comparable supporting material under any such ordinance or permit issued pursuant to the same, all with the same intent, purpose and effect as if express provision for such installations were made in the applicable ordinance or permit; and that the permittee or permittees, in each such case, and surety, shall be deemed further obligated to fully indemnify said City against all loss and to fully reimburse said City on account of all expense which shall be occasioned to said City by reason of any disturbance of the structure of said street or breakage of the paV'ement, curbing.or sidewalk of the same by reason of any -such installation or by reason -of the prosecution of the work therefor, all with the same intent, purpose and effect as if express provision for such installations were made in the applicable ordinance or permit; and COUNCILMEN Adopted by the Council 19— Yeas Nays DeCourcy Holland Approved 19— Loss Tn Favor Mortinson Peterson Mayor Rosen Against Mr. President, Vavoulis ISM 6-01 0 ORIGINAL TO CITY CLERK 2v65 • i CITY OF ST.
