This property is legally described as follows, to wit: STINSOI3'S ADDITION TO THE CITY OF SAINT PAUL IN THE STATE OF MINNESOTA S 5 FT OF LOT 15 AND ALL OF LOT 18 BLK 13 WHEREAS, based upon the records in the Ramsey County Recorder's Office and information obtained by Department of Safety and Inspections on ar before February 15, 2008, the following are the now known interested or responsible parties for the Subject Property: Washington Mutual Bank, PO Box 320Q Milwaukee, WI 53224; Reiter & Schiiler, 25 N Dale St, St. Paul, MN 55102; Jeff Kubitschek Properties, PO Box 270922, Vadnais Heights, MN 55127; Minnesota BPO/ REO, Dawn Reinke/FNMA, 2026 Edgewood Circle, Shakopee, MN 55379; District 5 Planning Council. WHEREAS, Department of Safety and Inspections has served in accordance with the provisions of Chapter 45 of the Saint Paul Legislative Code an order identified as an "Order to Abate Nuisance Building(s)" dated June 3, 2008; and WHEREAS, this order informed the then known interested or responsible parties that the struchxre located on the Subject Property is a nuisance building(s) pursuant to Chapter 45; and �WHEREAS, this order informed the interested or responsible parties that they must repair or demolish the structure located on the Subject Property by July 3, 2008; and WHEREAS, the enforcement officer has posted a placard on the Subject Property declaring this building(s) to constitute a nuisance condition; subject to demolition; and WHEREAS, this nuisance condifion has not been corrected and Department of Safety and Inspections requested that the City Clerk schedule public hearings before the Legisiative Hearing Officer of the City Council and the Saint Paul City Council; and WHEREAS, the interested and responsible parties have been served notice in accordance with the provisions of Chapter 45 of the Saint Paul Legislative Code, of the time, date, place and purpose of the public hearings; and WHEREAS, a hearing was held before the Legislative Hearing Officer of the Saint Paul City Council on Tuesday, August 26, 2008 to hear testnnony and evidence, and after receiving testimony and evidence, made the recommendation to approve the request to order the interested or responsible parties to make the Subject Froperiy safe and not detrimentai to the public peace, health, safety and welfare and remove its blighting influence on the community by rehabilitating ------ ,� , - - - - 45 46 47 48 49 50 51 52 53 54 55 56 57 58 59 60 61 62 63 64 65 66 67 68 69 70 71 72 73 74 75 76 77 78 79 80 81 82 83 84 85 86 87 _ - -- ---_ - this structure in accordance with all applicable codes and ordinances, or in the alternative by demolishing and removing the structure in accordance with all appiicable codes and ordinances. The rehabilitation or demolition of the structure to be completed within fifteen (15) days after the date of the Council Hearing; and WHEREAS, a hearing was held before the Saint Paul City Council on Wednesday, September 17, 2008 and the testimony and evidence including the action taken by the Legislative Hearing Officer was considered by the Council; now therefore BE IT RESOLVED, that based upon the testimony and evidence presented at the above referenced public hearings, the Saint Paul City Council hereby adopts the following Findings and Order concerning the Subject Property at 748 DESOTO ST . 1. 2. That the Subject Property comprises a nuisance condition as defined in Saint Paul Legislative Code, Chapter 45. That the costs of demolition and removal of this building(s) is estimated to exceed five thousand dollars ($5,000.00). That there now exists and has existed multiple Housing or Building code violations at the Subject Property. 4. That an Order to Abate Nuisance Building(s) was sent to the then known responsible parties to correct the deficiencies or to demolish and remove the building(s). 5 � .� That the deficiencies causing this nuisance condition have not been corrected. That Department of Safety and Inspecrions has posted a placard on the Subject Property which declares it to be a nuisance condition subject to demolition. That this building has been routinely monitored by Department of Safety and Inspections, Vacant/Nuisance Buildings. That the known interested parties and owners are as previously stated in this resolution and that the nofification requirements of Chapter 45 have been fulfilled. ••� • The Saint Paul City Council hereby makes the following order: The above referenced interested or responsible parties shall make the Subject Property safe and not detrimental to the public peace, health, safety and welfare and remove its blighting influence on the community by rehabilitating this structure and correcting all 45 96 97 98 99 100 101 102 103 104 105 de�iencie's as prescribed in the above referenced Order to Abate Nuisance Building(s) in accordance with all applicable codes and ordinances, or in the altemative by demolishing and removing the structure in accordance with all applicable codes and ordinances. In the event the building is to be demollshed and removed by the City of Saint Paul, all personal property or fixtures of any kind which interfere with the demolition and removal shall be removed from the property by the responsible parties by the end of this time period. According to our files, it has been a vacant building since January 17, 2008. The current property owner is Washington Mutual Bank, per AMANDA and Ramsey county property records. The City of St. Paul has boarded this building to secure it from trespass. There have been three (3) SUMMARY ABATEMENT NOTICES since 2008. There have been four (4) WORK ORDERS issued for: - Removal of improperly stored refuse and miscellaneous debris - Removal of snow and ice - Removal of tall grass and weeds - Boarding On May 13, 2008, an inspection of the building was conducted, a list of deficiencies which constitute a nuisance condition was developed and photographs were taken. An ORDER TO ABATE A NUISANCE BUILDING was posted on June 3, 2008 with a compliance date of July 3, 2008. As of this date this property remains in a condition which comprises a nuisance as defined by the legislative code. The Vacant Building registration fees are paid. As owner, agent or responsible pariy, you are hereby notified that if these deficiencies and the resulting nuisance condition is not corrected by July 3, 2008 the Deparhnent of Safety and Inspecrions, Division of Code Enforcement, will begin a substantial abatement process to demolish and remove the building(s). The costs of this action, including administrative costs and demolition costs will be assessed against the property taxes as a special assessment in accordance with law. Property Owner, Mazk Pasvogel, 7r., President of Bye Property, LLC., appeared. Mr. Magner stated the building was a two-story, wood frame, duplex dwelling with a detached garage on a lot of �,663 squaze feet and had been vacant since January 17, 2008. A code compliance inspection had been done on June 6, 2008. The vacant building registration fees were paid, and the $5,000 performance bond had not been posted. On May 13, 2008, an inspection of the building was done and a list of deficiencies which constitute a nuisance condition was developed. An order to abate a nuisance building was posted on June 3, 2008 with a compliance date of July 3, 2008. To date, the property remained in a condition which comprised a nuisance as defined by the Legislative Code. Ramsey County T�ation estimated the market value of the land to be approximately $37,100 and the building to be $162,000. Real estate taxes for were current. Code Bnforcement estimates the cost to rapair the building to be approximately $SQ000 to $60,000. The cost for demolition was estimated to be approximately $13,950 to $17,950. There had also been three sutnmary abatements issued to this properry since 2008, four of which went to work order: to secure the building and the City had to boazd the building to secure it from trespass, remove improperly stored refuse, cut tall grass and weeds, and remove snow and ice. Code Enforcement recommends the building be repaired or removed within 15 days. Mr. Magner presented photographs of the property. Ms. Moermond asked whether Mr. Pasvogel acquired the property from WaMu. Mr. Pasvogel stated that at the time, he was represented by a realtor when he acquired the property. He got a construction staxement of an amount of $62,100. Ms. Moermond asked for a report from Ms. Barr. Ms. Barr stated that this building was consriucted in 1875. It is a double house with front porch enclosed and the original siding was covered. On the east side of the block, there is good integrity and on the west, there is interesting topographical feature with the trees and hills. The side context is good and Staff strongly encouraged rehab on the buildings. Ms. Moermond asked how they became aware this was a vacant building. Mr. Magner stated that it was referred by the Fire Prevention staff on January 11, 2008. At that time, it was condemned for water and interior/exterior violations. The building was occupied at the time. Ms. Moermond explained the reason for the condemnation and its process to Mr. Pasvogel. Ms. Moermond recommended he provided the following by the close of business September 10: 1) the $5,000 performance bond must be posted; 2) the vacant registration form must be completed (one was given at the hearing); 3) a work plan; and 4) financial documentation.
